Diverging Perspectives On Electronic Contracting In The U.S. And Eu, Jane K. Winn, Brian H. Bix Jan 2006

Diverging Perspectives On Electronic Contracting In The U.S. And Eu, Jane K. Winn, Brian H. Bix

Cleveland State Law Review

Margaret Jane Radin's paper discusses the ways modern technologies have prompted new thinking within and about property, and the way the legal response has failed to take sufficiently into account the countervailing considerations that have shaped earlier Property Law developments. Some new technologies have also caused intellectual and practical struggles within Contract Law. This paper will consider some of the developments of Contract Law related to these changes, in particular the transactions relating to the sale, leasing or free use of computer software and the purchase of computers. Part I of this paper introduces the topic and offers an overview …

Mars Rising: Icons Of Imperial Power, Miriam Cooley, Michelle Forrest, Linda Wheeldon

Journal of Social Theory in Art Education

Political and news media imagery saturate the culture of our classrooms as thoroughly as the popular culture imagery that deliberately targets children and youth. Media images such as those of US president G. W. Bush's visit to Canada that we discuss in this paper have become ubiquitous in our culture. In our view they constitute a primary mechanism through which the powerful political and economic forces exert an unrelenting threat on populations around the world. We (1 + 1 + 1)* enter this discussion from the point of view of Canadians, one of whom holds duel Canadian / US citizenship, …

Performance Art As A Site For Learning: Queer Theory And Performance Studies In The Art Classroom, G. E. Washington Jan 2006

Performance Art As A Site For Learning: Queer Theory And Performance Studies In The Art Classroom, G. E. Washington

Journal of Social Theory in Art Education

Today, performance art is one of the most useful mediums for helping individuals see themselves differently. In this of "Out of sight" article, I explore the experience of participating in a student's performance art project. This work was a performance of crossing the road. Here, I discuss the inclusion of overtly queer articulations of personal experience within the art classroom. How can performance art construct learning experiences that engage a dynamic process of self-critique? How are classrooms organized differently when students become actively involved in the development of the art curriculum? And, how might a performative investigation of the sociality …

God, The Taboo Topic In Art Education, Terry Barrett, Valora Blackson, Vicki Daiello, Megan Goffos Jan 2006

God, The Taboo Topic In Art Education, Terry Barrett, Valora Blackson, Vicki Daiello, Megan Goffos

Journal of Social Theory in Art Education

A serendipitous match of this journal's call for imagery "that lies outside art educators' accepted sphere"-"out of site/ sight/ cite" - and a (too) rare discussion among art educators talking about God within a secular classroom prompts this article. Concepts of God are generally withheld from the site of public school art classrooms in the United States; many teachers express wariness and fear of bringing artists' sights of God into their public school art rooms, although God and Gods are a frequent subject for artists through time and across place. Further, the topic of God is rarely cited in art …

Voices Of Women: Telling The Truth Through Art Making, Alice Pennisi Jan 2006

Voices Of Women: Telling The Truth Through Art Making, Alice Pennisi

Journal of Social Theory in Art Education

On Wednesdays, when the last period of the school day is finished, the students trickle out of room 412 of Burnham High School and the young women enter who have been waiting outside. They immediately push all the desks to the side or back walls, leaving a large open space. Then each carries a chair toward the front of the room, creating a circle. Someone closes the door, and they begin to talk with one another. Thus begins a weekly meeting of Voices of Women (VOW), a group comprised mainly of high school girls who create collaborative artwork based on …

Marginalia And Meaning: Off-Site/Sight/Cite Points Of Reference For Extended Trajectories In Learning, James Haywood Rolling Jr. Jan 2006

Marginalia And Meaning: Off-Site/Sight/Cite Points Of Reference For Extended Trajectories In Learning, James Haywood Rolling Jr.

Journal of Social Theory in Art Education

This study argues that drawing upon off-site/ sight/ cite points of reference affords a space for extended trajectories of learning and the cultivation of rich and atypical personal meaning unavailable within the terrain and climes of typical schooling frameworks. This paper continues the author's effort to establish the efficacy of a poststructural and poetic aesthetic in qualitative research writing.

