The Governance Of The Imf: The Need For Comprehensive Reform, Daniel Bradlow
The Governance Of The Imf: The Need For Comprehensive Reform, Daniel Bradlow
Working Papers
This article argues that IMF's current governance arrangements suffer from being non responsive to key stakeholders, lack of accountability, non-representative decision making, lack of transparency, and poorly defined relations with other international organizations. These deficiencies have arisen because the IMF has failed to adapt its decision-making structure and procedures to its changing functions and role in the global economy. They have caused distortions in the IMF's relations with its member states, with non-state actors, and with other international organizations and problems with some of the IMF's interpretations of its articles. The article argues that the IMF cannot perform effectively until …

The Judicial Application Of The Causation Test Of The False Statement Doctrine In Securities Litigation In China, Ling Dai
Washington International Law Journal
As part of the reform of China’s centrally planned economy, one of the primary purposes in establishing a stock market was to help state-owned enterprises raise sufficient capital from the public. The protection of investors’ interests was not essential in the initial contemplation of securities laws, though the listed companies have a duty of disclosure under the 1998 Securities Law. After the Supreme People’s Court promulgated its judicial interpretation of the false statement doctrine in civil securities cases in 2002, the lower courts started to interpret and apply the elements of the false statement doctrine in securities cases brought by …
Aiming Straight: The Use Of Indigenous Customary Law To Protect Traditional Cultural Expressions, Meghana Raorane
Aiming Straight: The Use Of Indigenous Customary Law To Protect Traditional Cultural Expressions, Meghana Raorane
Washington International Law Journal
Globalization has led to the propagation of traditional cultural expressions of indigenous peoples outside their communities. Consequently, the question of how these expressions should be protected has acquired heightened significance. Commentators have proposed using existing intellectual property regimes and sui generis solutions. This Comment advocates a third solution, the use of indigenous customary laws of indigenous peoples to protect their particular traditional cultural expressions. Indigenous customary laws ensure effective protection of the traditional cultural expressions of indigenous peoples. The assumption that existing intellectual property regimes provide the only available protection is erroneous and constrains the development of effective solutions. Western …
Constitutional Adjudication In Post-1997 Hong Kong, Albert H.Y. Chen
Constitutional Adjudication In Post-1997 Hong Kong, Albert H.Y. Chen
Washington International Law Journal
In July 1997, the British colony of Hong Kong was returned to the People’s Republic of China (“PRC”). It became a Special Administrative Region (“SAR”) of the PRC in accordance with the concept of “one country, two systems” embodied by the Sino-British Joint Declaration of 1984. The constitutional instrument of Hong Kong’s new legal and political system is the Basic Law of the SAR of Hong Kong, enacted by the National People’s Congress of the PRC and effective as of July 1997. Under colonial rule, Hong Kong inherited a British-style legal system. English common law formed the foundation, and the …

Internet Filtering And The Adolescent Gay/Lesbian Patron, David Brian Holt
Internet Filtering And The Adolescent Gay/Lesbian Patron, David Brian Holt
Law Librarian Scholarship
With the recent passage of the Children’s Internet Protection Act (CIPA), and its constitutionality subsequently affirmed by the Supreme Court, libraries are faced with challenges presented by Internet filtering, and the obstacles to access it poses for disadvantaged patron groups. This paper discusses the ramifications of Internet filtering at public libraries on sexual minority youth and how this may translate into a negative health impact on this community and a restriction on intellectual freedom. Topics discussed include filtering technology, the risks it presents to equitable access, the disproportionate effect on the gay/lesbian community, and how filtering impairs the creation of …

