Maiming The Cubs, James J. White Jan 2006

Maiming The Cubs, James J. White

Articles

In the last twenty years much has been written about the deleterious effect that law school has on the mental well-being of law students.' Many have called for "humanizing" law school. In support of their case, the advocates of humanizing cite numerous anecdotes, much scholarly writing in the psychology literature, and even a few rigorous studies of law students. A principal voice is that of Professor Krieger who has done the most careful and elaborate study, a study of students at two law schools.1 You should understand that Professor Krieger and his cohorts do not merely claim that we make …

Out Of State And Out Of Luck: The Treatment Of Non-Custodial Parents Under The Interstate Compact On The Placement Of Children, Vivek Sankaran Jan 2006

Out Of State And Out Of Luck: The Treatment Of Non-Custodial Parents Under The Interstate Compact On The Placement Of Children, Vivek Sankaran

Articles

Courts handling child abuse and neglect cases face a daunting task. Within one to three days after a child is removed from his home, a court hearing must be held to determine whether court intervention and continued removal of the child is necessary. At this hearing, the court must sort through and evaluate the state's allegations and assess the various risks posed by placing the child in foster care or returning the child to one or both of his parents. Courts must weigh the heavy emphasis the law places on preserving the family unit against the equally paramount mandate to …

Estimation Of Incident Photosynthetically Active Radiation From Moderate Resolution Imaging Spectrometer Data, Shunlin Liang, Tao Zheng, Ronggao Liu, Hongliang Fang, Si-Chee Tsay, Steven W. Running

Ecosystem and Conservation Sciences Faculty Publications

Incident photosynthetically active radiation (PAR) is a key variable needed by almost all terrestrial ecosystem models. Unfortunately, the current incident PAR products estimated from remotely sensed data at spatial and temporal resolutions are not sufficient for carbon cycle modeling and various applications. In this study, the authors develop a new method based on the look-up table approach for estimating instantaneous incident PAR from the polar-orbiting Moderate Resolution Imaging Spectrometer (MODIS) data. Since the top-of-atmosphere (TOA) radiance depends on both surface reflectance and atmospheric properties that largely determine the incident PAR, our first step is to estimate surface reflectance. The approach …

Scholarship and Professional Work - Business

In this article, the author discusses the "Law and Culture" course that he developed to teach in the Butler University Honors Program. The course looks at some landmark periods or events in legal history and explores how those events were the product of their culture, and how they affected their culture. Among the events or periods that the author has looked at in iterations of this course were the survival instinct on display in "Regina v. Dudley and Stephens," the Nuremberg trials, the Scopes Monkey Trial, the modern American litigation explosion, and the events surrounding the U.S. Supreme Court decision …

Horizontal Unsaturated Flow Across A Single Fracture, Bud J Benneman Jan 2006

Horizontal Unsaturated Flow Across A Single Fracture, Bud J Benneman

UNLV Retrospective Theses & Dissertations

Unsaturated flow in a silica rich rock is driven by two primary forces, gravity, which drives water downward, and capillarity, which acts in all directions. The balance between gravity and capillary forces determines fluid flow. Water in an unsaturated silica rich matrix will adhere to the silica particles and through capillary action spread out in all directions. Fractures under unsaturated conditions, will act as capillary barriers to horizontal capillary flow. This restriction is due to an interruption in the continuity of grains along which water adheres to in the rock matrix. Given adequate time and fluid pressure, water may bridge …

Site Response Projections For Deep Sediment Columns And Earthquake Microzonation For The Las Vegas Basin, Ying Liu Jan 2006

Site Response Projections For Deep Sediment Columns And Earthquake Microzonation For The Las Vegas Basin, Ying Liu

UNLV Retrospective Theses & Dissertations

Deep sediment columns play a significant role in defining surface response to earthquakes. For the Las Vegas basin (Nevada, U.S.), the basin sediments are capable of amplifying ground motions by a factor of up to 5 to 10 with respect to motions recorded at near-rock sites at the edges of the basin, over the period range 0.3 to 5 sec; A one-dimensional (1-D) equivalent-linear model is used to study the impact of sediment columns on surface response. The 1-D model is optimally parameterized through iterative assessment to select the depth to halfspace so that the projected response spectrum best matches …

