On Conflict Of Human Rights, Xiaobing Xu, George Wilson Dec 2006

On Conflict Of Human Rights, Xiaobing Xu, George Wilson

The University of New Hampshire Law Review

[Excerpt] “This article supports Gewirth’s view: that is, the reason why utilitarian values such as national security, public safety, public order, public health, and public morality may outweigh human rights is that they contain human rights elements. Thus, as a rule, whenever human rights clash with nonrights value considerations, we should analyze whether they contain human rights elements. If they do, they may override human rights that conflict with them. If they do not, they cannot.”

The Five Indicia Of Virtual Property, Charles Blazer Dec 2006

The Five Indicia Of Virtual Property, Charles Blazer

The University of New Hampshire Law Review

[Excerpt] “Many Americans use “it” every day. Although it is intangible, it may be worth thousands of dollars. Because we can both control it and prevent other people from controlling it, we assume, without much thought, that we own it. Sometimes we pay someone a monthly fee to hold it for us. Sometimes, simply by using it, we increase its value. When we finish using it, we often sell it.

“It” is virtual property, and it may take the form of an email address, a website, a bidding agent, a video game character, or any number of other intangible, digital …

Videoconferencing In Immigration Proceedings, Aaron Haas Dec 2006

Videoconferencing In Immigration Proceedings, Aaron Haas

The University of New Hampshire Law Review

[Excerpt] “When there is mention of a legal trial, a certain picture naturally comes to mind. One sees a judge in his black robe sitting on a raised bench. Lawyers are stationed at tables on either side of the courtroom, prepared to present their arguments to the court. A jury box may sit off to the side, holding a cross-section of citizens culled from the population to perform their ancient duty. The courtroom is made of fine wood and polished marble, and it is adorned with the accouterments of justice—American flags, seals, paintings of honored jurists—which let an observer know …

Stealing What's Free: Exploring Compensation To Body Parts Sources For Their Contribution To Profitable Biomedical Research, Jo-Anne Yau Dec 2006

Stealing What's Free: Exploring Compensation To Body Parts Sources For Their Contribution To Profitable Biomedical Research, Jo-Anne Yau

The University of New Hampshire Law Review

[Excerpt] “At first blush, donating body parts in the name of science appears to be a beautiful solution to the problem of scarce body parts for research advancements. But a closer investigation reveals an ugly fact: the philanthropic donors—referred to as “Sources” in this article—are subjected to physical and financial exploitation.

Sources play a crucial and indispensable role in biotechnology. Without human body parts, most medical discoveries would not have been possible. Handsome profits can be derived from successful discoveries. But currently in the United States, when a Source provides body parts for research purposes, the researcher, research foundation, and …

Design Of A One Day Workshop On Intuition, Alexander Von Reumont Dec 2006

Design Of A One Day Workshop On Intuition, Alexander Von Reumont

Creativity and Change Leadership Graduate Student Master's Projects

Intuition has been basically an untouched field in the domain of creativity research. I therefore wanted to investigate intuition in this study from scratch. I wanted to find out what laymen, as well as experts in the field of creativity knew about intuition, what their perceptions and expectations were, and what they wanted to know and learn about it in the future. The purpose of this study was twofold. First, to find rational explanations for intuition which support my hypothesis that it is a wildly neglected but natural and highly influential part of our intelligence. Second, to develop a one …

Retaining Information Technology Employees In Higher Education, Mary Holmes Dec 2006

Retaining Information Technology Employees In Higher Education, Mary Holmes

Dissertations

The retention of qualified Information Technology (IT) employees is at an all time low within higher education institutions. IT personnel are essential for higher education institutions to effectively integrate technology into their educational programs. These IT employees contribute to their institution's teaching/learning mission, while simultaneously supporting complex and highly visible administrative operations. Yet, all previous research regarding IT employee retention issues had only been conducted within corporate settings.