Precinct, Gayle Gorman Jan 2006

Precinct, Gayle Gorman

Journal of Social Theory in Art Education

"Precinct" was a site-specific art project/ performance/ exhibit put on by SITE: Buffalo Artist Collective, an organization devoted to a nontraditional approach to art emphasizing the experiential and the value of spectered memories contained in found objects and images. With the aid of the Buffalo Arts Commission, the abandoned police precinct (now destroyed) on Niagara Street on Buffalo's West side was open to the public, occupied and interacted with for a one-day event. This venue was specifically selected in order to bypass the gallerycentric mode of display which tends to dominate the world of art. By doing so, SITE made …

Grasping The Site/Sight/Cite Of The Image: A Lacanian Explication, Jan Jagodzinski Jan 2006

Grasping The Site/Sight/Cite Of The Image: A Lacanian Explication, Jan Jagodzinski

Journal of Social Theory in Art Education

Reading images psychoanalytically from a Lacanian perspective has its challenges. The first task of this essay is to provide a way through what is often taken to be difficult and impenetrable theory, to explicate how the homology site/ sight/ cite can be understood in any act of critical perception. Its second task is to make distinctions between a psychoanalytic understanding of the subject as being 'split' or divided (as represented by the matheme '$,' Lacan's symbol for this form of subjectivity) when applied to art, as opposed to a naive realist subject of representation or a savvy poststructuralist (decentered) subject …

E-Learning 2.0: New Frontier For Student Empowerment, William Renner

EDU-COM International Conference

Second generation web applications (Web 2.0) are transforming elearning and opening new frontiers for learner empowerment, control and engagement. New online technologies allow individuals to filter and control existing content (aggregation), easily create new content (personal publishing) and rapidly communicate, inform and distribute this information with peers through online social networking services. Learners are able to construct highly personalized learning environments, assembled from a very large range of tools available on the internet, including blogs, wikis, podcasts and social bookmarking sites. Together the technical and social advances which characterize this change may even constitute a paradigm shift, which some authors …

Cognitive Engineering Research Methodology: A Proposed Study Of Visualization Analysis Techniques, Cristin M. Hall, Sonya A.H. Mcmullen, David L. Hall

Publications

The rapid development of new sensors and wide-band communications provides the capability to collect enormous amounts of data. An increasing challenge involves how to understand and interpret the data to yield knowledge about evolving situations or threats (e.g., of military situations, state of complex systems, etc.). New visualization tools and techniques are becoming available to support advanced visualization including three-dimensional, full immersion display environments and tools to support novel visualizations. Examples include network system display tools and evolving multi-sensory situation environments. Despite the emergence of such tools, there has been limited systematic test and evaluations to determine the efficacy of …

Lawless World - The Bush Administration And Iraq: Issues Of International Legality And Criminality, Philippe Sands Jan 2006

Lawless World - The Bush Administration And Iraq: Issues Of International Legality And Criminality, Philippe Sands

UC Law SF International Law Review

Sixty years ago, the United States and Great Britain spearheaded efforts to create a new world order based on international rules. Today these same two nations are leading the charge to abandon many of the global safeguards they once fought to establish. The Bush Administration has decided to turn its back on international agreements governing basic human rights, war, torture, and the environment. In this transcript from the Schlesinger Lecture held in November 2005, Professor Sands discusses how international rules are arbitrarily applied as human rights prove to be inconvenient in the face of globalizing economic forces.

"Monkeying With The Bible”: Edgar J. Goodspeed's American Translation, R. Bryan Bademan Jan 2006

"Monkeying With The Bible”: Edgar J. Goodspeed's American Translation, R. Bryan Bademan

History Faculty Publications

Devotion to the Bible remains an underappreciated aspect of American religious life partly because it fails to generate controversy. This essay opens a window onto America's relationship with the Bible by exploring a controversial moment in the history of the Bible in America: the public reception of University of Chicago professor Edgar J. Goodspeed's American Translation (1923). Initially, at least, most Americans flatly rejected Goodspeed's impeccably credentialed attempt to cast the language of the Bible in contemporary "American" English. Accusations of the professor's irreligion, bad taste, vulgarity, and crass modernity emerged from nearly every quarter of the Protestant establishment (with …

Tongues United: Polyphonic Identities And The Hispanic Family, José Medina Jan 2006

Tongues United: Polyphonic Identities And The Hispanic Family, José Medina

Ethnic Studies Review

In this paper I will use the Bakhtinian notion of polyphony,1 of a choral dialogue of multiple and heterogeneous voices, to elaborate a pluralistic account of cultural identity in general and of Hispanic identity in particular. I will complicate and further pluralize the Bakhtinian notion by talking about the overlapping and criss-crossing dialogues of heterogeneous voices that go into the formation of cultural identities. My pluralistic view emphasizes that cultural identity is bound up with differences and opposes those homogeneous models that try to impose a unique articulation of collective identity on the members of a group. Although I will …

