Regime Tension In The Intellectual Property Rights Arena: Farmers' Rights And Post-Trips Counter Regime Trends, Chidi Oguamanam Oct 2006

Regime Tension In The Intellectual Property Rights Arena: Farmers' Rights And Post-Trips Counter Regime Trends, Chidi Oguamanam

Dalhousie Law Journal

Recognizing the transitions that have occurred in the global intellectual property arena since the TRIPS Agreement, this article identifies and examines key sites of the counter regime trends in intellectual property rights with a focus on farmers' rights. It invokes farmers' rights to highlight the conceptual and juridicalhurdles facing the new issue-linkages that propel attempts to redress the shortcomings of the TRIPS' trade-centred approach to intellectual property. The author argues that the existingjuridical framework for farmers 'rights, especiallyunder the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA), although inchoate, is stymied and not competent to realize the expectations …

Building On Strong Foundations: Rethinking Legal Education With A View To Improving Curricular Quality, Veronica Henderson

Dalhousie Law Journal

Recent increases in law school tuition provide an occasion for criticalreflection on precisely what law students are being offered in their formal education. The aim of this article is to help catalyze discussion of what quality legal education entails. It begins by outlining the current underpinnings of Canadian legal education, especially the foundation of issue identification. Newer developments in legal education are also canvassed.A foundational critique is then applied to elucidate the main weakness of thepresent curricular structure: students are graduating with a flat understanding of the law Employing Dr Oliver Sacks's critique of medical education as a starting point, …

Addams's Internationalist Pacifism And The Rhetoric Of Maternalism, Marilyn Fischer Oct 2006

Addams's Internationalist Pacifism And The Rhetoric Of Maternalism, Marilyn Fischer

Philosophy Faculty Publications

Addams's pacifism grew out of her experiences working for social justice in Chicago's multi-national immigrant community. It rested on her well-tested conviction that justice and international comity could only be achieved through nonviolent means. While Addams at times used maternalist rhetoric, her pacifism was not based on a belief in woman's essential, pacifist nature. Instead, it was grounded on her understanding of democracy, social justice, and international peace as mutually defining concepts. For Addams, progress toward democracy, social justice, and peace involved both institutional reform and changes in moral, intellectual, and affective sensibilities.

A person's sensibilities grow out of his …

Modem Legal Reform In Egypt: Shifting Claims To Legal Authority, Shannon M. Roesler Oct 2006

Modem Legal Reform In Egypt: Shifting Claims To Legal Authority, Shannon M. Roesler

Cardozo Journal of International and Comparative Law

The article challenges the notion that Egyptian legal reform simply replaced Islamic law with European law, instead presenting it as a complex interplay where Islamic legal theory and European influences coexist. It highlights the dynamic process of integrating Islamic principles into the legal system, emphasizing the historical negotiation between fiqh (Islamic jurisprudence) and siyasa (state governance).

Medical Torture: End Of Life Decision-Making In The United Kingdom And United States, Jon D. Feldhammer Oct 2006

Medical Torture: End Of Life Decision-Making In The United Kingdom And United States, Jon D. Feldhammer

Cardozo Journal of International and Comparative Law

The note examines the legal and ethical challenges surrounding end-of-life medical decisions in the United States and the United Kingdom, highlighting the failure of both countries to effectively implement patients' end-of-life plans. It argues that the current legal frameworks in both nations often lead to prolonged, painful, and futile medical treatments, violating patient dignity and human rights. The analysis critiques the lack of consensus on medical futility and proposes a legislative model to balance patient autonomy, physician discretion, and ethical medical practice.

Simultaneous Application Of Entomopathogenic Nematodes And Predatory Mites To Control Western Flower Thrips Frankliniella Occidentalis, Lemma Ebssa, Christian Borgemeister, Hans Michael Poehling

All Peer-Reviewed Publications

Effects of entomopathogenic nematodes alone (Heterorhabditis bacteriophora Poinar or H. indica Poinar, Karunakar, and David), a predatory mite species alone [Amblyseius cucumeris (Oudemans) (Acarina: Phytoseiidae)], or the combination of nematodes and mites for the control of the western flower thrips Frankliniella occidentalis (Pergande) (Thysanoptera: Thripidae) was investigated in a climate controlled growth chamber and greenhouse. Different densities and concentrations of mites and nematodes, respectively, were tested at different densities of thrips infesting beans (Phaseolus vulgaris L.). In the growth chamber experiment, the presence of mites on the plants resulted in a large number of second-instar larvae of thrips to fall …

Latino Political Participation In Nebraska: The Challenge Of Enhancing Voter Mobilization And Representation - Ollas Report No. 3, Jonathan Benjamin-Alvarado

Latino/Latin American Studies Reports

This OLLAS policy brief seeks to enhance basic information regarding the role Latinos will play in shaping the future of politics in Nebraska in the short and medium term. Because issues such as immigration policy, fair housing, labor practices, and public education have risen to the top of the political agenda nationally and statewide, and because these issues most directly impact the lives of Nebraska’s growing Latino constituencies legitimately, we must consider to what extent Latino stakeholders can shape the debate and articulate acceptable policy responses to these matters.

How effectively these issues are dealt with will have major implications …

Assessment And The Fear Of Punishment: How The Protection Of Anonymity Positively Influenced The Design And Outcomes Of Postsecondary Assessment, Philip I. Kramer

Office of Academic Review and Curricular Advancement Staff Publications

This study examines how a state system of higher education, located in the Rocky Mountains area of the United States, allowed faculty members from the state’s public institutions of higher education to control the design and implementation of a pilot assessment of statewide general education courses. One of the primary reasons faculty were allowed to control the assessment process was to assuage the commonly held fear by faculty, academic departments, and institutions that they could be punished for the poor assessment results of their students who took the pilot assessment. An important conclusion of this study is that the promise …

The New York Times' Visual Art Criticism And Advertising (1970-2000), William A. Thorn Oct 2006

The New York Times' Visual Art Criticism And Advertising (1970-2000), William A. Thorn

Master's Theses (1922-2009) Access restricted to Marquette Campus

The goal of this study is furthering understanding of the relationship between advertising ·and visual art criticism. It must be noted, first, that measuring critiques for tone (positive and negative) is not in any way a judgment. A negative review, for instance, is neither good nor bad, merely negative. If a gallery exhibits a shoddily produced show of mediocre work, a negative review may be most appropriate. Simply put, since we are comparing New York Times visual art criticism only to itself (albeit across time), we require a standard for documenting change, movements, or trends in the New York Times …