A Winner Is Who? Fair Use And The Online Distribution Of Manga And Video Game Fan Translations, Jaime E. Muscar Jan 2006

A Winner Is Who? Fair Use And The Online Distribution Of Manga And Video Game Fan Translations, Jaime E. Muscar

Vanderbilt Journal of Entertainment & Technology Law

This note examines the legality of fan translations of Japanese comic books, known as manga, and video games distributed over the Internet, with special consideration given to the application of the fair use doctrine. Technology related to the distribution of media online grows exponentially compared to the law governing this technology. Although much recent litigation has limited the online distribution of traditional media, both copyright holders and courts have largely ignored a fringe segment of this distribution. This fringe includes manga and video games. Manga can be easily shared online by scanning images, and video games are now frequently converted …

Samats : Semi-Automated Modelling And Texturing System, Joe Hegarty Jan 2006

Samats : Semi-Automated Modelling And Texturing System, Joe Hegarty

Masters

The creation of detailed 3D (three-dimensional) building models has become an area of considerable research over the last couple of decades. The accurate modelling of buildings offers LBS (Location Based Services) applications in planning, cultural heritage, tourism and e-commerce among others. The approach taken by the majority of contemporary modelling systems that use terrestrial imagery taken from arbitrary locations requires the user to carry out manual correspondences across the image set. These correspondences are used for two purposes. Firstly, the correspondences are used to determine the exterior orientation parameters (position and orientation) of the cameras used to capture each image. …

Descriptive Study Of The Planning, Implementation, And Outcome Of A Parent School Involvement Program, Carol Mack Jan 2006

Descriptive Study Of The Planning, Implementation, And Outcome Of A Parent School Involvement Program, Carol Mack

PCOM Psychology Dissertations

Research verifies a positive impact on academic achievement based upon parental involvement with children's educational needs and school programs. It takes a sense of partnership between parents and schools to achieve positive educational outcomes for children. The purpose of this study is to evaluate the development, implementation and outcome of a Parent School Involvement Project involving parent-training workshops. While no statistically significant relationship could be found between improvement in student homework completion rates and parent attendance at school-sponsored parent training workshops, parents, faculty, and administration were united in their belief that the program was a positive and promising approach to …

Examining Vicarious Traumatization, Anna Zacharcenko Jan 2006

Examining Vicarious Traumatization, Anna Zacharcenko

PCOM Psychology Dissertations

The purpose of this study was to identify risk factors correlated with vicarious traumatization in Critical Incident Stress Management (CISM) clinicians. One hundred and sixty clinicians were surveyed. Statistical analyses were conducted to determine if a relationship existed between variables, such as current and cumulative exposure to client trauma and clinician endorsement of disrupted cognitive schemas and intrusive imagery. Variables such as clinician involvement in professional and personal support activities as well as participation in leisure ·and spiritual activities were also examined. Study results suggested that a longer work history and utilization of peer support served as protective factors against …

The Empirical Roots Of The 'Regulatory Reform' Movement: A Critical Appraisal, Richard Parker Jan 2006

The Empirical Roots Of The 'Regulatory Reform' Movement: A Critical Appraisal, Richard Parker

Faculty Articles and Papers

Over the past few years the debate over the economic rationality of health, safety and environmental regulation has morphed into a sustained controversy over the tests and methods by which that rationality is judged. Critics have argued that the main regulatory scorecards which comprise much of the empirical foundation for the regulatory reform movement are fundamentally flawed because they: alter agency estimates of future costs and benefits; disregard most uncertainties; and misrepresent ex ante guesses as the costs and benefits of regulation. They also zero out whole categories of benefits that cannot be quantified and/or monetized even when the benefits …

Journey To The Center Of The Core: Computers And The Internet In The Core Curriculum, Jorge Pérez, Meg C. Murray Jan 2006

