Lost Constitutional Moorings: Recovering The War Power, Louis Fisher
Lost Constitutional Moorings: Recovering The War Power, Louis Fisher
Indiana Law Journal
For the past half century, Presidents have claimed constitutional authority to take the country from a state of peace to a state of war against another nation. That was precisely the power that the Framers denied to the President and vested exclusively in Congress. That allocation of power was understood by all three branches until President Harry Truman went to war against North Korea in 1950. He never came to Congress for authority before he acted or at any time thereafter. Similar false claims of authority have been made by Presidents since that time. These constitutional violations have been assisted …

Youth, Governance And The City: Towards A Critical Urban Sociology Of Youth Crime And Disorder Prevention, Matt Bowden
Articles
This article considers the historical and spatial context for the emergence of youth crime and disorder prevention initiatives in Ireland. These initiatives have to be understood in the context of their relationship to the broader ‘urban question’ and in particular the relationship of the peripheral housing estate to the rest of society and the economic sphere. More recent changes in the nature of society and the emergence of a ‘liberal creed’ have resulted in greater use of surveillance technologies for offsetting the opportunities for crime to be committed. In this context, youth crime prevention initiatives must be seen as an …

Experimental Investigation Of The Effects Of Background Traffic Loads On Streamed Video Over 802.11b Wlans, Tanmoy Debnath, Nicola Cranley, Mark Davis
Conference papers
Video is a frame based media and video streaming is often described as “bursty” which has a large impact on the Quality of Service of the video streaming application over WLAN networks. In this paper the impact of background load on the performance of streaming MPEG-4 video with a video server located on the wired network streaming to wireless client is analysed. We experimentally investigate the performance for both uplink and downlink loads. The performance is measured in terms of the key parameters of bit rate, loss rate and mean delay since these are the primary factors that affect the …

Intellectual Property - Copyright & Internet Law - "The Big Chill": The Supreme Court Adopts An Inducement Standard For Third-Party Copyright Infringement Liability, Leaving Innovation In The Cold Metro-Goldwyn-Mayer Studios, Inc. V. Grokster, Ltd., 125 S. Ct. 2764 (2005)., Darrin Keith Henning
University of Arkansas at Little Rock Law Review
A key feature of an effective copyright system is to provide protection against infringement that is consistent with a copyright's goal: to "promote . . . useful Arts." Thus, for the overall public good, it is vital to achieve a proper balance between protecting authors' works as an incentive to create and the public's interest in accessing both creative works and new technology. The outcome of Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd. (Grosker III) and the resulting business and legal developments created ambiguity and doubt regarding potential liability in the copyright system that is having a deleterious effect on technical …

Keynote Address: Secret Evidence In The Age Of National Security, Adam Liptak
Cardozo Public Law, Policy & Ethics Journal
The article explores the tension between national security and the First Amendment, arguing that while the First Amendment remains a robust protection against government censorship, recent trends threaten press freedom, particularly in protecting confidential sources and accessing information. The author, drawing on personal experience as a media lawyer and reporter, emphasizes the importance of procedural safeguards and judicial oversight to prevent government overreach and ensure transparency.

Whose Life Is It Anyway?, Kam C. Wong
Cardozo Public Law, Policy & Ethics Journal
The article explores the complex ethical, legal, and societal dimensions of the right-to-die debate, emphasizing the need for a nuanced approach that moves beyond simplistic moral framing. It argues that the debate is inherently exploratory and tentative, shaped by cultural and personal values, and calls for a reassessment of existing perspectives to foster creative solutions. The central thesis underscores the inevitability of euthanasia as a societal issue and advocates for balanced policies that respect individual autonomy while addressing broader societal concerns.

Antimicrobial Activities Of Some Nigerian Chewing Sticks, M. O. Ogundiya, M. B. Okunade, A. L. Kolapo
Ethnobotanical Leaflets
The antimicrobial activities of the ethanolic extracts of three Nigerian chewing sticks, namely, Terminalia glaucescens, Anogeissus leiocarpus and Pseudocedrela kotschyi were investigated. Results from this study showed that the antimicrobial activities of the tested chewing sticks vary and are target-microbe specific. Of the tested chewing sticks, A. leiocarpus showed a significantly higher antibacterial activity (P<0.05) against Staphylococcus aureus and Streptococcus pyogenes; and this was closely followed by T. glaucescens, while P. kotschyi virtually had no activity against these two organisms. However, the activity of T. glaucescens against Streptococcus mutans was significantly higher (P<0.05) than that exhibited by A. leiocarpus. The extracts of …0.05)>0.05)>

'Yet In A Primitive Condition': Edward S. Curtis's The North American Indian, Shannon Egan
Art and Art History Faculty Publications
From 1907 to 1930, Edward S. Curtis created The North American Indian, a forty-volume edition of photographs and writings that he hoped would cover “every phase of Indian life of all tribes yet in a primitive condition.” All evidence indicates that he set out to make a singular and unified work of art. However, a comparative analysis of photographs made at different moments in this ambitious project reveals that The North American Indian ultimately is characterized not by stylistic and thematic unity but by significant shifts in aesthetic and political orientation.
