Textiles From The Canadian Front, J. Penney Burton
Textiles From The Canadian Front, J. Penney Burton
Textile Society of America: Symposium Proceedings
The craft of storytelling has all but disappeared from the Western cultural context, and there remain few peoples for whom oral traditions are still a prominent part of their everyday lives. Fiber artists and their work are frequently discussed by craft historians, critics, curators and connoisseurs, but aside from infrequent interviews in monographs and craft journals, their own voices are rarely heard. This is being somewhat addressed with the practice of conducting oral history interviews with leaders in the craft and textile field in the US, through the Smithsonian Institute, with the Nanette L. Laitman Project for Craft and the …

When This You See Remember Me: Sampler Making As A Material Practice Of Identity And Selfhood, Mary Lou Trinkwon
Textile Society of America: Symposium Proceedings
I would like to acknowledge the extensive research done by Textile historians, curators and collectors. I owe a huge debt to their research and all the documentation that is available. It is my hope that I can build on this strong body of knowledge and offer some new thoughts to this historic, vibrant and diverse practice.
I want to share with you a short survey of the terrain I have been cultivating on the topic of needlework and sampler making. I want to talk about how I use samplers as a pedagogical tool and as an assigned project in my …

Department of Plant Pathology: Faculty Publications
We have determined the genomic sequences of four virulent myophages, Bcep1, Bcep43, BcepB1A, and Bcep781, whose hosts are soil isolates of the Burkholderia cepacia complex. Despite temporal and spatial separations between initial isolations, three of the phages (Bcep1, Bcep43, and Bcep781, designated the Bcep781 group) exhibit 87% to 99% sequence identity to one another and most coding region differences are due to synonymous nucleotide substitutions, a hallmark of neutral genetic drift. Phage BcepB1A has a very different genome organization but is clearly a mosaic with respect to many of the genes of the Bcep781 group, as is a defective prophage …

An Empirical Study Of The Multifactor Tests For Trademark Infringement, Barton C. Beebe
An Empirical Study Of The Multifactor Tests For Trademark Infringement, Barton C. Beebe
Faculty Articles
The thirteen circuits' thirteen different multifactor tests for the likelihood of consumer confusion have long played a role of central importance in American trademark litigation, yet they have received little academic attention and no empirical analysis. Courts, commentators, and practitioners have all the while speculated about which factors, if any, drive the outcome of the tests, how the factors interact, and, most importantly, whether the circuits' different tests, given the same facts, would yield different outcomes. With a view to the settling of these questions and ultimately to the reform of the multifactor tests, this Article sets forth the results …
Risk And Redistribution In Open And Closed Economies, Mitchell A. Kane
Risk And Redistribution In Open And Closed Economies, Mitchell A. Kane
Faculty Articles
A growing body of tax scholarship considers the interplay of taxation and risk in the domestic context. This article is the first attempt in the tax literature to analyze systematically the relationship between tax and risk in the international, or open economy, setting. I demonstrate how common tax instruments can result in certain jurisdictions disproportionately taxing a portion of the upside gains from successful risky investments, while other jurisdictions end up disproportionately bearing the costs associated with unsuccessful ones. This leads to a phenomenon that I call “divergence.” I provide formal specifications for divergence and then make a preliminary assessment …
Government Secrets, Constitutional Law, And Platforms For Judicial Intervention, Adam M. Samaha
Government Secrets, Constitutional Law, And Platforms For Judicial Intervention, Adam M. Samaha
Faculty Articles
American law has yet to reach a satisfying conclusion about public access to information on government operations. But recent events are prompting reconsideration of the status quo. As our current system is reassessed, three shortfalls in past debates should be overcome. The first involves ignorance of foreign systems. Other democracies grapple with information access problems, and their recent experiments are illuminating. Indeed they expose two additional domestic weaknesses. One is a line we have drawn within constitutional law. Courts and commentators tend to treat constitutional issues of public access separately from those of executive discretion to withhold information, but these …
Behavioral Economics And The Regulation Of Public Offerings, Stephen J. Choi
Behavioral Economics And The Regulation Of Public Offerings, Stephen J. Choi
Faculty Articles
The SEC adopted new rules in 2005 governing registered public offerings in the United States. Few, if any, of the rules make sense if we start from a presumption that investors are rational and are able to account properly for any information they receive during the public offering process. In this Article, I examine the new rules and assess the implicit behavioral assumptions about investors contained in the rules. I also provide an assessment of the behavioral biases that may affect regulators at the SEC. Regulator biases may lead the SEC to take an ad hoc evaluative process often ending …
