The Immorality And Inefficiency Of An Efficient Breach, Dawinder S. Sidhu Jan 2006

The Immorality And Inefficiency Of An Efficient Breach, Dawinder S. Sidhu

Faculty Scholarship

This Article attempts to analyze a concept in contract law known as the doctrine of efficient breach, which “compels [or at least encourages or invites] a party to a contract to breach if they can compensate the other party and remain better off than if they had fully performed the contract.”2 This doctrine appears to encourage immoral conduct, namely the breach of a contract. However, in the name of economic efficiency, wealth maximization, and social wealth, several prominent legal scholars, including Judge Richard A. Posner, the “leader of the school of Law and Economics movement,”3 have argued that an efficient …

Adequate Progress, Or Rivers Left Behind? Developments In Colorado And Wyoming Instream Flow Laws Since 2000, Reed D. Benson Jan 2006

Adequate Progress, Or Rivers Left Behind? Developments In Colorado And Wyoming Instream Flow Laws Since 2000, Reed D. Benson

Faculty Scholarship

Colorado and Wyoming have much in common in regard to water supply and water use, and both states have followed the western states' traditional approach in their instream flow laws. This traditional approach, however, has serious practical shortcomings in restoring and protecting instream flows. This Article asks whether Colorado and Wyoming have made “adequate progress” since 2000 in addressing these shortcomings in their instream flow laws. For one of these states, the answer is clear Wyoming has made no progress on its instream flow laws in recent years. Colorado, by contrast, has clearly made progress in strengthening its laws-especially as …

A Few Ironies Of Western Water Law, Reed D. Benson Jan 2006

A Few Ironies Of Western Water Law, Reed D. Benson

Faculty Scholarship

We have a truly outstanding panel of speakers this morning to discuss issues and history relating to water resources in the American West. Water, of course, has always been scarce out here. Some nineteenth century maps of the United States had the words "Great American Desert" written broadly across the West, and that characterization reflected how many people viewed the West in that era. The story goes that President Grant sent a cabinet member to the West with orders to report back on "what it is they need out there." The secretary dutifully wrote back saying, "All this place needs …

Prosecutorial Discretion In The Post-Booker World, Norman C. Bay Jan 2006

Prosecutorial Discretion In The Post-Booker World, Norman C. Bay

Faculty Scholarship

This article takes a measured position. On the one hand, Booker has diminshed prosecutorial discretion somewhat. That point, perhaps, is obvious. In theory, the Guidelines are no longer mandatory, and prosecutors have less power to control sentencing. On the other hand, reports of the demise of the prosecutorial discretion have been greatly exaggerated. Post-Booker, prosecutorial discretion remains vast and, indeed, for a number of reasons is still likely to be greater than it was in the pre-Guidelines era. Much has happened since November 1, 1987, including the passage of mandatory minimum laws and the acculturation of federal judges to the …

Keep Your Money: Let The West Pay For Its Own Water Projects, Denise D. Fort Jan 2006

Keep Your Money: Let The West Pay For Its Own Water Projects, Denise D. Fort

Faculty Scholarship

The question posed here is what role the federal government should play in responding to the western water crisis, in light of the changes in the social and political landscape that have occurred in the last decade. My thesis is that solutions to water needs that are funded locally are more likely to be sustainable than those produced through national appropriations. My thinking is affected by the work I did on a Presidential commission that recommended sustainability be the cornerstone of western water policy.

Robustness And Distance Discrimination Of Adaptive Near Field Beamformers, Y. Rosa Zheng, Peng Xie, Steven L. Grant Jan 2006

Robustness And Distance Discrimination Of Adaptive Near Field Beamformers, Y. Rosa Zheng, Peng Xie, Steven L. Grant

Electrical and Computer Engineering Faculty Research & Creative Works

A robust adaptive beamformer is proposed using the near field regionally constrained adaptive approach that designs a set of linear constraints by filtering on a low rank subspace of the near field signal over a spatial region and a wide frequency band. This method can accurately control the beam-former response over the designed spatial-temporal region using a small number of linear constraint vectors and improve the robustness against target location errors. Meanwhile, this method enhances the capability of the near field beamformer in distance discrimination without additional constraints so that interference impinging at the same direction as the desired signal …

A method of improving weld quality between aluminum members by slowing the rate of solidification of a molten weld trough into solidified material. Upper and lower aluminum members are positioned together in contact between facing surfaces thereof to expose a first outer surface of the upper aluminum member to laser irradiation. A welding laser beam is moved in a path over the first outer surface, wherein the welding laser beam has an energy and width to progressively melt a trough of molten metal to a depth through the upper aluminum member and into the lower aluminum member. The molten metal …

Creating Cascading Failure Scenarios In Interconnected Power Systems, Badrul H. Chowdhury, Sushant Barave Jan 2006

Creating Cascading Failure Scenarios In Interconnected Power Systems, Badrul H. Chowdhury, Sushant Barave