Journey To The Center Of The Core: Computers And The Internet In The Core Curriculum, Jorge Pérez, Meg C. Murray

Faculty Articles

Computers, digitalization and the Internet have transformed modern society. Commerce, education, communication and socialization will never be the same. Surprisingly, many universities do not require a computing course in the core curriculum. Critical information technology (IT) competencies are often taken for granted, to the detriment of students who lack computing and Internet skills. This paper describes an initiative undertaken by a computer science and information systems department to assess and remediate IT skills needed by all university students, regardless of major. The project is evolving along several dimensions: identification of discipline-independent IT competencies, assessment of IT skills among current and …

Enhancing Vocabulary Acquisition Through Synthetic Learning Experiences: Implementing Virtual Field Trips Into Classrooms, Alicia Sanchez Jan 2006

Enhancing Vocabulary Acquisition Through Synthetic Learning Experiences: Implementing Virtual Field Trips Into Classrooms, Alicia Sanchez

Electronic Theses and Dissertations

A Synthetic Learning Environment (SLE) the Virtual Field Trip (VFT) was designed to increase vocabulary acquisition and knowledge by utilizing simulation based technologies and leveraging sound educational findings. Vocabulary acquisition is considered a prerequisite to becoming a good reader and therefore a critical predictor of academic and lifelong success for early learners, however, teachers report that students lack the real world knowledge required for vocabulary knowledge. The VFT provides a meaningful context for anchored and situated instruction. Second grade students were assigned to either use the VFT or to listen to stories read aloud by a researcher on a video …

Experimental Techniques For Nonlinear Material Characterization: A Nonlinear Spectrometer Using A White-Light Continuum Z-Scan, Mihaela Balu Jan 2006

Experimental Techniques For Nonlinear Material Characterization: A Nonlinear Spectrometer Using A White-Light Continuum Z-Scan, Mihaela Balu

Electronic Theses and Dissertations

The main goal of this dissertation is to introduce and demonstrate a new method for the rapid determination of the nonlinear absorption spectra and the dispersion of the nonlinear refraction of optical materials in the visible and near IR spectral regions. However, conventional methods like, white-light continuum pump-probe and Z-scan techniques were used to measure the peak 2PA cross-sections for a number of commercially available photoinitiators. In the new method mentioned above, a high energy, broadband femtosecond white-light continuum is used to replace the single wavelength source conventionally used in a Z-scan experiment. In a Z-scan experiment, the transmittance of …

The Role Of Expectancies In Binge Eating Behavior, Jessica Larose Jan 2006

The Role Of Expectancies In Binge Eating Behavior, Jessica Larose

Electronic Theses and Dissertations

The central aim of the present study was to examine the role of expectancies in binge eating behavior. Two distinct statistical techniques were used to accomplish this goal. First, regression analyses were conducted using variables previously identified in the literature, as well as eating expectancies as measured by the Eating Expectancy Inventory (EEI). For both females and males, regression equations including expectancies accounted for a substantial portion of the variance in binge eating behavior. Second, memory modeling techniques were used to model the probable organization of eating expectancies. Memory modeling of hypothetical expectancy networks has lead to successful interventions in …

Hispanics' Attitudes Toward Seeking Counselingas A Function Of Psychosocial And Demographic Variables, Angela Rojas-Vilches Jan 2006

Hispanics' Attitudes Toward Seeking Counselingas A Function Of Psychosocial And Demographic Variables, Angela Rojas-Vilches

Electronic Theses and Dissertations

Using variables identified in the social science literature believed to influence attitudes toward seeking professional counseling, an attempt was made to develop a model for predicting Hispanics' willingness to obtain professional help. A second purpose of this study was to compare college students (n = 158) with their parents on their attitudes toward mental illness and toward seeking counseling. Among predictor variables, social stigma and the belief that mental illnesses are untreatable were the primary variables predicting attitudes toward seeking counseling. The more college students and their parents perceived there to be social stigma attached to those seeking therapy, and …
