Rethinking Prison Sex: Self -Expression And Safety, Brenda V. Smith Jan 2006

Rethinking Prison Sex: Self -Expression And Safety, Brenda V. Smith

Project on Addressing Prison Rape - Articles

This article analyzes legislation and policies that limit prisoners' sexual expression and autonomy. The article juxtaposes prisoners interest in sexual expression against the interests of the state in regulating sex by and between prisoners. The article concludes that the state has an interest in regulating sex between inmates and staff and in regulating coerced or forced sex between inmates. In other instances prisons could accommodate prisoners' interest in sexual expression and achieve important goals such as better decisionmaking; improved relations with family and partners to aid community reentry; reduction of prison rape; and inmate management.

Sexual Abuse Of Women In Prison: A Modern Corollary Of Slavery, Brenda V. Smith Jan 2006

Sexual Abuse Of Women In Prison: A Modern Corollary Of Slavery, Brenda V. Smith

Project on Addressing Prison Rape - Articles

This paper addresses the sexual abuse of women in custody as a more contemporary manifestation of slavery and discusses the congruencies and the differences that exist between the sexual abuse of women in custody and slavery. The paper charts the history of the parallel abolition and prison reform movements and examines their divergent paths arguing that the women's movement abandonment of prison advocacy has harmed the women in prison movement. The article concludes that the embrace of human rights norms has assisted in providing new avenues for redressing the sexual abuse of women in custody.

Analyzing Prison Sex: Reconciling Self Expression With Safety, Brenda V. Smith

Project on Addressing Prison Rape - Articles

This article examines the complexity of prison sex and the challenges that it raises in the context of recently enacted United States legislation, specifically the Prison Rape Elimination Act (PREA). It begins by identifying a range of prisoner interests in enhanced sexual expression. These interests are described below in an attempt to disentangle prisoners’ rights in sexual expression from states’ legitimate interests in regulating that expression. This article also directs policymakers and decision makers to mine international documents and human rights norms that recognize the necessity of punishment and at the same time outline a standard for the safety of …

Considering Tortious Racism, Camille Nelson Jan 2006

Considering Tortious Racism, Camille Nelson

Scholarly Articles in Law Reviews & Journals

INTRODUCTION The recent concurrence of Justice Ginsburg in Grutter v. Bollinger, and her dissent in Gratz v. Bollinger, cogently explore what W.E. DuBois termed problems of the "color line". The ongoing consequences of racism in America reveal a complicated racial caste stem, the medico-legal consequences of which merit exploration. Following in the footsteps of other great jurists, Justice Ginsburg situates the challenges facing persons of color in the context of American history and connects the racialized dots to recognize the ongoing effects of racism. Together with the majority opinion in Grutter, Justice Ginsburg acknowledges that race still matters in America. …

Postharvest Treatment To Control Codling Moth In Fresh Apples Using Water Assisted Radio Frequency Heating, Shaojin Wang, Sohan Birla, J. D. Hansen Jan 2006

Postharvest Treatment To Control Codling Moth In Fresh Apples Using Water Assisted Radio Frequency Heating, Shaojin Wang, Sohan Birla, J. D. Hansen

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Apples destined for export to Japan and South Korea are currently disinfested for codling moth, Cydia pomonella L. (Lepidoptera: Tortricidae), using methyl bromide fumigation. Restrictions and limitations imposed on the uses of methyl bromide have increased interest in developing alternative non-chemical quarantine treatments. It is imperative that the treatment is effective against codling moth yet maintains the quality of treated apples. The present study explored the application of radio frequency (RF) energy in conjunction with conventional hot water treatment to develop feasible heat treatments. Treatment parameters were selected based on minimum time–temperature conditions required for 100% mortality of fifth-instar codling …

Creative Commons And The New Intermediaries, Michael W. Carroll Jan 2006

Creative Commons And The New Intermediaries, Michael W. Carroll

Scholarly Articles in Law Reviews & Journals

This symposium contribution examines the disintermediating and reintermediating roles played by Creative Commons licenses on the Internet. Creative Commons licenses act as a disintermediating force because they enable end-to-end transactions in copyrighted works. The licenses have reintermediating force by enabling new services and new online communities to form around content licensed under a Creative Commons license. Intermediaries focused on the copyright dimension have begun to appear online as search engines, archives, libraries, publishers, community organizers, and educators. Moreover, the growth of machine-readable copyright licenses and the new intermediaries that they enable is part of a larger movement toward a Semantic …

