Labor And Employment, Jerry C. Newsome, K. Alex Khoury Jul 2006

Labor And Employment, Jerry C. Newsome, K. Alex Khoury

Mercer Law Review

Several significant opinions affecting labor and employment law in the Eleventh Circuit were handed down by the Supreme Court and the Eleventh Circuit's trial and appellate courts during this survey period (January 1, 2005 to December 31, 2005). For example, the United States Supreme Court clarified the meaning of a continuous workday in IBP, Inc. v. Alvarez, expanding the amount of nonproductive time for which employers must pay their workers under the Fair Labor Standards Act ("FLSA"). Further, the Eleventh Circuit Court of Appeals and the United States District Court for the Middle District of Florida enforced a strict standard …

Gonzales V. Raich: Has New Federalism Gone Up In Smoke?, Laura W. Harper Jul 2006

Gonzales V. Raich: Has New Federalism Gone Up In Smoke?, Laura W. Harper

Mercer Law Review

In Gonzales v. Raich, the United States Supreme Court broke with recent federalist trends by holding that Congress did not exceed its Commerce Clause power in prohibiting the local growth and use of marijuana, which was legal under California state law. While the Court asserted that this case did not break with recent precedent restricting Congress's Commerce Clause power, this decision reaffirms expansive congressional power and creates uncertainty about whether federalist principles limit congressional power.

Making A Living In Rural Nebraska, Rebecca J. Vogt, Randolph L. Cantrell, Bruce B. Johnson, Alan J. Tomkins

Publications from the Center for Applied Rural Innovation (CARI)

Nebraska has historically had a low unemployment rate but the state’s per capita income has also been below the national average. How are rural Nebraskans making a living? How many households have individuals with multiple jobs? Why do individuals hold multiple jobs? How important is agriculture to rural Nebraskans’ families, communities and the state?

This report details 2,482 responses to the 2006 Nebraska Rural Poll, the eleventh annual effort to understand rural Nebraskans’ perceptions. Respondents were asked a series of questions about their jobs and their perceptions about the importance of agriculture in Nebraska. For all questions, comparisons are made …

Sleep Quality Of College Students And Its Relationship To Coping Styles And Well-Being, Cathy Alison Word Jul 2006

Sleep Quality Of College Students And Its Relationship To Coping Styles And Well-Being, Cathy Alison Word

Doctoral Dissertations

College students suffer from more sleep disturbances than the general population. Sleep difficulties in college students can lead to lower levels of performance, memory, and cognitive ability, as well as increased levels of anxiety and decreased levels of well-being. Sleep quality is known to impact individuals' physical and psychological health, which are indicators of well-being. Sleep also appears to influence individuals' choices of coping strategies. Sleep quality is also highly correlated with college students' emotional response to stress. The relationships between and among sleep quality, well-being, and coping style have not been fully examined. The purpose of this study was …

Effective Teaching Practices For Students With And Without Learning Difficulties: Constructivism As A Legitimate Theory Of Learning And Of Teaching?, Ken Rowe Jul 2006

Effective Teaching Practices For Students With And Without Learning Difficulties: Constructivism As A Legitimate Theory Of Learning And Of Teaching?, Ken Rowe

Student learning processes

Much of what is commonly claimed as ‘effective teaching practice’ and implemented during the early and middle years of schooling in Australian schools, for either mainstream students or for those experiencing learning difficulties, is not grounded in findings from evidencebased research. Of particular concern is that despite a lack of supporting evidence for its utility, the prevailing educational philosophy of constructivism (a theory of self-directed learning rather than a theory of teaching) continues to have marked influences on shaping teachers’ interpretations of how they should teach – aided and abetted by the content emphasis given during pre-service teacher education, as …

Movement Of Natural Persons Between The Philippines And Japan: Issues And Prospects, Tereso S. Tullao Jr, Michael Angelo A. Cortez