Electrical and Computer Engineering Faculty Research & Creative Works

The reported catastrophic failures of power systems from different geographical parts of the world often point to cascading outage events of system elements that eventually had led to system blackout. Although the initiating events of these cascading failures may, at times, be avoidable by vegetation management or proper protection settings, the occurrence of such an event as well as the eventual impact cannot always be predicted. There is much debate in the industry whether the operator has enough time to apply countermeasures to avoid blackouts. Besides, the process of determining effective countermeasures cannot be deemed accurate unless a system has …

Observability Conditions For Target States With Bearing-Only Measurements In Three-Dimensional Case, Mehdi Ferdowsi Jan 2006

Observability Conditions For Target States With Bearing-Only Measurements In Three-Dimensional Case, Mehdi Ferdowsi

Electrical and Computer Engineering Faculty Research & Creative Works

In target tracking with a passive sensor such as infrared seekers, angle-only information is determined. In this case no information about the range of the target is provided and unobservable system is resulted. This paper studies the observability of discrete time three-dimensional bearing-only target tracking. The target is assumed to be moving in a straight line while a single moving observer (own-ship) measures its relative (elevation and azimuth) bearing angles. By transforming the inherently nonlinear bearing measurements into a pseudo-linear form, a linear Least Squares (LS) estimator is formulated. Observability is then analyzed by studying the solvability of the associated …

In radio frequency identification (RFID) systems, the detection range and read rates will suffer from interference among high power reading devices. This problem grows severely and degrades system performance in dense RFID networks. In this paper, we investigate a suite of feasible power control schemes to ensure overall coverage area of the system while maintaining a desired read rate. The power control scheme and MAC protocol dynamically adjusts the RFID reader power output in response to the interference level seen locally during tag reading for an acceptable signal-to-noise ratio (SNR). We present novel distributed adaptive power control (DAPC) and probabilistic …

The SMART system is a special purpose server developed by ETRI and designed for efficient streaming services over high speed networks. The SMART server has one or more special purpose NS (Network-Storage) card. The NS card has several disks that store multimedia contents. However all of the multimedia contents to be serviced cannot be stored at the server. In this paper, we will describe the storage management mechanism in design and implementation aspects. With this storage management mechanism, the SMART server can provide effectiveness in managing storage and distributing some contents from a source station to streaming service servers.

Development And Implementation Of Optimized Energy-Delay Sub-Network Routing Protocol For Wireless Sensor Networks, Maciej Jan Zawodniok, Jagannathan Sarangapani, Steve Eugene Watkins, James W. Fonda Jan 2006

Development And Implementation Of Optimized Energy-Delay Sub-Network Routing Protocol For Wireless Sensor Networks, Maciej Jan Zawodniok, Jagannathan Sarangapani, Steve Eugene Watkins, James W. Fonda

Electrical and Computer Engineering Faculty Research & Creative Works

The development and implementation of the optimized energy-delay sub-network routing (OEDSR) protocol for wireless sensor networks (WSN) is presented. This ondemand routing protocol minimizes a novel link cost factor which is defined using available energy, end-to-end (E2E) delay and distance from a node to the base station (BS), along with clustering, to effectively route information to the BS. Initially, the nodes are either in idle or sleep mode, but once an event is detected, the nodes near the event become active and start forming sub-networks. Formation of the inactive network into a sub-network saves energy because only a portion of …

Gene Expression Data For Dlbcl Cancer Survival Prediction With A Combination Of Machine Learning Technologies, Rui Xu, Xindi Cai, Donald C. Wunsch Jan 2006

Gene Expression Data For Dlbcl Cancer Survival Prediction With A Combination Of Machine Learning Technologies, Rui Xu, Xindi Cai, Donald C. Wunsch

Electrical and Computer Engineering Faculty Research & Creative Works

Gene expression profiles have become an important and promising way for cancer prognosis and treatment. In addition to their application in cancer class prediction and discovery, gene expression data can be used for the prediction of patient survival. Here, we use particle swarm optimization (PSO) to address one of the major challenges in gene expression data analysis, the curse of dimensionality, in order to discriminate high risk patients from low risk patients. A discrete binary version of PSO is used for gene selection and dimensionality reduction, and a probabilistic neural network (PNN) is implemented as the classifier. The experimental results …

Intelligent Tool For Determining The True Harmonic Current Contribution Of A Customer In A Power Distribution Network, Joy Mazumdar, Frank C. Lambert, Ganesh K. Venayagamoorthy, Marty L. Page, Ronald G. Harley Jan 2006

Intelligent Tool For Determining The True Harmonic Current Contribution Of A Customer In A Power Distribution Network, Joy Mazumdar, Frank C. Lambert, Ganesh K. Venayagamoorthy, Marty L. Page, Ronald G. Harley

