The Information Quality Act: The Little Statute That Could (Or Couldn't?) Applying The Safe Drinking Water Act Amendments Of 1996 To The Federal Communications Commission, Kellen Ressmeyer

Federal Communications Law Journal

In December 2000, Congress passed the Information Quality Act - a two sentence rider to a 712-page Appropriations Bill. The Information Quality Act, which seeks to ensure the quality of government-disseminated information, places the White House Office of Management and Budget in a supervisory role. The Office of Management and Budget subsequently finalized a set of mandatory Guidelines applicable to all federal agencies. Among other things, the Guidelines require adherence to the scientific standard articulated in the 1996 Amendments to the Safe Drinking Water Act where such agencies engage in risk analysis to human health, safety, and the environment. As …

Sometimes Close Is Good Enough: The Value Of Nearby Environmental Amenities, Lucie Schmidt, Paul N. Courant Dec 2006

Sometimes Close Is Good Enough: The Value Of Nearby Environmental Amenities, Lucie Schmidt, Paul N. Courant

Economics: Faculty Publications

An extensive empirical literature exists, showing that variations in region-specific amenities can account for persistent differences in real wages across regions. However, this literature has considered only amenities in the same location as the household. This paper argues that environmental amenities at some distance from but accessible to urban areas may lead to negative compensating wage differentials. We use a general equilibrium framework and data from the 1995 Current Population Survey to calculate implicit amenity prices based on measures of distance to environmental amenities. Our results suggest that amenities outside the metropolitan area do generate compensating wage differentials, as workers …

Pedagogy Of Social Justice: An Inquiry Into The Experiences Of African American Adolescent Males, Natalie Ann Lambright

College of Graduate Studies: Theses & Dissertations

Using Critical Race Theory (Crenshaw, Gotanda, Peller, & Thomas, 1995; Ladson-Billing, 1998; Richard Delgado & Jean Stefanic, 2000; Solorzano & Yasso, 2002) as a theoretical framework, and critical narrative inquiry (Clendanin & Connelly, 1999) as research methodology, I explored stories from five eighth grade African American adolescent males in order to identify how home, community, and school experiences contributed to their academic success and social development. My passion for the inquiry was driven for my desire to foster a sense of agency for social justice and positive changes for the African American community. Selection of participants was based upon reading …

Derrida, Deconstruction And A Dialogue On The Contemporary Nursing Curriculum, Catherine Louise Gilbert

College of Graduate Studies: Theses & Dissertations

This theoretical inquiry utilizes the philosophy of Jacques Derrida and deconstruction to begin a discourse on the disconnect between student learning and nursing education within the academy. By entering into a thoughtful, reasoned and responsible critique of the nursing curriculum, this journey of discovery examines those constructs integral to nursing education: students, teachers, identity, the art and science of nursing, the curriculum, power and control, and the university, their (dis)connectedness and begins a dialogue that positions nursing education as the legitimate professional nursing curricula for the next millennium. This journey of discovery recognizes an underlying thesis; meaningful learning that facilitates …

Data Note: The Relationship Between Supported Employment Status And Minimum Wage For Vocational Rehabilitation Integrated Employment Closures In 2004, Frank A. Smith, Dana Scott Gilmore Dec 2006

Data Note: The Relationship Between Supported Employment Status And Minimum Wage For Vocational Rehabilitation Integrated Employment Closures In 2004, Frank A. Smith, Dana Scott Gilmore

Data Note Series, Institute for Community Inclusion

Some VR customers earn less than minimum wage despite being closed successfully, i.e., exiting Vocational Rehabilitation (VR) services into an integrated employment setting. Section 14(c) of the Fair Labor Standards Act allows employers to pay less than the minimum wage to a person whose disability impairs their capacity to be productive at a particular job. People in supported employment are more likely to have a disability that makes them eligible for Section 14(c) minimum wage exemption. How do wages for customers in supported employment compare to those earned by other customers?