To examine factors related to IT employees' retention within public higher education, an internet-based study was sent to IT employees in all four-year public universities throughout Michigan. The survey included questions within …

Phylogenetics Of North American Psoraleeae (Leguminosae): Rates And Dates In A Recent, Rapid Radiation, Ashley N. Egan Dec 2006

Phylogenetics Of North American Psoraleeae (Leguminosae): Rates And Dates In A Recent, Rapid Radiation, Ashley N. Egan

Theses and Dissertations

The scientific discipline of phylogenetics involves understanding the diversity of life in the context of history. Technological advances in molecular biology and computational power have created an exponential increase in the number and kind of phylogenetic studies, allowing exploration of all manner of questions concerning the evolutionary history of a group. This dissertation research is focused on phylogenetic theory and applying these methods to the plant tribe Psoraleeae (Leguminosae; Fabaceae) with an emphasis on North American (NAm) members. First, theory of phylogeny estimation is explored in a review chapter focusing on strengths and weaknesses of phylogenetic methodology. Second, methods are …

Who Is A Southern Writer?, Suzanne W. Jones Dec 2006

Who Is A Southern Writer?, Suzanne W. Jones

English Faculty Publications

Richard Ford’s response to a questioner at the University of Mississippi symposium—that he is a “southerner” but not a “southern writer”—makes him only the latest in a long line of distinguished writers who grew up in the South, but have refused to be corralled into a regional stall. Other contemporary writers from the South, feeling “left out” of a potentially profitable niche market, have sought to broaden the definition of “southern literature.” Instead of worrying about who qualifies as a “southern writer” or rigidly delimiting “southern literature,” we might more fruitfully ask questions about who is writing about the U.S. …

Numerical Analysis Of Sandwiched Composite-Fss Structures, Qiang Rui, Chen Ji, Huang Jingyu, Maria Koledintseva, Richard E. Dubroff, James L. Drewniak, Yang Fan

Electrical and Computer Engineering Faculty Research & Creative Works

A numerical technique to analyze shielding effectiveness of sandwiched FSS-composite structures is proposed. This technique is based on using a dispersive FDTD method in conjuncture with a novel periodic boundary condition to model sandwiched FSS-composite elements. Results show that by inserting single or multilayered FSS elements into composite materials, better shielding effectiveness can be achieved. © 2006 IEEE.

Searching For A Needle In A Haystack: The Constitutionality Of Police Dna Dragnets, Sepideh Esmaili Dec 2006

Searching For A Needle In A Haystack: The Constitutionality Of Police Dna Dragnets, Sepideh Esmaili

Chicago-Kent Law Review

DNA dragnets—the mass warrantless DNA testing of individuals whom authorities have neither probable cause nor reasonable suspicion to believe perpetrated a crime, but who merely live or work near a crime scene—have increasingly been used by police departments in a desperate attempt to solve puzzling crimes. The lack of success and the Fourth Amendment constitutional concerns raised by DNA dragnets, however, lead this practice to be suspect. Under the Fourth Amendment, all searches of an individual must be reasonable. The reasonableness of any search typically depends on the government obtaining a warrant prior to the search. While there are well-established …

Service-Learning Outcomes At A Faith-Based Institution Of Higher Education., Amy L. Doolittle Dec 2006

Service-Learning Outcomes At A Faith-Based Institution Of Higher Education., Amy L. Doolittle

Electronic Theses and Dissertations

This quantitative dissertation examines outcomes of a required service-learning program at a faith-based institution. Two hundred and ten students completed a pre/post survey administered to a sophomore level class about background, educational processes, and twelve attitude and knowledge subscales related to service-learning. All subscales met standard reliability standards. Two dependent variables were used to measure critical thinking and students' perceptions of learning. While students entered the class with strong positive attitudes and knowledge on most subscales, four subscales Civic Attitudes, Civic Behavior, Civic Action, and Social Justice showed significant positive changes, and two subscales Motivation for Service and Personal Enrichment …

Societal Aspects Of Phishing, James W. Ragucci, Stefan Robila Dec 2006

Societal Aspects Of Phishing, James W. Ragucci, Stefan Robila

Department of Computer Science Faculty Scholarship and Creative Works

The damage caused by phishing does not only apply to monetary property alone. The fragile bonds of trust that organizations build with their constituents are shattered in the process. As people loss faith in the reliability of electronic communication methods, companies loss their customer base. In the case disasters, people can spend billions in preparation, to analyze weaknesses and improve recovery time, only to have thrust shattered by phishing attacks. This in turn causes a significant loss in money, resources and time. In this study we review the main characteristics of phishing attacks and their impact to society. Based on …