Electrical and Computer Engineering Faculty Research & Creative Works

Customer loads connected to electricity supply systems may be broadly categorized as either linear or nonlinear. Nonlinear loads inject harmonics into the power network. Harmonics in a power system are classified as either load harmonics or as supply harmonics depending on their origin. The source impedance also impacts the harmonic current flowing in the network. Hence any change in the source impedance is reflected in the harmonic spectrum of the current. This paper proposes a novel method based on Artificial Neural Networks to isolate and evaluate the impact of the source impedance change without disrupting the operation of any load, …

Laser Optical In-Circuit Measurement System For Immunity Applications, Chong Ding, David Pommerenke Jan 2006

Laser Optical In-Circuit Measurement System For Immunity Applications, Chong Ding, David Pommerenke

Electrical and Computer Engineering Faculty Research & Creative Works

During immunity testing (ESD, EFT) of a digital circuit, the waveforms of critical signal nets need to be measured for analyzing the failure mechanism. However, it is difficult to measure the induced voltage in the circuit under test due to the unwanted coupling by the non-ideal shielding of the probe cable, especially, if large common mode currents are present. Fiber optical connection avoids this problem. Semiconductor lasers have frequently been used for converting the voltage into an optical signal. The paper shows novel implementations of powering the laser, leading to a small, low cost optical probe.

Nanoporous Zeolite Thin Film-Based Fiber Intrinsic Fabry-Perot Interferometric Sensor For Detection Of Dissolved Organics In Water, Ning Liu, Juan Hui, Cunqiang Sun, Junhang Dong, Luzheng Zhang, Hai Xiao Jan 2006

Nanoporous Zeolite Thin Film-Based Fiber Intrinsic Fabry-Perot Interferometric Sensor For Detection Of Dissolved Organics In Water, Ning Liu, Juan Hui, Cunqiang Sun, Junhang Dong, Luzheng Zhang, Hai Xiao

Electrical and Computer Engineering Faculty Research & Creative Works

A fiber optic intrinsic Fabry-Perot interferometric (IFPI) chemical sensor was developed by fine-polishing a thin layer of polycrystalline nanoporous MFI zeolite synthesized on the cleaved endface of a single mode fiber. The sensor operated by monitoring the optical thickness changes of the zeolite thin film caused by the adsorption of organic molecules into the zeolite channels. The optical thickness of the zeolite thin film was measured by white light interferometry. Using methanol, 2-propanol, and toluene as the model chemicals, it was demonstrated that the zeolite IPFI sensor could detect dissolved organics in water with high sensitivity.

Online Training Of A Generalized Neuron With Particle Swarm Optimization, R. Kiran, Ganesh K. Venayagamoorthy, Sandhya R. Jetti Jan 2006

Online Training Of A Generalized Neuron With Particle Swarm Optimization, R. Kiran, Ganesh K. Venayagamoorthy, Sandhya R. Jetti

Electrical and Computer Engineering Faculty Research & Creative Works

Neural networks are used in a wide number of fields including signal and image processing, modeling and control and pattern recognition. Some of the most common type of neural networks is the multilayer perceptrons and the recurrent neural networks. Most of these networks consist of large number of neurons and hidden layers, which results in a longer training time. A Generalized Neuron (GN) has a compact structure and overcomes the problem of long training time. Due to its simple structure and lesser memory requirements, the GN is attractive for hardware implementations. This paper presents the online training of a GN …

Optimal Design Of Svc Damping Controllers With Wide Area Measurements Using Small Population Based Pso, Ganesh K. Venayagamoorthy, Tridib Kumar Das, Sandhya R. Jetti

Electrical and Computer Engineering Faculty Research & Creative Works

Static Var Compensator (SVC) are employed for providing better voltage regulation and transient stability especially for increased power transfer through the transmission lines. In this paper, two SVC damping controllers with single and dual inputs respectively are designed based on wide area measurements of generator speed deviations. A Small Population based Particle Swarm Optimization algorithm (SPPSO) is applied to determine the optimal parameters of the damping controllers for small and large disturbances. Simulation results are provided to show that the effectiveness of the optimal damping controllers on the Kundur''s two-area benchmark power system. Results show the dual input controller further …

Echo State Networks For Determining Harmonic Contributions From Nonlinear Loads, Joy Mazumdar, Ganesh K. Venayagamoorthy, Frank C. Lambert, Ronald G. Harley Jan 2006

Echo State Networks For Determining Harmonic Contributions From Nonlinear Loads, Joy Mazumdar, Ganesh K. Venayagamoorthy, Frank C. Lambert, Ronald G. Harley

Electrical and Computer Engineering Faculty Research & Creative Works

This paper investigates the application of a new kind of recurrent neural network called Echo State Networks (ESNs) for the problem of measuring the actual amount of harmonic current injected into a power network by a nonlinear load. The interaction between loads connected to a point of common coupling (PCC) is a highly dynamic process. The determination of true harmonic current injection by individual loads is further complicated by the fact that the supply voltage waveform at the PCC is distorted by other loads at the PCC or further upstream and is therefore rarely a pure sinusoid. Harmonics in a …
