Force Rules: Un Reform And Intervention, John C. Yoo

This Article has three parts. Part I will discuss the existing legal framework established by the UN Charter governing the use of force. It questions whether this structure has succeeded in regulating state practice, and describes both the proposed reforms and the new international environment that prompted them. Part II criticizes the reforms' response to the rise of rogue nations and international terrorism by emphasizing the legal doctrine of imminence and a recentralization of power in the UN Security Council. It argues that the concept of imminence does not make sense, and should be replaced by a cost-benefit analysis of …

This paper is divided into five sections. Section I provides a brief overview of the UN's historical experience in nation-building. Section II examines key UN inputs into nation-building operations, such as levels of military and police, duration, timing of elections, and economic assistance. Section III examines such outcomes as the ability to achieve peace and democracy. Section IV outlines key UN reforms to improve its ability to conduct nation-building missions. Section V concludes with implications for future UN missions.

This Development analyzes the extent to which the freedom to arbitrate using shariah is sustainable in light of international law. Part 1I provides background information about the OAA and shariah while Part III analyzes shariah within the context of international law, focusing on its conformance or lack thereof with relevant United Nations ("UN") promulgations. Part IV evaluates possible problems arising from the use of shariah and considers measures that may rectify these while benefiting Muslims and the broader community. Talking About Abortion: A Qualitative Examination Of Women's Abortion Experiences, Diana L. Dumais

The sociological literature on women's responses to the experience of abortion is remarkably sparse. This thesis seeks to contribute to redressing that research gap. I use semi-structured, in-depth interviews with twenty women from relatively diverse social backgrounds who have had abortions to explore the range of factors that they saw as being influential in their abortion decision and experience. Although the ages and the family circumstances of the women interviewed varied, and although some had more than one abortion, nevertheless, common themes emerged in their accounts of their abortion experiences. The Cape Wind proposal to build 130 turbines in Nantucket sound has been a central figure in development of renewable energy in New England. The aim of this study was two fold. First, the contingent valuation method was used to estimate an economic value the public has on policy for the preservation of Nantucket sound, within the scopes of the project. The second goal was to identify lessons that could be learned from the Cape Wind proposal and applied to future renewable energy projects in New England.

A series of studies was conducted on laboratory scale sand columns under varying operational and design conditions with spiked concentrations of E. coli to investigate the role of the schmutzdecke, a biologically active layer that develops at the interface of the water and filter in slow sand filtration (SSF) and riverbank filtration (RBF). Results confirmed that E. coli removals in slow-rate biological filters occur primarily at the interface and are related to schmutzdecke ripening state, empty bed contact time, biological activity, temperature, and protistan abundance. Polychlorinated biphenyls (PCBs) are one of the most persistent and toxic pollutants in our environment today. Many rivers and lakes were heavily polluted with PCBs during the 1970s when their use and production was at their highest demand. Today, more than 30 years after they have been banned from production they continue to be one of the top priority contaminants. Their characteristic stability has made them very recalcitrant to physical, chemical and biological degradation. Remediation in soils and sediments are particularly more difficult due to the variability in the soil and sediment characteristics that affect how strongly PCBs are sorbed. …

The goal of this thesis was to suggest ways of evaluating the health of police cruisers without bringing these cruisers into a repair facility. The prototype in-car application was developed. The hardware connection was made between the in-car network and the Project54 network. The software was built to collect, process, and send the vehicle information to the server via a telecommunication tool. The prototype in-car application was tested in simulation and on the road. Thirty multiparous early lactation Holstein cows were used in a randomized complete block design to determine whether the addition of VERTAN (a specific blend of essential oils, major components: thymol, eugenol, vanillin and limonene) to corn silage based diet would increase alter protein metabolism in the rumen and increase milk yield and alter milk composition. Dietary treatments were 0 (control) and 0.08% VERTAN in diet DM. The pretreatment diet (fed 0 to 20 DIM) contained (DM basis) 32.1% corn silage, 14% grass silage, 7.7% alfalfa hay, 0.53% grass hay, 19.4% finely-ground corn, 1.8% beet pulp, 1.8% citrus pulp, 3.6% soybean …

This study examined the relationships that exist between psychological skills and confidence. Analysis of the relationship took place with ice hockey, lacrosse and soccer goalkeepers. Participants (N = 1927) completed measures of psychological skills (ACSI-28) and confidence (CSCI) online. Participants deemed psychological skills as important, but rarely used them to enhance performance. Goalkeepers (N = 412) scored higher on both the personal coping resource score (M = 50.82, SD = 9.24) and confidence (M = 41.88, SD = 5.66) than non-goalkeepers on the personal coping resource score (M = 47.48, SD = 9.60) and confidence (M = 41.84, SD = …

