Forensic Linguistics: An Introduction To Language In The Justice System, By John Gibbons, Drury Stevenson Jan 2006

Forensic Linguistics: An Introduction To Language In The Justice System, By John Gibbons, Drury Stevenson

University of Colorado Law Review

John Gibbons's book Forensic Linguistics provides an excellent introduction to the different areas of interdisciplinary studies involving linguistics and law. Gibbons explores many of the unique linguistic features of legal writing and courtroom speech, and discusses legal regulation of inappropriate uses of language (threats, lies, etc). This review surveys each of these sections of Gibbons's work, and adds in depth critique on issues related to "audience design " in legal documents and the linguistic pitfalls of relying on trial transcripts.

Ricoeur’S Critical Hermeneutics And The Psychotherapeutic Model Of Critical Theory, Francis J. Mootz Iii Jan 2006

Ricoeur’S Critical Hermeneutics And The Psychotherapeutic Model Of Critical Theory, Francis J. Mootz Iii

Scholarly Works

This paper seeks to extend Ricoeur’s acclaimed mediation of the Gadamer-Habermas debate. Freud’s psychoanalytic practice was an important touchstone for the debate, and Ricoeur’s reading of Freud provides a key to his critical intervention in the debate. The emerging postmodern account of psychotherapeutic practice provides a model of the critical hermeneutics that Ricoeur championed. Bringing Ricoeur’s insights to bear on this model, we can advance the questioning spurred by the Gadamer-Habermas debate without pretending to bring closure to the unending conversation of thinking.

Objectification Or Liberation? Bisexual And Lesbian Women's Experiences With Physical Appearance, Amy Black

Open Access Dissertations

Using a multi-method qualitative design and analytic approaches derived from grounded theory, the current study examined the appearance standards within lesbian and bisexual communities and how these norms relate to lesbian and bisexual women's psychological experiences with physical appearance. The study investigated how the women's diverse social identities relate to these experiences. Participants consisted of a relatively diverse sample of 24 bisexual (n = 10) and lesbian (n = 14) women who took part in 1 of 4 focus groups. From this sample, 4 bisexual women and 6 lesbians were recruited to participate in in-depth interviews. Participants represented a broad …

Menus Matter, Ian Ayres Jan 2006

Menus Matter, Ian Ayres

University of Chicago Law Review

Lawmakers can affect contractual equilibria by regulating contractual menus. The potential impact of menu regulation grows more important in contexts where contractors are cognitively constrained or imperfectly informed. This Essay explores the regulation of menus-both with regard to the simultaneous, alternative offers that private parties make to each other, and with regard to the offers that the state makes to potential contractors themselves.

Paternalism And Psychology, Edward L. Glaeser Jan 2006

Paternalism And Psychology, Edward L. Glaeser

University of Chicago Law Review

Does bounded rationality make paternalism more attractive? This Essay argues that errors will be larger when suppliers have stronger incentives or lower costs of persuasion and when consumers have weaker incentives to learn the truth. These comparative statics suggest that bounded rationality will often increase the costs of government decisionmaking relative to private decision-making, because consumers have better incentives to overcome errors than government decision-makers, consumers have stronger incentives to choose well when they are purchasing than when they are voting, and it is more costly to change the beliefs of millions of consumers than a handful of bureaucrats. As …

The Role Of Rules In Antitrust Analysis, John J. Flynn Jan 2006

The Role Of Rules In Antitrust Analysis, John J. Flynn

Utah Law Review

The analysis of antitrust issues is captured from time to time by rigid rules comprised of fixed concepts that are deductively applied to pre-ordained facts in disputes deemed subject to the antitrust laws. The rules are characterized by narrow assumptions of what will be permitted to be facts, by concepts that are fixed in concrete by rigid definitions, and by unstated normative assumptions underlying the rules and concepts. Calcification of concepts sets in and mumpsimus becomes the distinguishing characteristic of defenders of the periodic status quo generated by the antitrust less fashionable at one time or another. The mechanical jurisprudence …

Graduate Research Papers

The purpose of this project was to examine current available resources related to emergent literacy in order to create a core list of literature for early childhood center libraries. "Research suggests that the foundation for academic success is laid well before a child enters the public schools" (Smith, Fairchild, and Groginsky, 1997, p. ix). The researcher described past and present Federal initiatives that support these efforts. Current curriculum guidelines and recommendations from national organizations for early childhood learning centers were examined to determine what resources were needed to provide a framework for learning. Studies examined emphasized that exposing children to …

Methodological Challenges For Identifying And Coding Diverse Knowledge Elements In Interview Data, Victor R. Lee, Moshe Krakowski, Bruce Sherin, Megan Bang, Gregory Dam

Instructional Technology and Learning Sciences Faculty Publications

This paper, as part of a symposium on the analysis of clinical interview data and the development of a framework for analyzing students' intuitive science knowledge, identifies and discusses methodological challenges encountered when specifying the knowledge elements and resources are invoked dynamically during a clinical interview. Drawing from interviews with middle school students about the seasons and an analysis of knowledge in terms of 'nodes', two classes of problems are identified: those associated with identification of nodes and those associated with their application as codes to a transcript-based data corpus. We posit that these challenges are common ones associated with …

Se diferencia de las actividades de clase tradicionales en que no es corta, ni se realiza de manera aislada por un estudiante que sólo hace lo que le dice el profesor.

Theoretical Perspectives On Industry Clusters, Gashawbeza W. Bekele, Randall Jackson Jan 2006

Theoretical Perspectives On Industry Clusters, Gashawbeza W. Bekele, Randall Jackson

Regional Research Institute Working Papers

The concept of industry clustering has generated much discussion in regional economic development theory and practice in recent years. Yet it is fair to say that an accepted definition or a unified theoretical framework has failed to emerge from the discussion, as the concept often seems to enliven itself under divergent theoretical approaches, including but not limited to work on agglomeration economies, industrial districts, business networks, knowledge spillovers, and regional innovation systems. This paper provides a review of the major theoretical propositions that seek to explain the clustering of economic activity and its presumed link with regional economic development. While …

Assessing The Productivity Of Tense Marking In Young Children : Language Sample Analysis Versus Parent Report, Emily Frauenfeld-Block

Honors Capstones

The purpose of this capstone is to determine if certain items from the CDI: WS could be used to assess the productivity of tense marking in young children at risk for specific language impairment at 36 months. Recently, Hadley and Short (2005) devised cumulative measures of capturing the onset of tense marking during the earliest period of grammatical development. Their investigation was driven by the need to determine if the late emergence and limited productivity of tense morphemes could be used to detect children at risk for SLI at younger ages. However, their methods, which rely upon comprehensive, longitudinal language …

Linguistics And Claim Construction, Kristen Jakobsen Osenga Jan 2006

Linguistics And Claim Construction, Kristen Jakobsen Osenga

Law Faculty Publications

This Article argues that patent claim construction should instead track the way in which we, as readers of a language, attempt to understand what is being conveyed via the written word. First, there is a base level of conventional understanding from which all interpretation starts, an understanding that either a priori exists based on our earlier encounters with the word or is obtained from a dictionary in cases in which we lack previous knowledge. Second, from this conventional understanding, we construct the actual meaning of the term based on a number of linguistic clues. These clues are both internal and …
