On The Legal Consequence Of Sauces: Should Thomas Keller's Recipes Be Per Se Copyrightable, Christopher J. Buccafusco

This article is devoted to copyright protection for one of the restaurant industry’s most valuable assets – original recipes. The two most recent appellate courts to consider the issue have been hostile to the notion that recipes are copyrightable, but given the enormous amount of money at stake, litigation in this area is likely about to expand. The article begins by critiquing the courts’ conclusions. Following an analogy to musical composition, I argue that recipes are simply the means of fixation for culinary works of authorship, i.e, dishes. Di Indonesia, Angka Kematian Bayi (AKB) masih yang tertinggi di negara-negara ASEAN. Penyebab utama kematian anak balita tersebut adalah penyakit infeksi saluran nafas dan diare yang dapat dicegah antara lain dengan pemberian ASI secara benar dan tepat. Pada periode 2002-2003, sekitar 95,9% balita sudah mendapat ASI, tetapi hanya 38,7 % balita mendapat ASI pertama satu jam setelah lahir. Tujuan penelitian ini adalah untuk mengetahui berbagai faktor yang berhubungan dengan pemberian ASI dalam satu jam pertama setelah melahirkan. The growing popularity and use of therapeutic touch (TT) is an issue that has generated controversy and concern within the medical community. While anecdotal and traditional scientific evidence suggest that TT would be an advantageous addition for clinics and hospitals to include in their armamentarium of complementary interventions within the realm of traditional medicine, TT has not become widely available in the U.S. One reason for the lack of availability may be the dearth of conclusive scientific support for TT's efficacy and, therefore, its inclusion in clinic and hospital treatment planning would give it the appearance of legitimate practice, which …

Pregnancy during adolescence represents a challenge to society as a whole. Its incidence is increasing and brings about social and medical consequences to both the teen mothers and their children. The purpose of this study was to evaluate pregnant teenager involvement in sexual activity and the social context. The group studied comprised 152 pregnant teenagers attending the Department of Pediatrics, Santa Casa de Sao Paulo (SCSP) General Hospital. All information was analyzed. The age at first intercourse was 14.2 years and the average period between first intercourse and pregnancy was 1.4 years. Most pregnancies (75%) were neither planned nor wanted, …

The Food and Drug Administration (FDA) has promulgated a new regulation which revises the format for prescription drug labeling, and, in the process, has taken the position that the regulation displaces, or preempts, state products liability laws that seek to assess liability on the manufacturer for a label’s warning adequacy. In the FDA’s 100 year history, it has not taken the position that federal prescription drug labeling regulations preempt common law tort claims until the last few years, beginning with Motus v. Pfizer in 2002. This position, radical to many and rational to others, places federal preemption of prescription drug …

Acacia Constricta Gains Novel Benefits From Ants While Minimizing Potential Conflicts, E. Fleur Nicklen

The sum of costs and benefits in an interspecific interaction determines whether the relationship is mutualistic, neutral, or antagonistic. We investigate novel benefits Acacia constricta may gain from ant visitors and how A. constricta may minimize potential costs of ant visitation. A. constricta attracts ants onto its foliage and encourages nesting at its base with extrafloral nectaries. Plants with basal nests have significantly greater soil nutrients and produce twice as many seeds as plants lacking basal nests (Wagner 1997). Along side these benefits, however, ants can interfere with plant reproduction. This study tests whether augmented soil nutrients increase A. constricta's …

Effects Of Marine-Derived Nutrients On Population Dynamics Of Sockeye Salmon (Oncorhynchus Nerka), Tadayasu Uchiyama

The effects of marine-derived nutrients (MDN) on the productivity of sockeye salmon (Oncorhynchus nerka) stocks in Alaska were examined through nitrogen stable isotope analysis of smolts and mathematical models of the sockeye stock-recruit relationship. Smolt 8 [delta]¹⁵N was used to infer the degree to which smolts depend on MDN for their growth. We attempted to identify the characteristics of sockeye nursery lakes and watersheds that affect the availability of MDN to juvenile sockeye using multiple regression. Stock-recruit models incorporating MDN effects were fit to sockeye escapement-return data to test if fluctuations in sockeye stock productivity could be explained by changes …

Permafrost And Wildlife Influences On Stream Nutrient Dynamics And Metabolism In Boreal Forest Watersheds Of Interior Alaska, Emma F. Betts

In the boreal forest of interior Alaska, both permafrost and wildfire impact stream solute concentrations, but their effect on stream function is unknown. This research focused on the effects of wildfire and permafrost on stream nutrient dynamics and metabolism in the Caribou Poker Creeks Research Watershed (CPCRW) in interior Alaska. Wildfire impact on chemistry was determined through comparison of pre- and post-fire stream chemistry in a control and a burned watershed. We predicted that increased nutrient and decreased dissolved organic carbon (DOC) delivery to streams after fire would stimulate gross primary productivity (GPP) and reduce ecosystem respiration in burned watersheds. …