Whiteness Studies And The Colonial Aesthetic: Western Popular Culture And The Representations Of Race, Isabel Cserno Jan 2006

Whiteness Studies And The Colonial Aesthetic: Western Popular Culture And The Representations Of Race, Isabel Cserno

Ethnic Studies Review

As I have said before, planters are not poetical; but, my heart! if I possessed this place, methinks while young morning blushed, or high noon slept, or gentle dewy evening made nature think and pause, I would stroll upon my terrace, or sit, three parts recumbent, on one of those old oak chairs with Hasting's coronet on it, and forget the world of strife and penury and pain, till I lapsed into a citizen of the other world of peace and plenty and joy!

The Use And Misuse Of Comparative Constitutional Law (The George P. Smith Lecture In International Law), Cheryl Saunders Jan 2006

The Use And Misuse Of Comparative Constitutional Law (The George P. Smith Lecture In International Law), Cheryl Saunders

Indiana Journal of Global Legal Studies

This article examines the extent and nature of the use of foreign law in constitutional adjudication in common law systems outside the United States, with special reference to Australia. Demonstrating that the courts of other common law jurisdictions use foreign case law readily, naturally, and for a variety of purposes, the article reaches two broad conclusions: (1) as a generalization, other common law countries do not share the concern about the legitimacy of comparative precedents that manifests itself in the United States, and (2) as a consequence, other common law countries necessarily share with the United States an interest in …

Beyond A Snapshot: Preventing Human Trafficking In The Global Economy, Janie Chuang Jan 2006

Beyond A Snapshot: Preventing Human Trafficking In The Global Economy, Janie Chuang

Indiana Journal of Global Legal Studies

Current legal responses to the problem of human trafficking often reflect a deep reluctance to address the socioeconomic root causes of the problem. Because they approach trafficking as an act (or series of acts) of violence, most responses focus predominantly on prosecuting traffickers, and to a lesser extent, protecting trafficked persons. While such approaches might account for the consequences of trafficking, they tend to overlook the broader socioeconomic reality that drives trafficking in human beings. Against this backdrop, this article seeks to reframe trafficking as a migratory response to current globalizing socioeconomic trends. It argues that, to be effective, countertrafficking …

The New Politics Of Linkage: India's Opposition To The Worker's Rights Clause, Kevin Kolben Jan 2006

The New Politics Of Linkage: India's Opposition To The Worker's Rights Clause, Kevin Kolben

Indiana Journal of Global Legal Studies

This article examines why India has opposed a World Trade Organization (WTO) workers' rights clause, and calls for a new way of thinking about international institutions and the link between trade and labor rights. Many labor rights supporters argue that labor rights principles should be integrated into the WTO, either via the addition of a workers' rights clause or through a 'judicial" reading of labor rights values into the existing WTO framework. But India has led a large block of developing countries in opposing any link between labor rights and the WTO. This opposition has been based primarily on economic …

An Investigation Of The Effects Of The Gerogis Framework For Integrating Technology(In Tech) Training Program On Teachers' Computer Self-Efficacy And Computer Utilization, Ian Johnson

CCAC Theses and Dissertations

National technology standards drafted by the International Society for Technology in Education (ISTE) are incorporated into the technology standards required of American public schools. The state board of education in Georgia instituted the Georgia Framework for Integrating TECHnology (InTech), which is a 50-hour training program that prepares teachers to help their students accomplish technology standards and performance objectives.

The goal of this study was to investigate the effects on teachers' computer self-efficacy, technology integration, current instructional practices, personal computer use and factors relating to use or non-use of computers in the curriculum after completing the Georgia Framework for Integrating TECHnology …

The Marketing Of Mussolini : American Magazines And Mussolini, 1922-1935, Anthony F. Ambrogi Jan 2006

The Marketing Of Mussolini : American Magazines And Mussolini, 1922-1935, Anthony F. Ambrogi

Master's Theses

Until the Halo-Ethiopian War, Italian dictator Benito Mussolini and the American press had a symbiotic relationship. Mussolini used his charisma and journalistic skills to put himself in the limelight of the American foreign press, and whether they loved him or hated him, American periodicals relished the constant flow of news and sensationalism from Rome. This analysis examines the rise of Fascism and Mussolini in Italy and his efforts to market himself to the press, especially the American press. It then reviews American magazines from 1922 until Italy's invasion of Ethiopia in 1935 and their varying attitudes toward II Duce. Popular …
