Constitutional Norms In A State Of Permanent Emergency, Sanford Levinson Jan 2006

Constitutional Norms In A State Of Permanent Emergency, Sanford Levinson

Georgia Law Review

Perhaps the most important constitutional issue of our time involves claims by the President to exercise power sufficient to confront ostensible 'emergencies" faced by the United States. One question is whether the Constitution grants the President sufficient powers. If not, are presidents justified in going 'beyond the Constitution"in order to do what they believe necessary in the given context? Professor Levinson demonstrates that debates about "emergency powers" have been a feature of our political system almost from its beginning. Many of those deemed our "greatest" presidents-Jefferson, Lincoln, and Franklin Roosevelt-have acted in questionable ways with regard to what might legitimately …

Atanarjuat And The Ideological Work Of Contemporary Indigenous Filmmaking, Monika Siebert Jan 2006

Atanarjuat And The Ideological Work Of Contemporary Indigenous Filmmaking, Monika Siebert

English Faculty Publications

Ilanaaq is the latest North American example of “playing Indian” (Deloria 1998), a practice with vast historical precedent. With ilanaaq, Canada joins a host of nations who have turned to symbols of local indigeneity to assert their national distinctiveness. Such appropriation presents indigenous artists with a dilemma. The current flowering of indigenous letters, art and cinema in North America is generally taken as evidence that Canada and the United States, as thriving multiculturalist democracies, have broken with an earlier history of the expropriation and displacement of the Americas’ indigenous peoples. The art bears witness to a new historical period, in …

Legal Pluralism Between Islam And The Nation-State: Romantic Medievalism Or Pragmatic Modernity?, Sherman A. Jackson Jan 2006

Legal Pluralism Between Islam And The Nation-State: Romantic Medievalism Or Pragmatic Modernity?, Sherman A. Jackson

Fordham International Law Journal

This Essay attempts a reconciliation of sorts between two perspectives on legal pluralism, via specific reference to Islamic law, most notably in its pre-modern guise. The Essay begins with a provisional commitment to legal centralism, but primarily as a means of securing a functional place for sub-State reglementary regimes. To this end, legal centralism, as presented, is tempered by a demonstration that, even where the State enjoys an exclusive monopoly on the application of sanctions with impunity, it need not be the actual source of every rule it recognizes or applies as law.

This Report presents the findings of this research effort. Following this introduction, Part I of this Report describes South Africa's international and domestic legal obligations regarding culture and gender equality, particularly with respect to marriage, divorce, and family formation. Part I then sketches two distinct approaches to the tension between customary law and gender equality, both of which …

The Promiscuity Of Print: John Clare’S ‘Don Juan’ And The Culture Of Romantic Celebrity, Jason N. Goldsmith Jan 2006

The Promiscuity Of Print: John Clare’S ‘Don Juan’ And The Culture Of Romantic Celebrity, Jason N. Goldsmith

Scholarship and Professional Work - LAS

This essay offers a new reading of John Clare's "Don Juan," a hard-hitting and deliberately vulgar denunciation of English society and letters. In his extended Byronic performance, Clare harnesses Byron's famed sexual appetite and strong Romantic irony to dramatic effect, defiantly redeploying the machinery of literary celebrity that had produced him as "The Northamptonshire Peasant Poet." Tracing Clare's imaginative and textual investments in prostitutes and boxers, figures located at the margins of London's criminal underworld, I show how the compulsive misogyny of "Don Juan" and its obscene sexual punning form part of a concerted, if not entirely coherent, response to …

Hate Crime Law And The Limits Of Inculpation, Janine Young Kim Jan 2006

Hate Crime Law And The Limits Of Inculpation, Janine Young Kim

Faculty Publications

Critics sometimes maintain that hate crime law punishes an offender for her motive and character and is therefore doctrinally and morally illegitimate. This manuscript explores the concept of culpability to examine this challenge, and argues that critics inaccurately assume that our criminal law conditions culpability on a robust understanding of choice. This inaccuracy significantly undermines the doctrinal critique against hate crime law, which in fact appears to be consistent with many other laws that consider motive and character as relevant factors in determining degree of guilt and proportionate punishment. Notwithstanding the apparent doctrinal validity of hate crime law, the author …

Interrogating Torture And Finding Race, Ayanna Thompson Jan 2006

Interrogating Torture And Finding Race, Ayanna Thompson

Studio for Law and Culture

Antonin Artaud’s second manifesto for the Theatre of Cruelty cries out for a theatre that will depict “great social upheavals” and “conflicts between peoples and races.” Opposed to “disinterested” theatre, Artaud designed the Theatre of Cruelty to depict and affect not only the “tortured victims,” but also the “executioner-tormentor himself.” Artaud viewed both as trapped by “a kind of higher determinism” which he sought to alter through the Theatre of Cruelty (102). To usher in this new theatrical tradition, Artaud declared that the “first spectacle of the Theatre of Cruelty will be entitled: The Conquest of Mexico” (126). Explaining …

The Ciego In The Novels Of Galdós: Costumbrismo, Realism, Symbolism, Vernon Chamberlin Jan 2006

The Ciego In The Novels Of Galdós: Costumbrismo, Realism, Symbolism, Vernon Chamberlin

Decimonónica

Like many of his contemporaries, both in Spain and other European countries, Galdós utilized many blind characters in his novels1. Although he was unaware of the fact as he created these characters, he himself would spend his final years sightless. Individual Galdosian blind characters are sometimes mentioned by critics as part of the overall discussion of specific works, but to date there has been no study showing how pervasive the ciego is throughout the vast panorama of Galdós’s works. Therefore, the aim of the present study is to demonstrate that the ciego, and the multiplicity of his …

Subversion In Gertrudis Gómez De Avellaneda’S Sab, Reina Barreto Jan 2006

Subversion In Gertrudis Gómez De Avellaneda’S Sab, Reina Barreto

Decimonónica

The colonial and slave society that was Cuba of the early nineteenth century is the setting for Gertrudis Gómez de Avellaneda’s first novel, Sab.1 Published in Madrid in 1841, this novel represents Avellaneda’s literary struggle against the injustices of slavery and the oppressive treatment of women within the patriarchal Romantic framework of the early 1800s. Avellaneda’s novel draws a parallel between women and slaves: “Como los esclavos, ellas arrastran pacientemente su cadena y bajan la cabeza bajo el yugo de las leyes humanas” (Gómez de Avellaneda 194). Catherine Davies states that Sab “is the only feminist-abolitionist novel published …
