Non-Governmental Organizations And The International Criminal Court: Changing Landscapes Of International Law, Zoe Pearson
Non-Governmental Organizations And The International Criminal Court: Changing Landscapes Of International Law, Zoe Pearson
Cornell International Law Journal
An exploration of claims that non-governmental organizations (NGOs) influence the formation of international law focuses on NGO participation in the multilateral negotiations to form the International Criminal Court. It is shown that, although NGO's can contribute to international lawmaking processes, their participation remains ad hoc, contingent, & characterized by conflicting viewpoints. However, existing international lawmaking is attempting to accommodate the diversity of global civil society actors even though deeply entrenched traditional constructions of international law tend to limit their involvement. Servant-Leadership And Vulnerability: A Brief Interview With Bill Robinson, Bill Robinson
Servant-Leadership And Vulnerability: A Brief Interview With Bill Robinson, Bill Robinson
International Journal of Servant-Leadership
1. Greenleaf refers to love as essential to both the servant and the leader in generating legitimate power in the self, the organization, the community, and the world. Emerson furthers this point when he proposed the following: mediocre people want to be loved; true people are lovely. How does love influence your own leadership and your way offollowing others? I think I'm probably influenced by some kind of twisted, quid pro quo love, but I don't find the agape version showing up too often. When my oldest daughter was a senior in high school, she hung out with a friend …

Regulating The Business Of Insurance: Federalism In An Age Of Difficult Risk, Robert H. Jerry Ii, Steven E. Roberts
Regulating The Business Of Insurance: Federalism In An Age Of Difficult Risk, Robert H. Jerry Ii, Steven E. Roberts
Faculty Publications
Natural disasters and terrorism events of a massive scale are "difficult risks." They are difficult (or, if large enough, impossible) to insure, and they present enormous risk-management challenges. Indeed, we are now in an era when difficult risks are the dominant feature of the risk-management landscape. These kinds of risks are inevitably multi-jurisdictional in nature, and managing them effectively requires a cohesive, comprehensive national catastrophe policy involving ex ante prevention and mitigation measures, effective risk allocation through insurance mechanisms, and ex post victim-compensation strategies. Although our nation is not yet close to establishing a much-needed and increasingly discussed national catastrophe …

Gis-Based Analysis Of Ice-Breeding Seal Strandings In The Gulf Of Maine, David Harris Ph.D., Sat Gupta
Gis-Based Analysis Of Ice-Breeding Seal Strandings In The Gulf Of Maine, David Harris Ph.D., Sat Gupta
Faculty Publications
Phoca groenlandica (harp seals) and Cystophora cristata (hooded seals), two species of ice-breeding seals, are being sighted more frequently onshore in the Gulf of Maine since 1990, but little is known about their behavior in this ecosystem. We obtained records of 904 ice-breeding seal stranding locations in the Gulf of Maine between 1996 and 2002 from NOAA Fisheries and used a geographic information system (GIS) to conduct group-wise comparisons by species (using non-parametric techniques), and to determine the predictors of high seal-stranding density (using ordinal logistic regression analysis). Compared to harp seals, hooded seals stranded closer to deep water, farther …

Print Media Distribution: Process, Profitability, And Challenges, Twyla Cummings, Bernice Lemaire, Maria Cummings
Print Media Distribution: Process, Profitability, And Challenges, Twyla Cummings, Bernice Lemaire, Maria Cummings
Books
Today the distribution of printed media is viewed as a value added or ancillary service. Ancillary services have been identified as a key printing industry growth opportunity in a recent PIA/GATF report (Davis & Gleeson, 2005). Distribution is a customer service offering that starts when the job is scheduled. Efficient distribution involves the use of market expertise to negotiate freight rate and logistics services, routing, and overall compilation or management and organization of products and distribution. Other aspects of distribution include warehousing, shipping, inventory management, fulfillment and kit packing. The objectives for Phase Two of this research project were to: …
Regulating Information Flows: States, Private Actors And E-Commerce, Henry Farrell
Regulating Information Flows: States, Private Actors And E-Commerce, Henry Farrell
Comparative Research in Law & Political Economy
Growing interdependence between jurisdictions means that states are increasingly using private actors as proxies, in order to achieve desired regulatory outcomes. International relations theory has had difficulty in understanding the exact circumstances under which they might wish to do this. Drawing on existing literatures in both international relations and legal scholarship, this article proposes a framework for understanding the circumstances under which states will or will not use private actors as proxy regulators. This framework highlights the relationship between state preferences and the presence or absence of "points of control," a special kind of private actor. The article then conducts …

