System For Heating Bulk Materials, Nassib Aouad, J. Kennedy
Mining Engineering Faculty Research & Creative Works
A system for heating bulk material to remove moisture. The system includes a heat exchanger system in the floor of a bin for receiving moist bulk material. The heat exchanger system is capable of withstanding the weight of the bulk material as well as being stable for the dynamic process of loading and discharging the bulk material. The heat exchanger includes a plurality of spaced beams mounted between a top plate and bottom plate. The spaced beams form conduits for receiving water or other fluids that have been heated by a stove capable of burning wood, coal, biomass material or …

The Effect Of Classical Music On Painting Quality, Attitude And Behaviour For Students With Severe Intellectual Disabilities, Jane V. Riddoch
Theses: Doctorates and Masters
The main purpose of this study was to investigate the effectiveness of a new Pictorial and Musical Visual Arts Program for students with severe intellectual disabilities. In particular, to learn whether the addition of classical music as background helped students improve the quality of their abstract paintings, attitudes and behaviour in class.
A Reappraisal Of Wesleyan Methodist Mission In The First Half Of The Nineteenth Century, As Viewed Through The Ministry Of The Rev John Smithies (1802-1872), Richard B. Roy
Theses: Doctorates and Masters
The dissertation reappraises Wesleyan Methodist (WM) mission in the first half of the nineteenth century on the basis of its mission statement (`to reform the nation, particularly the Church; and to spread scriptural holiness over the land' ) and a primary WM characteristic, religious experience. The mission statement shapes the outline for the first main section of the dissertation (3.0) utilising the three divisions of the statement only in reverse order, specifically, (1) the spread of scriptural holiness, (2) reform of the church and (3) reform of the land (nation). The second main section (4.0) examines religious experience in the …
Land Whisperings And A Poetics Of Newplace And Birthplace, Glenly R. Phillips
Land Whisperings And A Poetics Of Newplace And Birthplace, Glenly R. Phillips
Theses: Doctorates and Masters
The creative component of this doctoral submission, entitled Land Whisperings, comprises a selection of seventy-five poems, ten short stories and a novella. The connecting theme of this body of work is the emphasis on the landscapes of three continents: Australia, my birthplace, Italy, my wife Rita's birthplace, and China, where I have visited and taught for many years. These locations have also been the subject of substantial research and field experience over the past four years. Since I am an Australian, there is a natural predominance of Australian settings for the poetry and short stories. The selected creative works also …

I went to London not to see the queen, but to find the Dutch baronet from whom we were all descended. I went as my father and forefathers and foremothers had done, to turn the crackling pages of a parish register and put my finger on our name. I went with an image of Gualter de Raedt, a young Dutchman in 1660, boarding a ship to accompany Charles the Second back to England, where monarchy would be restored. The fleet of thirteen ships sailed from Schevinengen on a flat gray sea as fifty thousand people stood on the beach to …

The imperatives for reducing the world’s dependence on fossil and nuclear fuels have multiplied manifold in recent years with the advent of worldwide terrorism. These new dangers come in addition to the imperatives of addressing the dire consequences of global warming and devastating pollution that accompany the use of these fossil fuels. Reducing dependence on these unsafe and unreliable energy resources should be a top global priority. Implementation of proven energy efficiency technologies offers the world the fastest, safest, most economic and most environmentally benign way to alleviate these threats. This article outlines available efficiency measures, their economic advantages and …

“Peace Is More Than The End Of Bombing”: The Second Stage Of The Vieques Struggle, Sherrie Baver
“Peace Is More Than The End Of Bombing”: The Second Stage Of The Vieques Struggle, Sherrie Baver
Publications and Research
The nature of colonialism in Puerto Rico has caused most political issues to be viewed within the framework of status politics. In the first stage of the struggle to expel the U.S. Navy from the island (1999–2003), civil society in Puerto Rico united when the issues were reframed with links not to status politics but to human rights and social justice. Viequenses symbolized for Puerto Ricans in Puerto Rico, on the mainland, and in the world at large the costs of military colonialism. In the second stage of the struggle, since the military’s departure, Viequenses have struggled to control the …
Ethics, Morality, And Truth-Telling, Lee E. Teitelbaum
Ethics, Morality, And Truth-Telling, Lee E. Teitelbaum
Utah Law Review
The most troublesome of these examples is the last-impeachment by prior conviction. Jethro Lieberman's book, The Litigious Society, argues that to impeach a witness to save your client is like a bodyguard throwing an innocent person in the path of a bullet.66 Until 1993 the Criminal Defense Standards suggested that impeachment by prior conviction should be avoided if the witness is testifying truthfully.67 Lieberman's argument reminds one of the dangers of analogy, and the Defense Standards ultimately only hoped that lawyers will not impeach witnesses for the fun of it. Perhaps the real problem is with the evidence rule itself. …

