Worlds Together . . . Words Apart: An Assessment Of The Effectiveness Of Arts-Based Curriculum For Second Language Learners, Stephanie Urso Spina

Publications and Research

The objective of this study is to assess whether authentic arts-based1 curricula facilitate the acquisition of English as a second language (ESL) without sacrificing proficiency in the first language (Spanish). This question is examined theoretically and empirically. First, the use of an arts-based curriculum is positioned within a Vygotskiian framework of learning as reflected in current research. This overview is organized by two themes: 1) the authenticity of the art experience and 2) the emphasis on social interaction and the cognitive mediation among sign systems. Applicable findings from related literature are reviewed and synthesized within each of these themes. Secondly, …

The Reality Of Computer-Mediated Communication: An Examination Of An Online Dating Service, James W. Peoples Iii Jan 2006

The Reality Of Computer-Mediated Communication: An Examination Of An Online Dating Service, James W. Peoples Iii

Student Work

This was an exploratory study to investigate how online users portrayed themselves when using online personals in order to introduce themselves to a prospective partner in hopes of friendship, dating, or possible marriage. The primary method of examining the applicants was by the use of the online resumes that they placed on Yahoo. This study used 72 resumes from heterosexual applicants, male and female, between the ages 18 and 67, evenly proportioned across 5 year age groups, to examine the close-ended answers and open-ended statements that applicants provided. The main perspectives used in analyzing the resumes included Erving Goffman’s Presentation …

Body Image And Beliefs About Appearance: Constraints On The Leisure Of College-Age And Middle-Agewomen, Toni Liechty, Patti A. Freeman, Ramon B. Zabriskie

Faculty Publications

The purpose of this study was to examine the relationships among body image, beliefs about appearance, and leisure constraints for college-age women and their mothers. The Body-Image Assessment Scale, the Beliefs About Appearance Scale, and a hierarchical leisure constraints scale were used to assess body image concerns, and leisure constraints. A convenience sample of 116 female students at a private American university and 76 of their mothers was utilized. Multiple regression and t-tests were used to analyze the data. Findings suggested that body image and beliefs about appearance pose leisure constraints for college-age and middle-age women. Findings also suggested that …

The Next Epidemic: Bubbles And The Growth And Decay Of Securities Regulation, Erik F. Gerding Jan 2006

The Next Epidemic: Bubbles And The Growth And Decay Of Securities Regulation, Erik F. Gerding

Publications

This article explores how speculative bubbles undermine the effectiveness of securities regulations and spawn epidemics of securities fraud. A brief historical survey demonstrates that stock market bubbles almost invariably coincide with epidemics of securities fraud, and provides a compelling argument that the outbreak of fraud in the Enron era did not stem merely from factors unique to the 1990s, but from the dynamics of an asset price bubble as well.

Drawing on perspectives from securities law practice and economic theory, the article argues that bubbles dilute the deterrent effect of antifraud rules and promote deregulation. Both effects alter the calculus …

The Unexpected Value Of Litigation: A Real Options Perspective, Joseph A. Grundfest, Peter H. Huang Jan 2006

The Unexpected Value Of Litigation: A Real Options Perspective, Joseph A. Grundfest, Peter H. Huang

Publications

In this Article, we suggest that litigation can be analyzed as though it is a competitive research and development project. Developing this analogy, we present a two-stage real option model of the litigation process that involves sequential information revelation and bargaining over the surplus generated by early settlement. Litigants are risk-neutral and have no private information. The model generates results that, we believe, have analytic and normative significance for the economic analysis of litigation

From an analytic perspective, we demonstrate that negative expected value (NEV) lawsuits are analogous to out of the money call options held by plaintiffs and that …

Against "Academic Deference": How Recent Developments In Employment Discrimination Law Undercut An Already Dubious Doctrine, Scott A. Moss Jan 2006

Against "Academic Deference": How Recent Developments In Employment Discrimination Law Undercut An Already Dubious Doctrine, Scott A. Moss

Publications

When the defendant in an employment case is a college or other institution of higher education, the plaintiff usually will face an "academic deference" argument. Citing the importance of their "academic freedom," defendants and sympathetic courts have asserted that federal courts should decline to "invade" higher education with "federal court supervision." Whether or not courts cite the "academic deference" doctrine expressly, they certainly have proven hostile to professors' claims of discrimination, dismissing as a matter of law claims that seemed quite strong, or at least solid enough to allow a factfinder to rule either way. Indeed, empirical evidence shows that …

Raising The Red Flag: The Continued Relevance Of The Japanese Internment In The Post-Hamdi World, Aya Gruber Jan 2006

Raising The Red Flag: The Continued Relevance Of The Japanese Internment In The Post-Hamdi World, Aya Gruber

Publications

In the years since the terrorist attacks of September 11th, the Japanese interment has re-emerged as a topic of serious discourse among legal scholars, politicians, civil libertarians, and society in general. Current national security policies have created concerns that the government has stepped dangerously close to the line crossed by the Roosevelt administration during World War II. Civil libertarians invoke the internment to caution policy-makers against two of the most serious dangers of repressive national security policies: racial decision-making and incarceration without process. Bush defenders advance several arguments in response to internment comparisons. The most conservative is an ardent defense …

Victimizing The Abused?: Is Termination The Solution When Domestic Violence Comes To Work?, Nicole Buonocore Porter Jan 2006

Victimizing The Abused?: Is Termination The Solution When Domestic Violence Comes To Work?, Nicole Buonocore Porter

Faculty Publications

Domestic violence occurs in the workplace more frequently than one might presume. Workplace violence is the number one cause of death for women in the workplace in part because of domestic violence spillover, where an abuser harms his victim as well as any co-workers who try to intervene.

