Just Until Payday, Ronald Mann, James Hawkins Aug 2006

Just Until Payday, Ronald Mann, James Hawkins

ExpressO

Abstract The growth of payday lending markets during the last 15 years has been the focus of substantial regulatory attention both here and abroad, producing a dizzying array of initiatives by federal and state policymakers. Those initiatives have conflicting purposes – some seek to remove barriers to entry and others seek to impose limits on the business. As is often the case in banking markets, the resulting patchwork of federal and state laws poses a problem when one state is able to dictate the practices of a national industry. For most of this industry’s life, just that has happened – …

Why Justice Scalia Should Be A Constitutional Comparativst . . . Sometimes, David C. Gray Aug 2006

Why Justice Scalia Should Be A Constitutional Comparativst . . . Sometimes, David C. Gray

ExpressO

The burgeoning literature on transjudicialism and constitutional comparativism generally reaffirms the familiar lines of contest between textualists and those more inclined to read the Constitution as a living document. As a consequence, it tends to be politicized, if not polemic. This essay begins to shift the debate toward a more rigorous focus on first principles. In particular, it argues that full faith to the basic commitments of originalism, as advanced in Justice Scalia’s writings, opinions, and speeches, requires domestic courts to consult contemporary foreign sources when interpreting universalist language found in the Constitution. While the essay does not propose a …

The Role Of The History Of Mathematics In Middle School., Mary Donette Carter Aug 2006

The Role Of The History Of Mathematics In Middle School., Mary Donette Carter

Electronic Theses and Dissertations

It is the author's belief that middle school mathematics is greatly taught in isolation with little or no mention of its origin. Teaching mathematics from a historical perspective will lead to greater understanding, student inspiration, motivation, excitement, varying levels of learning, and appreciation for this subject. This thesis will develop four units that will incorporate original source documents and selected historical topics surrounding computation, numbers, and early calculating devices. Many of the units will center on the Rhind Papyrus and The Treviso Arithmetic. These units will be appropriate to middle school, with an emphasis on 6th grade.

Selection Of Dwarf Mistletoe–Infected Ponderosa Pines By Ips Species (Coleoptera, Scolytidae) In Northern Arizona, Shawn C. Kenaley, Robert L. Mathiasen, Carolyn M. Daugherty Aug 2006

Selection Of Dwarf Mistletoe–Infected Ponderosa Pines By Ips Species (Coleoptera, Scolytidae) In Northern Arizona, Shawn C. Kenaley, Robert L. Mathiasen, Carolyn M. Daugherty

Western North American Naturalist

Following an Ips bark beetle outbreak in 2002, mortality of ponderosa pine (Pinus ponderosa Douglas ex C. Lawson) was evaluated in 2 study areas infested with southwestern dwarf mistletoe (Arceuthobium vaginatum [Willd.] Presl subsp. cryptopodum [Engelm.] Hawksw. & Wiens) in the Coconino and Tonto National Forests, Arizona. A pairwise comparison of dwarf mistletoe ratings for live and dead ponderosa pines was conducted to determine whether dead ponderosa pines had higher dwarf mistletoe ratings than pines that were not attacked. In both study areas, dead ponderosa pines had significantly higher dwarf mistletoe ratings, indicating an association between the severity …

Deforestation And Land-Use Change In Veracruz, Mexico: A Remote Sensing Analysis, Mark Dalrymple

LSU New Orleans Theses and Dissertations

The purpose of this study was to analyze deforestation using multi spectral satellite imagery in a region of Veracruz and Puebla Mexico. A smaller study area in a subtropical region in Veracruz was used to relate changes in forest cover to changes in land-uses within the smaller region. A land-use classification was created for this study that includes fallow/barren, subsistence agriculture, sugar cane, urban/settlement, grazing lands and other vegetation. A change detection was performed to analyze the extent of each land-use encroaching into forests between 1979 and 2002. Another objective of the study is to examine the seasonal variation of …

Renegotiating Democracy In Public Space, Anna Brand Aug 2006

Renegotiating Democracy In Public Space, Anna Brand

LSU New Orleans Theses and Dissertations

Dissent is intricately linked to the qualities of public space. While the First Amendment protects dissent, historical legal and social mechanisms have regulated protest and its relationship with public space. In the latter half of the twentieth century, a rigorous legal framework has emerged to both protect and regulate protest. Yet free speech rights are highly contested. The media are complicit in relating protesters to violence. This perception has been thoroughly constructed in the media since the World Trade Organization protests in Seattle in 1999. The September 11th terrorist attacks have further amplified concerns for security in public spaces. The …

Resilience And Resistance: Public Narratives From Post-Katrina New Orleans, Heather Price Aug 2006

Resilience And Resistance: Public Narratives From Post-Katrina New Orleans, Heather Price