"Peoples Distinct From Others": The Making Of Modem Indian Law, Charles Wilkinson
"Peoples Distinct From Others": The Making Of Modem Indian Law, Charles Wilkinson
Utah Law Review
The story of how tribes have taken back their reservations, and through sovereign self-rule restored democracy and improved the lives of their people, is surprising, both in the means and the magnitude, and it cuts against preconceptions and stereotypes. Overwhelmingly, the central thrust has been the work of Indian people. People in the agencies, courts, and Congress were not sitting around wondering how they could benefit Indians. The tribes themselves initiated litigation or invited it by assertions of tribal sovereignty and jurisdiction and hunting, fishing, water, land and cultural rights. They themselves brought forth the legislative proposals. They constructed the …

The Eleventh Circuit's Maltreatment Of G-Ray-Market Case Law: Davidoff & Cie V. Pld International Corp., Jeremy Wooden
Utah Law Review
The Davidoff ruling is also suspect when compared to the principles and policies underlying the Supreme Court's interpretation of the Tariff Act in the K Mart case. First, the Court emphatically interpreted the Act as revealing that Congress lacked "sympathy" for the "prototypical gray-market victim. Second, although the Tariff Act confers trademark owners protection against some instances of gray-market competition, it only does so for a select few who have furchased their trademarks at "arm's length" from an overseas company.24 Most importantly, this extension of trademark protection against intrabrand, gray-market competition was done on the basis of equity analysis, and …
Classical And Quantum Algorithms For Finding Cycles, Jill Cirasella
Classical And Quantum Algorithms For Finding Cycles, Jill Cirasella
Publications and Research
Quantum computing—so weird, so wonderful—inspires much speculation about the line between the possible and the impossible. (Of course, there is still unclarity about how “impossible” intractable problems are and about how “possible” quantum computers are.) This thesis takes a slightly different tack: instead of focusing on how to make the impossible possible, it focuses on how to make the possible easier.
More specifically, this paper discusses quantum algorithms for finding cycles in graphs, a problem for which polynomial-time classical algorithms already exist. It explains and compares the classical and quantum algorithms, and it introduces a few new algorithms and observations. …

Rousseau's Gift To Geneva, Helena Rosenblatt
Rousseau's Gift To Geneva, Helena Rosenblatt
Publications and Research
People often seem to forget that Rousseau dedicated his Second Discourse to “The Republic of Geneva.” This is a shame because, in doing so, they miss precious clues not only about the meaning of the Discourse itself, but also about its place in Rousseau’s political thought as a whole.
It is no accident that Rousseau dedicated the Discourse on Inequality, his most radical work of all, to his hometown of Geneva; but it requires some research into the historical context to understand why. In Geneva a patrician ruling elite was using social contract theory to subvert the democratic principles …

Adaptive Finite Element Methods For Elliptic Pdes Based On Conforming Centroidal Voronoi-Delaunay Triangulations, Lili Ju, Max Gunzburger, Weidong Zhao
Faculty Publications
A new triangular mesh adaptivity algorithm for elliptic PDEs that combines a posteriori error estimation with centroidal Voronoi–Delaunay tessellations of domains in two dimensions is proposed and tested. The ability of the first ingredient to detect local regions of large error and the ability of the second ingredient to generate superior unstructured grids result in a mesh adaptivity algorithm that has several very desirable features, including the following. Errors are very well equidistributed over the triangles; at all levels of refinement, the triangles remain very well shaped, even if the grid size at any particular refinement level, when viewed globally, …

