The use of authorial marks in relation to the sale of creative works, like the use of business trademarks in relation to the sale of goods and services, creates social benefits that deserve legal protection. Authorial attribution acts as an incentive to authorial production, provides valuable information to consumers, and provides additional social benefits that go beyond issues of market efficiency. However, the use of authorial marks, like the use of trademarks, can create social harms. Just as counterfeiters place illegitimate trademarks on goods, exploiters of entertainment markets may be tempted to misattribute authorship. In the United States, such deceptive …

While rail has been the focus of most planning for Transit Oriented Development (TOD), there has been recent interest in bus-related TOD with an emphasis on new bus rapid transit (BRT) systems in North and South America and Australia. This article takes a critical look at the strengths and challenges of bus-based transit systems compared to rail in relation to TOD. It includes a review of the literature and an assessment of TOD-related developments. The Qualitative Report
The purpose of this paper is to discuss the development of research questions in mixed methods studies. First, we discuss the ways that the goal of the study, the research objective(s), and the research purpose shape the formation of research questions. Second, we compare and contrast quantitative research questions and qualitative research questions. Third, we describe how to write mixed methods research questions, which we define as questions that embed quantitative and qualitative research questions. Finally, we provide a framework for linking research questions to mixed methods data analysis techniques. A major goal of our framework is to illustrate that …

Before the civil war, “lynching” signified all forms of group-inflicted punishments, including vigilantism and mob killings. By this definition, lynchings happen in every country. Only in America, however, was lynching widespread and socially accepted. Scholars say this shows that the American commitment to due process often succumbed to “vigilante values,” that is, the desire for speedy, certain and severe penalties. They contend that vigilante values triumphed on the frontier, where courts were weak and vigilance committees strong. This article demonstrates that this view must be substantially qualified because due process was of great concern to Americans on the frontier, especially …

The Effect Of Local Life Circumstances On Female Probationers' Offending, Marie L. Griffin, Gaylene Armstrong
Criminology and Criminal Justice Faculty Publications
This article examines the influence of change in local life circumstances on the short-term criminal behavior of female drug-abusing probationers. Using a binomial hierarchical generalized linear model, we examine the probability that certain “discrete life events” act to modify or change criminal behavior in the short term. The findings indicate that participants' involvement in conventional activities results in the decreased likelihood of engaging in nondrug crimes but an increased likelihood of drug dealing. Faced with this contradiction, we suggest that the dynamics of offending are altered by the nature of the criminal activity itself and the way in which gender …

Ethiopia’s 70-year history of internal and international armed conflict, from the Italian invasion of 1935 to the Ethiopian- Eritrean War (1998–2000), has contributed to significant landmine and unexploded ordnance contamination. Ethiopia is one of the world’s 10 most heavily mined countries, with the government estimating it will take decades to clear. The most extensive contamination is in the Tigray, Afar and Somali regions. It is estimated that during the recent Ethiopian-Eritrean conflict, Ethiopian forces laid 150,000–200,000 landmines and Eritrea laid 240,000 mines over the disputed border areas.

Libya is one of the world’s largest socialist republics and has been ruled by many different foreign powers. Libya’s official name is the Great Socialist People’s Libyan Arab Jamahiriya. During the Turk-Italian War of 1911, there was a constant battle between the Libyans and the Italians until the Italians seized the country in 1939. It was also the major battleground in northern Africa when Italy entered World War II, which left many landmines scattered throughout Libya. This study examines the institutional development of the abbey of La Chaise-Dieu, whose evolution depended upon its community of monks, its patrons, and its response to the demands placed upon it by the society at large and the Church in general. It examines these factors as they were managed by its first eightabbots by tracing the development of their personal, social, political, and ecclesiastical networks in an effort to identify how those interactions took place and why they took the forms they did. The decision of Brown v. Board of Education to desegregate schools in the United States fifty-two years ago was approached with hesitation by many school districts. For half of those fifty-two years, school desegregation proceeded at a snail's pace in southern and northern school districts as civil rights lawyers waged trench warfare in federal courts. Even though it was "law," many school districts ignored the mandate or suffered from the "with all deliberate speed" syndrome. The focus of this study was to investigate the educational segregation and desegregation of students in the Edinburg Consolidated Independent School District (ECISD).

The use of color creates a varied reaction from person to person within the human experience. Color has been theorized to have many different symbolic meanings. However, no definitive link between color and symbolic meaning has been found. Research about human response to color has been examined in relation to cognitive, psychological, and physiological effects. Within the field of art therapy, color is important for understanding the client’s view. Aston draws on his own research in Yemen and Oman as well as on the work of other scholars and researchers to explore two locations in the Book of Mormon account of Lehi’s journey through Arabia: Nahom and Bountiful. Preliminarily, Aston highlights Nephi’s own directional indications for each leg of the journey, considers the relevance of existing trade routes, and suggests relative durations of stops along the way. He reviews the research on the tribal area associated with Nahom, including the discovery of an altar dating to roughly 600 bc that bears the tribal name NHM—possibly the first archaeological evidence …

Royal Skousen’s endeavor to recover the original text of the Book of Mormon is more complicated than it seems because it involves more than simply reproducing the original manuscript. Rather, what Skousen means by “original text” is the very language that appeared on the Urim and Thummim. Every subsequent step, such as Joseph’s reading, his scribes’ understanding and transcribing of that utterance, and Oliver Cowdery’s copying of the manuscript for the printer, exposed the text to the possibility of human subjectivity and error. Until now, nearly all commentaries on the Book of Mormon have focused mainly on issues of doctrine rather than beginning with the text itself. Royal Skousen’s critical text project does the opposite by treating the text itself on the word and phrase level. Skousen weighs nearly all possible evidence to deduce the events that may have led to the variations seen in the texts and to draw conclusions about which readings are most likely original. Some conclusions may surprise readers, but Skousen is more interested in candidly documenting what the texts reveal than in interpreting all the implications. Several lengthy …

Both student activism and Internet use by students are among the fastest growing variables in national reports of student engagement (Astin, 2004; Levine & Cureton, 1998b). This study introduces the term estudentprotest to describe how contemporary student activists use information and communication technologies (ICTs) for protest. A sequential mixed methods design (Creswell, 2003) was utilized. This approach involved obtaining statistical information from a sample for descriptive and outcome analyses, using the results to suggest nodes for an investigation of social networks, and finally interviewing individuals to explore those results in more depth.
