The Family Law Education Reform Project: Final Report, J. Herbie Difonzo, Mary E. O’Connell Jan 2006

The Family Law Education Reform Project: Final Report, J. Herbie Difonzo, Mary E. O’Connell

Hofstra Law Faculty Scholarship

The Family Law Education Reform Project (the FLER Project) was launched by a group of professionals who share a common concern. In their regular (for some, daily) interactions in the family court, they routinely observe lawyers who are woefully unprepared to make positive contributions on behalf of their clients. While some novice attorneys struggle valiantly and learn quickly, the quality of their initial preparation is, to use a term that surfaced often in FLER Project discussions, dismal. The question this group asked is “can we help the law schools to do this better?”

The Principles On Agreements: "Fairness" And International Human Rights Law, Barbara J. Stark Jan 2006

The Principles On Agreements: "Fairness" And International Human Rights Law, Barbara J. Stark

Hofstra Law Faculty Scholarship

Family law is again in turmoil, and the ALI Principles are an ambitious and sometimes inspired effort to increase clarity and fairness. This turmoil can be attributed to two major factors. First, family law is ground zero in the gender wars. Second, family law is reeling from the upheavals of globalization. These factors provide the backdrop against which the dilemmas addressed in Chapter 7, Agreements, play out.

Chapter 7 focuses on a particularly intriguing tension, between commercial contracts and premarital agreements. This tension is grounded in the broader tension between American views on freedom of contract and autonomy in general, …

Twenty-three items from the National College Health Risk Behavior Survey were used. For data analysis, students were placed into dichotomous categories for TV-viewing risk; dichotomous categories were also created for each DV. Chi-square tests examined relationships between demographic and risk-behavior correlates and Ss' self-reports of TV-viewing; subsequent analyses were run for Ss who were normal- and overweight/obese. Odds ratios with 95% CI were also computed. TV-viewing was related to decreased use of diet/exercise to control weight and an increased likelihood …

Landscapes Of Imagination: A Critical Analysis Of Art Textbooks, Lynda C. Kerr Jan 2006

Landscapes Of Imagination: A Critical Analysis Of Art Textbooks, Lynda C. Kerr

College of Graduate Studies: Theses & Dissertations

Author's abstract: This qualitative study examined imagination in secondary art textbooks, both historically and in the current educational climate. An arts-based inquiry, as described by Barone & Eisner (Jaeger, 1988), investigated how imagination is manifested in some art books, how the standards movement has tended to limit imagination in art textbooks, and how art textbooks could expand students' imaginations. Using a framework based on the theories of Dewey (1934/1980), Greene (2001), and Eisner (2002), four art textbooks were analyzed for their qualities which expand students' imaginations. The study described a design for an imaginative art textbook. Analysis focused on the …

Intergenerational Communication About African American Women's Health: The Sharing Of Health Messages Between Diabetic Mothers And Their Non-Diabetic Adult Daughters, Angela F. Cooke-Jackson

University of Kentucky Doctoral Dissertations

The prevalence of type II diabetes is high among African-American women but research that emphasizes black mothers and their adult daughters is rarely studied in social sciences or communication research. Though existing research addresses various domains of the mother-daughter relationship scant information addresses the significance of talk or the transmission of health information between African-American diabetic mothers and their non-diabetic adult daughters. For that reason, this dissertation investigates information sharing among a sample of African-American mothers with type II diabetes and their non-diabetic adult daughters. This study's two primary research objectives were to: 1. describe whether and how African-American type II …

Adoption Consents: Legal Incentives For Best Practices, Elizabeth Samuels Jan 2006

Adoption Consents: Legal Incentives For Best Practices, Elizabeth Samuels

All Faculty Scholarship

When a state places its legal imprimatur on the unmaking of one family and the making of another, the state should insure to the greatest extent possible that all the individuals involved have followed or have been afforded the best practices that ethics and humanity demand. The Uniform Adoption Act sets out commonly accepted goals of state adoption laws, among them the goals of protecting minor children against unnecessary separation from their birth parents and of ensuring that a decision by a birth parent to relinquish a minor child and consent to the childs adoption is informed and voluntary. With …

Governance And The Religion Question: Voluntaryism, Disestablishment, And America's Church-State Proposition, Carl H. Esbeck Jan 2006