LSU New Orleans Theses and Dissertations

Narratives of resilience and resistance are applied by public editors in post-Katrina New Orleans in hopes of reordering the city's ruptured narrative. Using qualitative methods and grounded theory, the textual analysis of local newspaper editorials and letters to the editor, collected from the six month period between August 29, 2005 and February 28, 2006, have revealed categories of hope and struggle in acts of collective reaffirmation; of civility and leadership in expectations of personal transformation; and of self-reliance and civic engagement in acts of resistance. Discussion will focus on how editorialists work to create public narratives that will unite their …

Looting, Law, And Lawlessness, Stuart Green Aug 2006

Looting, Law, And Lawlessness, Stuart Green

ExpressO

As recent incidents in the wake of Hurricane Katrina and other natural and man-made disasters have illustrated, the moral content of looting spans an extraordinarily wide continuum: At one end are predatory and exploitative acts that seem deserving of even greater punishment than ordinary acts of burglary and larceny. At the other end are cases of necessity, involving otherwise law-abiding citizens who, as a result of forces beyond their control, find themselves hungry and exposed to the elements. In between these two poles lies a wide range of conduct that often involves impoverished and alienated citizens living on the edges …

No Child Left Behind: The Impact On Special Education Teachers At The Secondary Level, Stacey E. Gofberg Aug 2006

No Child Left Behind: The Impact On Special Education Teachers At The Secondary Level, Stacey E. Gofberg

Theses and Dissertations

The purpose of this qualitative investigation was to explore how the implementation of the No Child Left Behind Act of 2001 (NCLB) has impacted special education teachers at the secondary level. Two research strategies were used for this study. First, surveys were given to eleven special education teachers at a southern New Jersey high school. Then, a veteran teacher and a novice teacher at the high school were interviewed. It was found that participants generally endorsed the overarching goals of NCLB, but they did not believe that all of the requirements were realistic for students with disabilities. Based on these …

Bahamian Cave And Karst Geodatabase, And Gis Analysis Of San Salvador Island, Bahamas, Adam Dennis Walker

Theses and Dissertations

A geodatabase and a data management program have been created to store and manipulate cave and karst feature data from the Bahamas. A geographic information system was used to recognize any spatial patterns in the cave and karst data from San Salvador Island. Elevation data for banana holes, vadose pits and flank margin caves were obtained from a digital elevation model and are consistent with values predicted by the Carbonate Island Karst Model. The slope and aspect of the hill on which a flank margin cave is found showed no relationship to cave sizes and shapes, emphasizing the hypogenic nature …

Jobs-Housing Balance & Individual Spatial Choices: A Case Study Of Saturn Workers In Spring Hill, Tennessee, Jonathan Del Bosco Aug 2006

Jobs-Housing Balance & Individual Spatial Choices: A Case Study Of Saturn Workers In Spring Hill, Tennessee, Jonathan Del Bosco

Theses and Dissertations

This study examines the jobs-housing balance and the excess commute of Saturn employees in Spring Hill. Until recently, the number of jobs has greatly exceeded the number of houses. In 2005 the balance is about even, however many newer residents are believed to be people who work in Nashville. Many Saturn employees live on the outskirts of Spring Hill and must commute longer distances to work. A spatial analysis using GIS of employee home locations shows that 74% of employees commute is in excess compared to if employees actually lived within Spring Hill. Surveys of Saturn employees shows traffic en …

Critical Leadership Traits And Characteristics Of Rural Mississippi Community College Presidents For The 21st Century, Jan Reid-Bunch Aug 2006

Critical Leadership Traits And Characteristics Of Rural Mississippi Community College Presidents For The 21st Century, Jan Reid-Bunch

Theses and Dissertations

The development of effective and well prepared leaders is vital to the continued success of community colleges and their students. The community college movement boomed in the 1960s and 1970s, and it is now faced with massive numbers of retirements across the nation. Throughout its history, the American Association of Community Colleges (AACC) has made leadership development a priority and a central portion of its mission. Leadership roles are changing in the 21st century in America?s community colleges; therefore, we must reflect on our past to assist in directing our future. According to Young and Ewing (1978), a vast majority …

Thinking Outside The Border: Homeland Security And The Forward Deployment Of The U.S. Border, Gregory W. Bowman Aug 2006

Thinking Outside The Border: Homeland Security And The Forward Deployment Of The U.S. Border, Gregory W. Bowman

ExpressO

Following the September 11, 2001, terrorist attacks, the U.S. government implemented a number of inbound cargo security programs it described as “pushing the border outward” or “expanding [the U.S.] perimeter of security.” Are these statements rhetorical flourish, or do these programs materially affect international cargo trade? This article argues that far from being mundane or rhetorical, these cargo security programs are transforming how U.S. borders operate from both a conceptual and practical perspective. Specifically, by moving certain aspects of border functionality to locations well-removed from the physical U.S. border, these programs make U.S. regulation of inbound trade significantly more extraterritorial. …
