Let The Damages Fit The Wrong: An Immodest Proposal For Reforming Personal Injury Damages, Elaine W. Shoben

The modern legislative approach to tort reform has been a piecemeal process of altering single rules rather than reconsidering the fundamental principle of compensatory damages--the goal of making victims whole. When some aspect of damage doctrine has become disfavored, such as joint and several liability, legislatures and sometimes courts have made a change in that one rule. Lawmakers have focused little on the overall remedial scheme in tort and even less on the basic premise of compensatory damages and whether it is still justifiable.

Frontier Justice: Legal Aid And Unhcr Refugee Status Determination In Egypt, Michael Kagan

Where UNHCR conducts refugee status determination (RSD), its reactions to legal aid for asylum-seekers have been mixed. Statistical evidence collected from Egypt in 2002 indicates a correlation between receiving some form of legal aid service and an asylum-seeker's increased chances of gaining refugee protection from UNHCR. Unconventional forms of legal aid, including limited services by supervised non-lawyers (including volunteers from the refugee community) showed a positive impact on first instance cases, while traditional legal aid models showed an impact at the appeal stage. Legal aid should form an essential part of UNHCR's RSD procedures, and NGOs should work to expand …

Against Bipolar Black Masculinity: Intersectionality, Assimilation, Identity Performance, And Hierarchy, Frank Rudy Cooper

In this article, Professor Frank Rudy Cooper contends that popular representations of heterosexual black men are bipolar. Those images alternate between a Bad Black Man who is crime-prone and hypersexual and a Good Black Man who distances himself from blackness and associates with white norms. The threat of the Bad Black Man label provides heterosexual black men with an assimilationist incentive to perform our identities consistent with the Good Black Man image.

The reason for bipolar black masculinity is that it helps resolve the white mainstream's post-civil rights anxiety. That anxiety results from the conflict between the nation's relatively recent …

Dual class shares have been used by Canadian corporations to access public capital markets for the past sixty years. The debates surrounding the regulation of dual class shares have been reenergized. Energy issues have long been at the heart of human security concerns. At one level, we humans have always needed food energy and heat energy to survive and thrive. Yet, with the industrial revolution and our discoveries of the tremendous utility of fossils fuels like coal and oil, the security concerns related to human energy demands have expanded dramatically as our demand for energy accelerated rapidly. Offenders struggle with anger management not only before prison, but also while incarcerated (e.g., difficulty with prison adjustment, institutional behavioral problems). For these reasons, a number of correctional institutions offer anger management programming. However, the literature of these outcome studies within corrections is limited (Dowden, Blanchette, & Serin, 1999). This study is a program evaluation of psycho-educational anger management/substance abuse groups provided to male federal detainees at a privately owned detention facility in the northeastern United States. Antimicrobial Resistance In Non-Typhoidal Salmonella From Food Sources Colombia: Evidence For An Unusual Plasmid Located Class 1 Integron In Serotypes Typhimurium And Anatum, Ciara Walsh, Rebecca O'Mahoney, Teresa Quinn, Denise Drudy, Paul Whyte, Salim Matar, Seamus Fanning

Seventy-two isolates representing 18 serotypes recovered from various food samples collected in Colombia were tested for antimicrobial susceptibilities. The collection was further characterized for extended-spectrum cephalosporin, aminoglycoside, and tetracycline resistance markers. Multidrug resistant (MDR) isolates were further investigated for class 1 integrons and were evaluated for the presence of conjugative plasmids along with a determination of the incompatibility group by polymerase chain reaction (PCR). Antibiogram analysis showed that the incidence rate of ceftiofur resistance was moderately high (15%). A similar level of resistance to neomycin and oxytetracycline (11% and 10%, respectively) was also observed. There was a high prevalence of …

A deduction for treble damages paid for breach of the taxpayer's National Health Service Corps medical service obligation was erroneously denied under IRC 265(a)(1) in 'Stroud v. US', 906 F. Supp. 990 (1995). The provision does not apply because taxpayer's damages were not a cost of earning a tax-exempt scholarship which had been received many years earlier, but rather a deductible cost of buying out one employment obligation in order to earn taxable income in another. Objectification Or Liberation? Bisexual And Lesbian Women's Experiences With Physical Appearance, Amy Black

Using a multi-method qualitative design and analytic approaches derived from grounded theory, the current study examined the appearance standards within lesbian and bisexual communities and how these norms relate to lesbian and bisexual women's psychological experiences with physical appearance. The study investigated how the women's diverse social identities relate to these experiences. Participants consisted of a relatively diverse sample of 24 bisexual (n = 10) and lesbian (n = 14) women who took part in 1 of 4 focus groups. The Rhetorical War: Class, Race And Redemption In Spanish-American War Fiction. Stephen Crane, Frank Norris, Richard Harding Davis And Sutton Griggs, David Scott Kramer

One of the primary purposes and contributions of this study is to recover and discover a place in literary history for an under-examined genre: fiction of the Spanish-American War of 1898. While scholars have extensively described the general contours of Spanish-American War rhetoric, its literary representations have been largely overlooked. I argue that a close analysis of the fictions of Stephen Crane (1871-1900), Richard Harding Davis (1864-1916), Frank Norris (1870-1902) and Sutton Griggs (1872-1933) complicates our understanding of the Spanish-American War and the rhetoric it generated.
