State Courts And The Interpretation Of Federal Statutes, Anthony J. Bellia Jr. Oct 2006

State Courts And The Interpretation Of Federal Statutes, Anthony J. Bellia Jr.

Vanderbilt Law Review

In the debate over how federal courts should interpret federal statutes, "faithful agent" theories stand pitted against "dynamic" theories of statutory interpretation. The following questions lie at the heart of the debate: Is the proper role of federal courts to strive to implement the commands of the legislature-in other words, to act as Congress's faithful agents? Or, is the proper role of federal courts to act as partners with Congress in the forward-looking making of federal law-in other words, to interpret statutes dynamically? Proponents of faithful agent theories include both "textualists" and "purposivists." Textualists have argued that federal courts best …

Membrane Systems With Limited Parallelism, Bianca Daniela Popa Oct 2006

Membrane Systems With Limited Parallelism, Bianca Daniela Popa

Doctoral Dissertations

Membrane computing is an emerging research field that belongs to the more general area of molecular computing, which deals with computational models inspired from bio-molecular processes. Membrane computing aims at defining models, called membrane systems or P systems, which abstract the functioning and structure of the cell. A membrane system consists of a hierarchical arrangement of membranes delimiting regions, which represent various compartments of a cell, and with each region containing bio-chemical elements of various types and having associated evolution rules, which represent bio-chemical processes taking place inside the cell.

This work is a continuation of the investigations aiming to …

Stress And Fatigue In Foreign Language Professionals: Implications For Global Security, James A. Mccubbin, June J. Pilcher, Thomas W. Britt, Thomas Wallsten

Publications

Information critical to the security of nations is embedded in an array of foreign languages. Foreign language professionals must often analyze complex information from different language sources, and the integrity of their analyses can significantly affect corporate and government decision-making, policy development, and response to world events. Psychological stress and fatigue can degrade the performance of foreign language professionals resulting in errors that may adversely affect security. Optimal design of work organization and work environments, individual stress management training, and augmented cognitive linguistics may facilitate the performance of foreign language professionals. Strategic assessment and management of stress and fatigue in …

The Role Of Educational Leaders In Implementing A Culturally Responsive Pedagogy Designed To Increase The Learning Opportunities For Diverse Students, Frank Andrews Oct 2006

The Role Of Educational Leaders In Implementing A Culturally Responsive Pedagogy Designed To Increase The Learning Opportunities For Diverse Students, Frank Andrews

Academic Leadership: The Online Journal (2003-2012)

While there has been a dramatic shift in the demographic educational landscape of the United States, to a more culturally diverse student population, the characteristics of teachers and educational leaders have remained largely homogeneous. Classroom teachers and school principals remain predominately White, approximately 90%, and 84% respectively (National Center for Education Statistics, as cited in Taylor & Whittaker, 2003). According to many experts, the differences between school and home culture result in lower rates of academic achievement for diverse learners. This article focuses on the challenge facing educational leaders to respond to this demographic shift by leading the implementation of …

Rahner's Primordial Words And Bernstein's Metaphorical Leaps: The Affinity Of Art With Religion And Theology, Robert Masson

Theology Faculty Research and Publications

Karl Rahner's notion of primordial words and Leonard Bernstein's conception of music as intrinsically metaphorical are engaged to suggest that there is a fundamental affinity between artistic and religious imagination. The affinity is grounded, in part at least, in metaphoric process—an elemental cognitive act in which the human spirit is stretched so that its expressions can address what lies beyond them.

Court Review: Volume 43, Issue 3 – Jailing Ourselves: Standards Used For Declaring United States Citizens To Be Enemy Combatants, Joseph Carl Storch

Court Review: Journal of the American Judges Association

On a clear, blue September morning in 2001, nineteen men hijacked four commercial airplanes headed toward the West Coast. They crashed two into the World Trade Center in New York City, one into the Pentagon in Northern Virginia, and one into a Pennsylvania field. In the wake of the shocking attack, Congress authorized President Bush to use military force against those who committed the attack, commencing a “war on terror” that still rages today.