Governance And The Religion Question: Voluntaryism, Disestablishment, And America's Church-State Proposition, Carl H. Esbeck

Faculty Publications

The quandary over how to structure the relationship between religion and the civil state is an ancient one. From the perspective of political philosophy this is the religion question, and events over many centuries have proven that the answer is easy to get wrong. Religion, by its very definition, is the fixed point from which all else is surveyed. It is about ultimate matters, both micro and macro. Hence, religion addresses the irreducible core of personhood and its meaning, while at the same time religion embraces a worldview that transcends and encompasses everything else. Religion generates intense emotions that when …

Evalutation Of Sediment-Sensitive Biological Metrics As Bio-Monitoring Tools On Varied Spatial Scales, Janna Yvonne Smithey Owens Jan 2006

Evalutation Of Sediment-Sensitive Biological Metrics As Bio-Monitoring Tools On Varied Spatial Scales, Janna Yvonne Smithey Owens

All ETDs from UAB

Sediment is one of the principal causes of water-quality impairment in surface waters of the United States. Although biological assessments are useful for characterizing the status of aquatic communities, reasons for impairment cannot be identified without quantifying associated variables physical variables that can be adequately related to bio-logical functions. Our objective was to explore potential relations between fish and ben-thic macroinvertebrate community structures and variables of sedimentation processes on a watershed and channel-reach scale. Biologic collections and habitat evaluations were conducted using the EPA’s Rapid Bioassessment Protocol over a period of three years (2000-2003) at sites in the upper Cahaba …

Increased Hexosamine Biosynthesis And Protein O-Glcnac Protect Isolated Rat Heart From Ischemia/Reperfusion Injury, Jia Liu Jan 2006

Increased Hexosamine Biosynthesis And Protein O-Glcnac Protect Isolated Rat Heart From Ischemia/Reperfusion Injury, Jia Liu

All ETDs from UAB

Increased levels of protein-associated O-linked N-acetylglucosamine (O-GlcNAc) have been correlated with increased tolerance to stress. Therefore the goal of this study was to determine whether enhanced flux through the hexosamine biosynthesis pathway (HBP), which leads to elevated levels of O-GlcNAc, increased the tolerance of the heart to ischemia and reperfusion (I/R). Hearts from male rats were isolated and perfused with Krebs-Henseliet buffer containing 5mM glucose, and global, no-flow ischemia was induced for 20min followed by 60 min reperfusion. 20 min pre-treatment with 10 mM glucosamine, which enters the HBP directly, significantly improved functional recovery and decreased cardiac Troponin I release …

Regulation Of Ss-Catenin By Gli1 In Epithelial Transformation, Xingnan Li Jan 2006

Regulation Of Ss-Catenin By Gli1 In Epithelial Transformation, Xingnan Li

All ETDs from UAB

Gli family members-mediated continuous Hedgehog (Hh) pathway activity plays a role in the growth of a number of human cancers, including the common malignancy of skin, basal cell carcinoma (BCC), and other highly aggressive tumor types. However, the mechanism by which Gli proteins act to promote the outgrowth of cancer in response to stimulation of Hh signaling is poorly understood. Identified as zinc finger transcriptional factors, the Gli family of proteins has been shown to be involved in multiple cellular processes through activating its target genes. Therefore, to study the function of Gli target genes is important for our understanding …

Klf4 Regulates Notch1 Expression And Signaling During Epithelial Transformation, Zhaoli Liu Jan 2006

Klf4 Regulates Notch1 Expression And Signaling During Epithelial Transformation, Zhaoli Liu

All ETDs from UAB

Notch1 and KLF4 function in the specification of epithelial cell fates, and each can act as a context-dependent oncogene or tumor suppressor. We report that KLF4 directly regulates transcription of Notch1 and that cleavage of full-length Notch1 to the active intracellular form, N1IC, is necessary for transformation by KLF4. Paradoxically, KLF4 suppresses canonical Notch1-CSL signaling by up-regulating Hairless, an antagonist of this pathway. Dominant-negative inhibitors of the canonical Notch1 signaling pathway do not block transformation of epithelial cells by KLF4, while they greatly reduce the efficiency of transformation by N1IC. Thus, N1IC can transform cells by two distinct mechanisms: the …