Spanish In Brazil: Language Policy, Business, And Cultural Propaganda, José Del Valle
Publications and Research
The purpose of this article is to describe and analyze the language policies designed and implemented since the early nineties by Spanish government agencies in order to promote Spanish as a valuable international language. In particular, we focus on its promotion in Brazil and on the strategies used to legitimize not only the presence of the language in various domains (e.g. the educational system) but also the active participation of Spanish institutions in its spread. Through a detailed analysis of a corpus of relevant texts, (a) we critically examine the cultural, economic, and political roots of these policies, as well …

This Article evaluates the federal Indian country criminal justice regime, not against norms of Indian law and policy, but against those of criminal law and policy. Specifically, this Article evaluates the federal constitutional norms that lie at the heart of American criminal justice and that are designed to ensure the legitimacy of federal criminal trials. Toward that end, Part I presents a critical description of key facets of the federal Indian country criminal justice system. Part II begins the critical evaluation by evaluating a key institutional player in the federal system, the federal prosecutor. It highlights the handicaps faced by …

Demand for help is high, which reflects a healthy desire by the SMEs to innovate. The assistance given is time limited, but its impact on the business is extremely varied. This paper will discuss …
Practicing What We Preach: Humane Treatment For Detainees In The War On Terror, Jennifer Moore
Practicing What We Preach: Humane Treatment For Detainees In The War On Terror, Jennifer Moore
Faculty Scholarship
This article sets forth both principled and pragmatic arguments for the fair and humane treatment of all individuals detained in the war on terror derived from both U.S. and international law. Section II explores the human dimension of the "war on terror." Section IIA critiques the use of the metaphor of war to characterize counter-terrorism policy. Section IIB examines the experiences of several individuals apprehended by the United States on suspicion of involvement in terrorism, including the response of U.S. courts to their detention without charge as "unlawful combatants." Section III offers possible explanations for the phenomenon by which the …
Mad Women And Desperate Girls: Infanticide And Child Murder In Law And Myth, Elizabeth Rapaport
Mad Women And Desperate Girls: Infanticide And Child Murder In Law And Myth, Elizabeth Rapaport
Faculty Scholarship
This article first offers a comparison between the stereotype dominated understanding of infanticide and child homicide in the United States and the statistical landscape it obscures. It then turns to the history of the crime of infanticide, a history which confirms that a fascination with deviant women as long dominated the story of infanticide. The article concludes with the exploration of the "Good Mother Defense." That exploration reveals the extent to which the fate of a woman tried for child homicide hinges on whether the jury sees her as a good mother, rather than on the prosecutors' ability to prove …

The Next Epidemic: Bubbles And The Growth And Decay Of Securities Regulation, Erik F. Gerding
Faculty Scholarship
This article explores how speculative bubbles undermine the effectiveness of securities regulations and spawn epidemics of securities fraud. A brief historical survey demonstrates that stock market bubbles almost invariably coincide with epidemics of securities fraud, and provides a compelling argument that the outbreak of fraud in the Enron era did not stem merely from factors unique to the 1990s, but from the dynamics of an asset price bubble as well. Drawing on perspectives from securities law practice and economic theory, the article argues that bubbles dilute the deterrent effect of antifraud rules and promote deregulation. Both effects alter the calculus …
Deflating The Deference Myth: National Interests Vs. State Authority Under Federal Laws Affecting Water Use, Reed D. Benson
Deflating The Deference Myth: National Interests Vs. State Authority Under Federal Laws Affecting Water Use, Reed D. Benson
Faculty Scholarship
This Article seeks to separate the myth from the reality of federal deference to state water allocation authority. Section I briefly addresses background principles of state water law and federal constitutional law, and Section II traces the early history of deference prior to 1910. Section III analyzes three federal statutory schemes and Supreme Court cases applying them, suggests that each represents a different level of federal deference, and distills a few principles for analyzing deference under federal statutes. Section IV addresses deference issues arising in the context of the CWA and the ESA, applying the principles identified in the previous …

The Immorality And Inefficiency Of An Efficient Breach, Dawinder S. Sidhu
Faculty Scholarship
This Article attempts to analyze a concept in contract law known as the doctrine of efficient breach, which “compels [or at least encourages or invites] a party to a contract to breach if they can compensate the other party and remain better off than if they had fully performed the contract.”2 This doctrine appears to encourage immoral conduct, namely the breach of a contract. However, in the name of economic efficiency, wealth maximization, and social wealth, several prominent legal scholars, including Judge Richard A. Posner, the “leader of the school of Law and Economics movement,”3 have argued that an efficient …