The government has fought the “war on terror” on many fronts. The military is engaged in Afghanistan and Iraq; diplomatic overtures have been made to Libya …

The Hermeneutic Foundations Of Qualitative Research, Bernd Reiter Oct 2006

The Hermeneutic Foundations Of Qualitative Research, Bernd Reiter

Government and International Affairs Faculty Publications

This article is the result of reflection that emerged while conducting qualitative field research on nationalism and exclusion in Portugal. The problem I confronted was when to stop interviewing. Stated more precisely, I was seeking an answer to the question of when one has collected enough empirical data to support or reject one’s hypotheses. This initial problem led me to a rather old discussion on the difference between natural and human sciences that has characterized German academic life for many years–in fact, since the early 19th century–producing some more heated phases of academic dispute, known as the Positivismusstreit in the …

The Sacred Performative: Holy Wednesday And Colonial Ritual/Theatre, Christopher B. Swift Oct 2006

The Sacred Performative: Holy Wednesday And Colonial Ritual/Theatre, Christopher B. Swift

Publications and Research

"Holy Wednesday" is a late sixteenth century adaptation of a Spanish auto sacramental (sacred play) written in alphabetized Nahuatl, the predominant pre-Columbian language spoken on the High Central Plateau of Mexico. The author remains unknown, however he was likely a Nahua amanuensis educated by Franciscans at Colegio de Santa Cruz in Tlatelolco. Religious drama was one of the important evangelizing tools of the Catholic brotherhoods in colonial Mexico and although a record of performance of Holy Wednesday does not exist, this dramatic depiction of the final meeting of Christ and Mary prior to the crucifixion was almost certainly performed as …

The Supreme Court Report 2005-06, Julie M. Cheslik, Jamie Landes, Leah Pollema, Michael Shelton

Faculty Works

This article reviews the decisions of the U.S. Supreme Court for the 2005-2006 term focusing on decisions of particular relevance to state and local government. The Court's 2005-06 Term began with much speculation as one, then a second new Justice joined the Court. After the close of the 2004-05 Term, the Court suffered the loss of Chief Justice William Rehnquist, who succumbed to the thyroid cancer that had plagued him during that Term. President Bush ultimately replaced him with Judge John G. Roberts, who began the new Term and authored his fi rst opinion, the traditional 9-0 opinion of a …

Beyond Orientalism And Islamophobia: 9/11, Anti-Arab Racism, And The Mythos Of National Pride, Steven Salaita

Faculty Journal Articles

This article will be broken into three parts: The first part will justify my disprivileging of the terms Orientalism and Islamophobia and outline the features of anti-Arab racism according to the intensive research of corporate American media I conducted during production of my book Anti-Arab Racism in the USA: Where It Comes from and What It Means for Politics Today (2006); the second part will examine the way anti-Arab racism is interpolated across cultural, religious, and linguistic institutions in the United States and reinvents itself continually based on the peculiarities of American history and the United States’ geopolitical relationship with …

Problematizing The Pursuit Of Social Justice Education, Martin Scanlan Oct 2006

Problematizing The Pursuit Of Social Justice Education, Martin Scanlan

College of Education Faculty Research and Publications

Leadership for social justice embraces diversity, promotes inclusivity, and transforms relationships between schools and communities (Riehl, 2000). Though calls for such leadership abound (Bates, 2006; Blackmore, 2002; Cambron-McCabe & McCarthy, 2005; Larson & Murtadha, 2002; Marshall & Oliva, 2006b), the intricacies and inconsistencies of this pursuit are less frequently subjected to case study analysis. Drawn from a multicase study of schools serving traditionally marginalized students (Scanlan, 2005), this article examines how leadership efforts toward social justice can paradoxically lead to truncated manifestations of this goal. The implications of the original study suggest that school leaders need to problematize – not …

Friendship, Otherness, And Gadamer’S Politics Of Solidarity, Darren R. Walhof Oct 2006

Friendship, Otherness, And Gadamer’S Politics Of Solidarity, Darren R. Walhof

Peer Reviewed Articles

This article makes the political dimension of Gadamer’s thought more explicit by examining the interplay of three concepts in his work: solidarity, friendship, and the other. Focusing primarily on certain post–Truth and Method writings, I argue that Gadamer’s conception of solidarity has to do with historically contingent manifestations of bonds that reflect a civic life together of reciprocal co-perception. These bonds go beyond conscious recognition of observable similarities and differences and emerge from encounters among those who are, and remain, in important ways other to each other. I make this case through an analysis of Gadamer’s phenomenology of friendship and …
