Common Law Property Metaphors On The Internet: The Real Problem With The Doctrine Of Cybertrespass, Shyamkrishna Balganesh Oct 2006

Common Law Property Metaphors On The Internet: The Real Problem With The Doctrine Of Cybertrespass, Shyamkrishna Balganesh

Michigan Telecommunications & Technology Law Review

The doctrine of cybertrespass represents one of the most recent attempts by courts to apply concepts and principles from the real world to the virtual world of the Internet. A creation of state common law, the doctrine essentially involved extending the tort of trespass to chattels to the electronic world. Consequently, unauthorized electronic interferences are deemed trespassory intrusions and rendered actionable. The present paper aims to undertake a conceptual study of the evolution of the doctrine, examining the doctrinal modifications courts were required to make to mould the doctrine to meet the specificities of cyberspace. It then uses cybertrespass to …

The Rape Investigator's Handbook, Julie Kazimer Oct 2006

The Rape Investigator's Handbook, Julie Kazimer

Regis University Student Publications (comprehensive collection)

The handbook should be used as a resource for assistance during investigations of sexual assault. The handbook is structured chronologically by the 'standard' timeline of procedures associated with a rape investigation after receiving the initial report. As no two reports are alike, the handbook should be used as guideline to what might occur at the time of report. The handbook is further divided by the role of the user. For example, one section deals strictly with the response of the first responder on scene, another handles the issues, and investigational aspects of the lead investigator. It is suggested that all …

Review Of Henry S. Turner, The English Renaissance Stage: Geometry, Poetics, And The Practical Spatial Arts, 1580–1630, Elizabeth Spiller Oct 2006

Review Of Henry S. Turner, The English Renaissance Stage: Geometry, Poetics, And The Practical Spatial Arts, 1580–1630, Elizabeth Spiller

Department of English: Faculty Publications

In The English Renaissance Stage: Geometry, Poetics, and the Practical Spatial Arts, Henry Turner argues that English stage practice emerged out of practical geometry and related mechanical arts. The book is part of a new critical attention to the interconnections between literature and science, one that depends on the recognition that art involved the creation not just of aesthetic objects but also of knowledge itself. Stage practice drew from geometry to develop the concepts of plat-plot and to define its use of scenes as both spatial divisions and dramatic structures. Drama also provided audiences with forms of practical knowledge …

Simple Way For A Successful Path, Km. Nadeera Oct 2006

Simple Way For A Successful Path, Km. Nadeera

Academic Leadership: The Online Journal (2003-2012)

Education is the basic path to create a complete person improving high thinking and analytical skills for solving problems. Certain defects of the science education would be observed in developing countries minimizing the nations’ strength towards the better development. Quality of the science education is the common fact to be considered in developing countries. Most of the developing countries are following western educational systems which are unsuitable for man’s strength in developing countries as a result of the colonization. Portrait Of Professor Breidenbaugh, Melissa A. Heckel Oct 2006

Portrait Of Professor Breidenbaugh, Melissa A. Heckel

Hidden in Plain Sight Projects

People often do not see what is right in front of them; objects that are passed by everyday are often unnoticed. People are not necessarily unobservant, but are probably more absorbed with their own activities. One object that is hidden in plain sight on the Gettysburg College campus is the portrait of Professor Edward S. Breidenbaugh that hangs in the Science Center. The name Breidenbaugh is commonly known amongst the students at Gettysburg because of the building in his name, Breidenbaugh Hall. However, the history behind Breidenbaugh and his portrait is not as commonly known as the name, but is …

Plaque In Christ Chapel, Amanda C. Caligiuri

Hidden in Plain Sight Projects

We see them every day and pass them as we rush to class. Painting, monuments, and even old photographs that remind us of Gettysburg’s past. They have become so commonplace that we hardly spare a second glance for them so that they start to fade into the general scenery, eventually losing their meaning and with that, the rich history that they denote. What if one could turn back the clock and return to the beginning of freshman year when every sign and monument was new, worth our attention and more importantly, our curiosity? Although Gettysburg College is well steeped in …

Intellectual Property Rights In Advertising, Lisa P. Ramsey Oct 2006

Intellectual Property Rights In Advertising, Lisa P. Ramsey

Michigan Telecommunications & Technology Law Review

Before the twentieth century, U.S. courts refused to protect copyright in advertisements. Until the middle of the twentieth century, advertising slogans generally were not registered or protected under U.S. trademark law. Today, firms can acquire copyright protection in advertising and there is no categorical rule against trademark registration or protection of slogans. This Article questions whether this extension of copyright protection to advertising and trademark protection to slogans has a satisfactory utilitarian justification[...] If it is too difficult to completely eliminate copyright protection of advertising, Congress should at least consider reducing such protection to increase the free flow of advertising …

Faces Of Social Work In South Africa: A Twenty:First Century Perspective, Dorothy L. Graff Oct 2006

Faces Of Social Work In South Africa: A Twenty:First Century Perspective, Dorothy L. Graff

African Social Science Review

This qualitative mini-ethnographic study explores the current issues facing the profession of social work in South Africa after the first fully democratic elections in ten years ended the apartheid era. It employed interviews with social work educators and practitioners, politicians, and other professionals; personal observations of diverse settings; conversations with citizens including blacks, whites and coloreds; and meetings with experts attending an international conference on African policy planning. Social work educators and practitioners generally agreed that the two major social problems currently facing South Africa are poverty and violence. Poverty-related issues include homelessness, substandard and dangerous housing, substance abuse, unemployment …