DLSU Business & Economics Review

Historically, the economic relations between the Philippines and Japan have been shaped by factors leading to the movements of goods, capital and people. Lately, the interspatial transfer of people has been defined by the asymmetric needs of each country. Considering the demographic changes in Japan, particularly its ageing population, and the Philippines’ excess labor and its ability to train health workers, we explore the possibility of meeting the asymmetric needs of both countries, examine how welfare and protection can be promoted, and analyze the impact on productivity enhancements to both countries

Transport Of Galectin-3 Between The Nucleus And Cytoplasm. I. Conditions And Signals For Nuclear Import, Peter J. Davidson, Su Yin Li, Andrew G. Lohse, Rianna Vandergaast Jul 2006

Transport Of Galectin-3 Between The Nucleus And Cytoplasm. I. Conditions And Signals For Nuclear Import, Peter J. Davidson, Su Yin Li, Andrew G. Lohse, Rianna Vandergaast

University Faculty Publications and Creative Works

Galectin-3, a factor involved in the splicing of pre-mRNA, shuttles between the nucleus and the cytoplasm. We have engineered a vector that expresses the fusion protein containing the following: (a) green fluorescent protein as a reporter of localization, (b) bacterial maltose-binding protein to increase the size of the reporter polypeptide, and (c) galectin-3, whose sequence we wished to dissect in search of amino acid residues vital for nuclear localization. In mouse 3T3 fibroblasts transfected with this expression construct, the full-length galectin-3 (residues 1-263) fusion protein was localized predominantly in the nucleus. Mutants of this construct, containing truncations of the galectin-3 …

Transport Of Galectin-3 Between The Nucleus And Cytoplasm. Ii. Identification Of The Signal For Nuclear Export, Su Yin Li, Peter J. Davidson, Nancy Y. Lin, Ronald J. Patterson

University Faculty Publications and Creative Works

Galectin-3, a factor involved in the splicing of pre-mRNA, shuttles between the nucleus and the cytoplasm. Previous studies have shown that incubation of fibroblasts with leptomycin B resulted in the accumulation of galectin-3 in the nucleus, suggesting that the export of galectin-3 from the nucleus may be mediated by the CRM1 receptor. A candidate nuclear export signal fitting the consensus sequence recognized by CRM1 can be found between residues 240 and 255 of the murine galectin-3 sequence. This sequence was engineered into the pRev(1.4) reporter system, in which candidate sequences can be tested for nuclear export activity in terms of …

Ex-Ante Evaluation Of Exclusive Bus Lanes Implementation, D. Tsamboulas Jul 2006

Ex-Ante Evaluation Of Exclusive Bus Lanes Implementation, D. Tsamboulas

Journal of Public Transportation

This article presents a comprehensive approach for the ex-ante evaluation and the identification of relevant impacts related to the implementation of Exclusive Bus Lanes (EBL). It proposes indicators to measure the impacts related to key stakeholders: public transport operators, taxis, private vehicle drivers and passengers, as well as society regarding energy and the environment. Impact values are estimated from the application of relevant transportation planning models. The ex-ante evaluation method is based on cost-benefit analysis (CBA) and is designed to assist any decision regarding implementation of EBL by determining whether it is beneficial. To demonstrate the capability of the approach, …

Tuberculosis Of The Scapula, Yousuf A. Husen, Naila Nadeem, Fawad Aslam, Muhammad Ali Shah Jul 2006

Tuberculosis Of The Scapula, Yousuf A. Husen, Naila Nadeem, Fawad Aslam, Muhammad Ali Shah

Department of Radiology

Tuberculosis (TB) of the scapula is an extremely rare presentation of osteoarticular tuberculosis. In a tuberculosis endemic setting with a rising burden of acquired immunodeficiency syndrome, this rare presentation may become more frequent. The common presentation is with longstanding Complaints of pain and swelling in the shoulder region, typically in young adults. Classic radiographic features include a well defined radiolucent lesion with minimal sequesteration. The erythrocyte sedimentation rate is usually elevated and initially these patients are frequently mis-diagnosed and thus a high index of clinical suspicion is required. Medical therapy with antituberculous drugs is the standard modality of treatment. This …