Searching For Social Capital In U.S. Microenterprise Development Programs, Nancy C. Jurik, Gray Cavender, Julie Cozogill
Searching For Social Capital In U.S. Microenterprise Development Programs, Nancy C. Jurik, Gray Cavender, Julie Cozogill
The Journal of Sociology & Social Welfare
This paper focuses on the claims and efforts of U.S. microenterprise development programs (MDPs) to build social capital among poor and low income entrepreneurs. MDPs offer business training and lending services to individuals operating very small businesses (with five or fewer employees and less than $20,000 in start-up capital). Advocates suggest that MDPs help promote economic development by building social capital defined as networks among small entrepreneurs and between entrepreneurs and their larger community. We begin our paper with a short review of the varied definitions and claims about the role of social capital in promoting civic and economic empowerment. …

Paying Ceos In Bankruptcy: Executive Compensation When Agency Costs Are Low, M. Todd Henderson
Paying Ceos In Bankruptcy: Executive Compensation When Agency Costs Are Low, M. Todd Henderson
Coase-Sandor Institute for Law & Economics Research Paper Series
Conventional wisdom suggests that high agency costs explain the (excessive) amounts and (inefficient) forms of CEO compensation. This paper offers a simple empirical test of this claim and the reform proposals that follow from it, by looking at pay practices in firms under financial distress, where agency costs are dramatically reduced. When a firm files for Chapter 11 or privately works out its debt with lenders, sophisticated investors consolidate ownership interests into a few large positions replacing diffuse and disinterested shareholders. These investors, be they banks or vulture investors, effectively control the debtor during the reorganization process. In addition, all …
Capstone Courses In Mass Communication Programs, Jack Rosenberry, Lauren Vicker
Capstone Courses In Mass Communication Programs, Jack Rosenberry, Lauren Vicker
Media and Communication Faculty/Staff Publications
Many colleges and universities emphasize helping students make the transition into higher education. But transition to post-graduation life through approaches such as capstone courses has not received much attention. A survey of mass communication programs indicated that capstones are commonly used for both integration of prior learning and for transition to what students may face after graduation, and that mass communication programs appear to be meeting the challenge of blending these somewhat incongruous approaches. Mass communication capstones employ a wide variety of methods and content, but teachers and administrators appear satisfied with how the courses serve their programs. The survey’s …

Franklin Pierce Law Center: Leading The Way In Legal Education For New Hampshire, John D. Hutson
The University of New Hampshire Law Review
[Excerpt] "This issue of the Pierce Law Review is the first devoted entirely to the practice of law in New Hampshire. This venture is appropriate because the Franklin Pierce Law Center is the only law school in the State. We are truly New Hampshire’s law school. Our Trustees, faculty, staff, and students feel this responsibility profoundly. Pierce Law serves as both a state law school and a national and international school. While we send a greater percentage of our graduates out of state than any other law school in the country except one, our alumni comprise fully one-third of the …

An Evaluation Of Library Instruction Delivered To Engineering Students Using Streaming Video, Jack M. Maness
University Libraries: Faculty Scholarship
This paper evaluates the use of streaming video applications in the delivery of information literacy instruction to engineering students. It describes the University of Colorado at Boulder (UCB) Engineering Library's implementation of streaming video to support graduate distance programs in the Center for Advanced Engineering and Technology Education (CAETE), and reviews library literature regarding the use of streaming technology. As an initial evaluation of the project, the preliminary results of a survey (n=27) comparing satisfaction levels and learning outcomes between students who attended library instruction sessions in-class versus via streaming video are given. The results reveal no significant difference in …

The Family History Artworks Of Valerie Atkisson, Josh E. Probert
The Family History Artworks Of Valerie Atkisson, Josh E. Probert
BYU Studies
Valerie Atkisson, an artist who lives in the Bronx, New York, exemplifies a generation of Mormon artists who are at home navigating the world of Contemporary art while maintaining their personal and spiritual identity. Family history, transgenerational inquiry, and relatedness have been the majority subjects of Atkisson’s work thus far. “What began as an interest in my ancestors has turned into an insatiable desire to know as much about them as possible,” she says. “[My work] is a continuation of them, not just that my flesh and blood are a part of them, but the remembrance is also an extension …