The conflict between domestic violence and the workplace is often exposed in its rawest state when a victim of domestic violence is considered to be a threat to the workplace by her employer.

The initial reaction of most people when hearing of [a] hypothetical [in which an employer fires a domestic violence …

Religion And State: Some Main Issues And Sources, John M. Finnis Jan 2006

Religion And State: Some Main Issues And Sources, John M. Finnis

Journal Articles

Public reason's default position is not atheism or agnosticism about the dependence of everything on a transcendent Creator. On the contrary, there is good reason to judge that there is such a transcendent cause, capable of communicating with intelligent creatures, that one of the world's religions may be essentially true and others substantially truer than atheism, and that there is a human or natural right to immunity from coercion in religious inquiry, belief (or unbelief, precisely as such), and practice so far as is compatible with public order, that is with the rights of others, public peace and public morality. …

Service-Learning In Watershed-Based Initiatives: Keys To Education For Sustainability In Geography?, James Eflin, Amy L. Sheaffer

Service Learning, General

A call for combining the strengths of geographic education with environmental education to produce an 'education for sustainability' addresses local problems for sustainable development. A place-based approach encourages civic responsibility among students. Using service-learning to extend education beyond the classroom in this case study connected students with local clients in a watershed-based initiative. Theoretical underpinnings of service-learning for geographic education are discussed, and the case study is viewed from instructor, student, and client perspectives to identify successful outcomes and provide suggestions for those who might adopt service-learning for the first time.

The Design Of An Undergraduate Degree Program In Computer & Digital Forensics, Gary C. Kessler, Michael E. Schirling

Security Studies & International Affairs - Daytona Beach

"Champlain College formally started an undergraduate degree program in Computer & Digital Forensics in 2003. The underlying goals were that the program be multidisciplinary, bringing together the law, computer technology, and the basics of digital investigations; would be available as on online and oncampus offering; and would have a process-oriented focus. Success of this program has largely been due to working closely with practitioners, maintaining activity in events related to both industry and academia, and flexibility to respond to ever-changing needs. This paper provides an overview of how this program was conceived, developed, and implemented; its evolution over time; and …

The Mirrored Walls Of Reality:A Journal Of Shattered Reflection, Lisa Bryant Jan 2006

The Mirrored Walls Of Reality:A Journal Of Shattered Reflection, Lisa Bryant

Electronic Theses and Dissertations

Theatre in its most crude, poignant, and honest form exists as the unapologetic mirror of our world. It houses the piercing reflections of mankind's hope, fear, self-doubt, passion, joy, despair, brilliance, destitution, and desire. It becomes the image of all that man hopes to be, yearns to achieve, and knows he has destroyed. Theatrical performance is without equal in its ability to conjure visible truth from the reflection man sees everyday and hopelessly fails to recognize. Ultimately, theatre demands that man see himself without the masks of excuse, ignorance, or makeup. It is the vision of this journey to honor …

This thesis will explore the application of comemdia dell'arte technique to a contemporary performance. UCF's spring 2005 production of Molière's The Trickeries of Scapin will serve as a resource in both commedia dell'arte's ability to resonate with a modern audience as well as an analysis of the actor's process in fusing elements of commedia dell'arte and contemporary acting techniques. This document will include a thorough description of the history and origins of commedia dell'arte in order to decipher existing elements today. Also included, will be major influences on commedia dell'arte including Greek and Roman Comedy. It is important to discuss …

Tya Methodology Twentieth-Century Philosophy, And Twenty-First Century Practice: An Examination Of Acting, Directing, And Dramatic Literature, Allen Mccoy Jan 2006

Tya Methodology Twentieth-Century Philosophy, And Twenty-First Century Practice: An Examination Of Acting, Directing, And Dramatic Literature, Allen Mccoy

Electronic Theses and Dissertations

Throughout the twentieth century, theatre for young audiences (TYA), or children's theatre, has been situated as something "other" or different than adult theatre, a kind of theatre--but not really theatre, a construct which opened the door to numerous "how to" philosophies geared specifically toward the theatre for young audiences practitioner. As a twenty-first century theatre practitioner, I am interested in how these philosophies are situated within or against current professional practices in the TYA field. This interest led me to the main question of this study: What are the predominant twentieth-century philosophies on acting, directing, and dramatic literature in the …

Henry James, Virginia Woolf, And Frank Lloyd Wright: Interiority, Consciousness, Time, And Space In The Modernist Novel And The Home, Carol Michaelsen Jan 2006

Henry James, Virginia Woolf, And Frank Lloyd Wright: Interiority, Consciousness, Time, And Space In The Modernist Novel And The Home, Carol Michaelsen

Electronic Theses and Dissertations

During the Modernist period, generally defined between the years 1890 and 1945, artists were attempting to break away from previous forms and styles. For example, writers like Henry James and Virginia Woolf sought to change the novel by exploring the consciousness of characters, while playing with the ideas of time and space to create the present moment. The thesis explores the modernist techniques used by James and Woolf, but also connects the work of the writers with the architecture of Frank Lloyd Wright. Using Joseph Frank's theory of spatial form, my work explores the similarities between Wright's designs of private …
