The Corporate Lawyer And 'The Perjury Trilemma', Thomas D. Morgan Jan 2006

The Corporate Lawyer And 'The Perjury Trilemma', Thomas D. Morgan

Hofstra Law Review

This paper extends Monroe Freedman's idea of the criminal lawyer's "perjury trilemma" to current issues faced by corporate lawyers dealing with perceived pressures on the attorney-client privilege. The duties of criminal defense and corporate lawyers are more similar than they often seem. Corporate lawyers' duties of honesty in dealing with third parties are closely analogous to criminal lawyers' duties of honesty in dealing with a court. Both sets of lawyers also have an important interest in fostering open communications with their clients. Where their situations differ is not with respect to lawyer obligations but with respect to their clients' rights. …

The Supreme Court Will Not Overrule Roe V. Wade, Robert A. Sedler Jan 2006

The Supreme Court Will Not Overrule Roe V. Wade, Robert A. Sedler

Hofstra Law Review

In this Idea, Professor Sedler, who litigated the Kentucky version of Roe v. Wade for the ACLU of Kentucky while on the faculty of the University of Kentucky, gives his opinion as to why the Supreme Court will not overrule Roe v. Wade. The Idea is based on an op-ed that ProfessorSedler published in the Detroit Free Press in connection with the nomination of Chief Justice John Roberts to the Supreme Court.

Professor Sedler maintains that the Court is not likely to overrule Roe v. Wade for two related reasons. The first reason goes to the operation of the Court …

Expedited Removal: Suggestions For Reform In Light Of The United States Commission On International Religious Freedom Report And The Real Id Act, Simona Agnolucci

UC Law Journal

Undocumented persons enter the United States every day. Even though many of them seek asylum, under a law passed by Congress in 1996, ninety-nine percent of undocumented persons are returned to their home countries through "Expedited Removal." Those who enter the United States are detained, often under horrible conditions and sometimes for years. When they finally appear before an immigration judge, many are denied entry because of alleged inconsistencies between their testimony before the judge and statements they originally made at the point of entry, even though their testimony and prior statements are often consistent.

This Note examines the practice …

Waste Discharge Requirements: Beyond The Point Source, Hastings Law Journal

UC Law Journal

Recent amendments to the Porter-Cologne Water Quality Act withdraw the general waiver for agricultural discharge. Discharges from agricultural lands include irrigation return flow, flows from tile drains, and storm water runoff. Historically, most regional boards regulated these discharges, but recent legislation now requires regional boards to review and renew their waivers or replace them with waste discharge requirements. This Panel of experts discussed the impact of these modified waiver requirements as well as their appropriateness and efficacy in ameliorating waste discharge issues.

Between A Rock And A Hard Place: The Legacy Of Castle Rock V. Gonzales, Lynn A. Combs Jan 2006

Between A Rock And A Hard Place: The Legacy Of Castle Rock V. Gonzales, Lynn A. Combs

UC Law Journal

Despite systemic reforms during the late twentieth century, domestic violence victims still face a troubling threat from their abusers. Town of Castle Rock v. Gonzales, which holds that there is no constitutional right guaranteeing that police will enforce restraining orders, highlights a disjunction between the legal reality, which is rooted in law enforcement's discretion, and the social reality, where intimate partners are perpetrating acts of violence because restraining orders afford victims little protection. According to Castle Rock, even statutes that seemingly mandate abuser arrests may still allow police officers significant discretion to determine how, when, and if they need to …

Choosing Tribal Law: Why State Choice-Of-Law Principles Should Apply To Disputes With Tribal Contacts, Katherine J. Florey

American University Law Review

The Supreme Court has, in recent years, developed a detailed set of rules governing whether cases with tribal contacts should be heard in a state or tribal forum. It is therefore all the more remarkable that courts considering such cases have devoted almost no attention to the question of which law should apply once a forum has been chosen. Instead, courts have broadly assumed, without explicit consideration of the issue, that the forum in which the case is brought will apply its own law. Where state courts are concerned, two problems exist with this approach. First, the assumption that state …