Feasibility Study For Bicycle Safety: Data Assessment And Network Evaluation, Michael Seth Klobucar, Jon D. Fricker

JTRP Technical Reports

Bicycles offer a promising transportation alternative to private motor vehicles, especially in areas with congestion, poor air quality, and high fuel prices. This study sought rational methods for evaluating the benefits of incorporating bicycle-friendly features into highway project designs. Data on recent bicyclist fatalities and other collisions involving bicyclists in Indiana were analyzed to determine factors that could help to explain the incidents and offer insights into countermeasures or remedies. Human error – on the part of the bicyclist or the motorist – was found to be the most common factor. Poor lighting and noncompliance with sidewalk ordinances also were …

Effects Of Perceived Social Norms And Locus Of Control On Condom Use And High Risk Sexual Behaviors In Military Personnel, Anthony M. Kraemer

PCOM Psychology Dissertations

This study looked at the role of perceived social norms and internal versus external locus of control on high-risk sexual behaviors and condom use in a population of 333 U.S. Army soldiers from Combat and Non-Combat units of the Ist Cavalry Division, Fort Hood, Texas. This study showed that younger (17 -24 years of age) soldiers of lower rank (junior enlisted, E-l to E-5) displayed more misperceptions of what constitutes appropriate sexual behavior and condom use than their peers. It also showed that soldiers, in general, not only reported higher rates of high-risk sexual behavior themselves, but that internality or …

Integrative Therapeutic Approach Combining Cognitive Behavioral Therapy For The Treatment Of Recurrent Depression In An Adult Client , William J. Librizzi, Iii Jan 2006

Integrative Therapeutic Approach Combining Cognitive Behavioral Therapy For The Treatment Of Recurrent Depression In An Adult Client , William J. Librizzi, Iii

PCOM Psychology Dissertations

Major Depressive Disorder (MDD) is the most often diagnosed psychiatric illness worldwide, with prevalence rates indicating that as many as 25% of the population during their lifetimes will experience symptoms of MDD (Holmes, 1997). Therapies that focus on restructuring the client's cognitions have been shown to be effective in the treatment of this disorder. For some clients, however, reoccurring depressive episodes are common and symptom reduction is infrequent. The research of Worthington (1988) suggests that the highly religious client may actually see the world in a uniquely differently way than does the non-religious. These individuals utilize more religious schema and …

Lawyering For A Cause And Experiences From Abroad, Jayanth K. Krishnan Jan 2006

Lawyering For A Cause And Experiences From Abroad, Jayanth K. Krishnan

Articles by Maurer Faculty

For more than a decade, there has been a steady growth in what is now commonly referred to as the 'cause lawyering' literature. Partly as a response to those who were critical of the legal profession during the 1970s and 1980s, cause lawyering scholars have sought to rebut these critics' charges, as well as more comprehensively illustrate what, why, and how cause lawyers do what they do. While the critics of cause lawyers on the one hand, and cause lawyering scholars on the other, have made enormous contributions to the debate, only recently has the discourse shifted to examining an …

Economic Development At A Public University - A Process Model And Associated Metrics, Andres C. Salazar Jan 2006

Economic Development At A Public University - A Process Model And Associated Metrics, Andres C. Salazar

Electrical & Computer Engineering Faculty Publications

A university has long been considered an institution of higher learning with the immutable dual goals of research and teaching. A “public” university, however, has also had the founding principle of service, the performance of which is often linked to the region from which it receives public funds. Recently, this service component has morphed to playing an active role in regional economic development. This paper reviews the factors that have led to the situation in which a public university must define a relevant and significant set of objectives for itself in improving the economy of the community it serves. Further, …

Design and Planning Assistance Center - Projects

The goal of this process was to provide as much knowledge and insight as possible to the city of Portales with the intention that they would use this knowledge and this booklet as a tool to write an RFP that would get them the type of end product they want. While shifting from design issues to RFP issues it quickly became apparent that the RFP written for this project would need to be written better than what the current standard of RFP is in the state. This led me on a search for an RFP suited for this project. I …