Diabetes mellitus accelerates atherogenesis, but the exact mechanisms involved are unknown. This study examined the effects of hyperglycemia on the inflammatory transcription factor peroxisome proliferator activated receptor gamma (PPARgamma), known to be involved in atherogenesis, and the ATP binding cassette A1 (ABCA1) protein that is a downstream product of PPARgamma. ABCA1 is a membrane bound transporter that is involved in reverse cholesterol transport via high density lipoprotein cholesterol (HDL-C). To study dynamic in vivo biochemical changes within the corpus luteum (CL) during luteolysis, a physiological model mimicking the onset of natural luteolysis was established, in which sheep received sequential systemic pulses of PGF2alpha (20ug/min/lhr) at mid-luteal phase of the estrous cycle. We previously demonstrated that after one pulse of PGF2alpha, the protein levels of extracellular matrix (ECM) regulators, tissue inhibitors of metalloproteinases (TIMPs) -1 and -2 decreased dramatically within one hour of PGF2alpha infusion, while matrix metalloproteinase (MMP)-2 activity increased 4 hrs post infusion. Wisely using byproduct materials in beneficial use applications such as highway construction is becoming more important in the United States as virgin materials are depleted and landfill capacity declines. Slags are byproducts of the steel and iron industries found in the Midwestern United States. Historically, many of these materials have historically been used in construction applications, but methods for characterizing their environmental risk are limited. The purpose of this study was to further our understanding of how the leisure occupations of mothers are influenced by having a child with significant developmental disabilities. Qualitative research methods specifically, a phenomenological approach was used to develop an understanding of how the mothers of children with developmental disabilities engage in leisure activities and the feelings and meanings they attach to leisure participation. Data were collected through in-depth interviews with mothers who shared their experiences regarding their leisure activities. As of now, the beneficial-use (recycling) of secondary materials (e.g. coal-fly ash) in highway construction is limited. In 1998 and 1999, the Association of State and Territorial Solid Waste Management Officials (ASTSWMO) conducted a Beneficial-Use Survey to determine the issues that states face when evaluating potential beneficial-use applications for recycled/secondary materials. The report identified the largest obstacle as the lack of good information for use in evaluating potential risks to human health and the environment (i.e. soil and groundwater contamination) from beneficial-use applications. Strategies to conserve vernal pool-dependent amphibians emphasize the maintenance of adequate areas (buffers) of terrestrial habitat surrounding the pool. I conducted a large-scale field study that specifically examined the effects of buffer width manipulation on adult and metamorph wood frogs at eleven vernal pools in a managed forest in central Maine. Buffer width treatments were 30 m or 100 m forest buffer surrounded by a 100 m clearcut, or no cut (reference). I encircled pools with drift fences and monitored wood frogs from April--November, 2004 and 2005 using pitfall traps and radio-telemetry. Buffer width had no effect on the number …

Many countries, especially industrialized countries, are facing a crisis in municipal solid waste (MSW) problems due to its ever increasing amount and related problems such as limited dumping space, transboundary waste movement, financial pressures, and dioxin problems. Insurance reimbursement guidelines have changed the way allied health services are delivered. The onset of the Prospective Payment System (PPS) reorganized financing for therapy services. Instead of basing reimbursement on each individual case, finances are based on diagnostic and case mix groupings and regulate expected service needs. This has forced both occupational and physical therapy to vie for the same reimbursement monies.

As socializers, parents provide and interpret experiences which ultimately influence achievement beliefs and behaviors in their children. Eccles' Expectancy-Value model (Eccles & Harold, 1991), the model of parental influences on motivation and achievement (Eccles et. al., 1998) and Achievement Goal Theory (Nicholls, 1989) provide the theoretical framework for this study. The investigation explored the relationships between athlete goal orientations, perceptions of parental self-handicapping, perceptions of parental goal orientations and athlete tendency to employ self-handicapping. Sediments contaminated with dioxins/furans and polychlorinated naphthalenes (PCNs) have been the subject of little study although they are equal, if not more significant, contributors than PCBs to toxicity at selected sites. The reaction of a bimetal catalyst, palladized magnesium (Mg/Pd, 0.01% by weight Pd) with these contaminants was studied in solvents and sediments.
The reaction for single congeners in solvent resulted in 69-95% removal in 30 minutes. The detection of dibenzo-p-dioxin for the dioxin reaction and naphthalene/tetralin for the PCN reaction demonstrated dechlorination. A 24 hour sediment reaction with Mg/Pd resulted in 48% and 71% reduction for spiked sediments (500 …