Labeling “Genocide” In Sudan: A Constructionist Analysis Of Darfur, William F.S. Miles Dec 2006

Labeling “Genocide” In Sudan: A Constructionist Analysis Of Darfur, William F.S. Miles

Genocide Studies and Prevention: An International Journal

Labeling is critical for the framing, perception, and political implications of social problems, genocide being a critical but overlooked example. For half a century social-science theory has developed increasingly sophisticated paradigms for understanding the process by which problems are recognized and addressed: social constructionism, labeling theory, politico-linguistics, problem definition, and tipping points. Yet rarely have these theoretical frameworks been applied to genocide studies. When reconsidered in light of Sudan, these general frameworks validate the constructionist argument that the recognized severity of political problems—including government-organized or -sanctioned mass killings—is a function of the socio-linguistic processing and naming of them. Anti-genocide advocates, …

Book Review: Naomi Baumslag. Murderous Medicine: Nazi Doctors, Human Experimentation, And Typhus , Myma Goldenberg

Genocide Studies and Prevention: An International Journal

In Murderous Medicine: Nazi Doctors, Human Experimentation, and Typhus, Naomi Baumslag proposes an agenda for research on the connections among medicine, war, and genocide. Building on the groundbreaking work of Robert Jay Lifton, John J. Michalczyk, Howard Fertig, Arthur Caplan, Henry Friedlander, and others, Baumslag sets out to prove that the Nazis rewarded physicians who helped implement the Final Solution, specifically by encouraging the spread of typhus as a means of murdering Jews. By imposing and then neglecting deplorable conditions in the ghettos and camps, Baumslag argues, Nazi doctors ‘‘promoted typhus . . . because ‘natural death’ was cheaper than …

Computer Model To Select Leed Certification For Building Projects, Ruba Mirghani Mohammed

Masters Theses

According to the US Green Building Council (USGBC) residential and commercial buildings in the United State consume huge amounts of natural resources; pollute the environment, and generate large amounts of waste, all of which affect the environment, economy, public health, and productivity. As a result, USGBC committees developed the Leadership in Energy and Environmental Design (LEED) rating system to help professionals improve the quality of buildings and lessen their impact on the environment.

The (LEED) Green Building Rating System is a point-based system for certifying the level of a building's sustainability. There are four LEED certification categories: (1) Certified, (2) …

The Analysis Of Ceramic Symbolism From The First Street Site In Barbados, Aya Hashimoto Dec 2006

The Analysis Of Ceramic Symbolism From The First Street Site In Barbados, Aya Hashimoto

Masters Theses

The expression of race and racism in material culture is of increasing interest in historical archaeology ( e.g., Epperson 1990, 1999, 2000; Mullins 1996, 1999). This study investigates 6 ceramic sherds from one vessel associated with a white urban domestic site on First Street, in Holetown Barbados. This vessel conveys a racist message. A black slave in a loincloth serving tea to a white person is transfer printed on the ceramic. The ceramic seems to be an annular designed pearlware from England in the first half of the 19th century.

By interpreting the meanings of the ceramic decoration, this …

Mindful Teachers: Case Studies Of Intermediate Teachers And Their Mindful Teaching Practices, Christine Edwards Sherretz Dec 2006

Mindful Teachers: Case Studies Of Intermediate Teachers And Their Mindful Teaching Practices, Christine Edwards Sherretz

College of Graduate Studies: Theses & Dissertations

For generations, educational philosophers, parents, business people, and practitioners have argued that public schools promote mindless standardization that stifles creativity, curiosity, and enthusiasm for learning. The case has been made that instead of mindlessness, schools should be a place where mindful individuals can flourish. Langer (1989, 1997) described mindful individuals as displaying the following characteristics: (a) openness to novelty, (b) alertness to distinction, (c) sensitivity to different contexts, (d) awareness of multiple perspectives, and (e) orientation in the present. Langer (2000) states that mindlessness might be described as a lack of these attributes. The purpose of this research was to …
