“Arrogance Cloaked As Humility” And The Majoritarian First Amendment: The Free Speech Legacy Of Chief Justice William H. Rehnquist, Edward L. Carter, Brad Clark

In his 19 years as Chief Justice of theUnited States, William H. Rehnquist voted in favor of the individual expression interest asserted in approximately one-fifth of the Speech Clause cases heard by the Supreme Court. Meanwhile, he opposed protecting those constitutional interests in approximately two-thirds of the speech cases during that time. (His votes evidenced both speech-protective and non-protective elements just more than 10 percent of the time). This manuscript analyzes the Rehnquist jurisprudence in comparison with that of his two immediate predecessors as Chief, Warren Burger and Earl Warren. There is no dispute that the punitive damages award that was upheld by the Oregon Supreme Court in this case satisfies the most rigorous law and economic standards for rationality. The Court need not credit the analysis of the undersigned amici on this score; the fact that Petitioner’s own amici – most notably law and economics scholars A. Mitchell Polinsky and Steven Shavell – have been unable to find anything economically amiss in the decision below speaks volumes. Across Central Africa a commercial, unsustainable, and largely illegal hunting and trade in wildlife for meat has expanded in recent years causing immediate threat to countless wildlife populations and species. Currently, multi-national agreements and government initiatives created to address the bushmeat crisis in the region are unable to halt the extensive destruction to the area’s unique biodiversity . Although many of these agreements strongly support addressing the bushmeat crisis, they lack the resources and capacity to be fully implemented. This article deals with the legal status of postoperative transsexuals in terms of marriage and sex-based classifications. Until recently, sex has been assumed to be binary, i.e., male and female. Whether sex is immutable or transitory, objective or subjective, has now become an international concern. This article addresses every case in the world every decided on this issue.