Champions Of Change: Reinventing Democracy Through Land Law Reform, John R. Nolon
Elisabeth Haub School of Law Faculty Publications
This Article explores the prospects of achieving policy coherence in the field of land use regulation. It explains how, as municipal governments react to pressures and crises at the local level, they discover and adopt new strategies in a constant process of experimentation. Through a properly constructed legal framework, critical information can be relayed from local to higher levels of government, state and federal legislators and judges can respond, and a "system" of law can evolve. Using theories developed in the fields of systems analysis and diffusion of innovations, the Article describes the process by which local communities perceive land …
An Examination Of The Service-Learning Program At A Comprehensive University Through The Lenses Of Program Theory And Institutional Theory, Cathy Duff
Electronic Theses and Dissertations
Case study design, employing qualitative research methods, was used to document and examine a mandatory service-learning program at a new, comprehensive, public university. The study examined service-learning from multiple perspectives. Institutional theory provided a framework for examining the influence of the environment on the conceptualization, adoption, and implementation of service-learning. Program theory was used to identify and analyze the program's conceptual underpinnings, including goals and objectives, intended outcomes for students, and program processes. Knowledge of how a program is supposed to work is useful for developing assessment questions, evaluating institutional effectiveness, and improving program performance. The study included a review …

Nutrient Loads In An Urban Ozark Watershed: Jordan, Fassnight And Upper Wilson's Creeks, Springfield, Missouri, Ronald B. Miller
Graduate Theses/Dissertations
The study watershed includes Jordan Creek, the primary stream draining the central downtown area of Springfield, Missouri, and also Fassnight and upper Wilson Creeks. Ten sample sites were established within the watershed and water samples and were collected during baseflow and storm runoff events between August 1, 2004 and July 31, 2005. Samples were tested for total nitrogen (TN), total phosphorus (TP) and selected heavy metals (zinc, arsenic, lead, copper and cadmium) and the parameters pH, specific conductance, turbidity, temperature and dissolved oxygen. Rating curves were used to correlate discharge and water quality variables. Separate rating curves were developed for …

Redevelopment And The Four Dimensions Of Class In Land Use, Audrey Mcfarlane
Redevelopment And The Four Dimensions Of Class In Land Use, Audrey Mcfarlane
All Faculty Scholarship
This essay begins with the proposition that the battle over the exercise of eminent domain as a question of the extent to which we accept local economic development as a proper exercise of local governmental authority. In light of the reality that economic development seeks to accomplish redevelopment to meet the social needs and consumption tastes of the affluent, the issue of local governments' autonomy to engage in redevelopment for economic development purposes is suffused with socioeconomic class struggles over land use. Therefore, the changes wrought by redevelopment challenge us to think and talk about class in ways for which …
The New Inner-City: Class Transformation, Concentrated Affluence And The Obligations Of The Police Power, Audrey Mcfarlane
The New Inner-City: Class Transformation, Concentrated Affluence And The Obligations Of The Police Power, Audrey Mcfarlane
All Faculty Scholarship
This article examines the role of local government in the process of urban spatial restructuring (gentrification). In light of the disparate needs and competing interests of different racial and socioeconomic groups seeking a place in the city, there are limits to local government's ability to facilitate redevelopment projects that deliberately aim to accomplish class transformation and exclusively reconfigure the inner city for the affluent. These limits exist by virtue of implied obligations of the police power.
