Constitutional Realism About Constitutional Protection: Indigenous Rights Under A Judicialized And A Politicized Constitution, Matthew Sr Palmer Apr 2006

Constitutional Realism About Constitutional Protection: Indigenous Rights Under A Judicialized And A Politicized Constitution, Matthew Sr Palmer

Dalhousie Law Journal

This article assesses the comparative effectiveness of constitutional protection of indigenous rights in Canada and New Zealand using a perspective of "constitutional realism". The two constitutions offer a useful contrast of similar systems distinguished by distinctly contrasting directions over the past twentyfive years. The reality of Canadas constitutional development has seen more power accrue to the judicial branch of government. The reality of New Zealand's constitutional development has seen more power accrue to the political branches ofgovernment. The article considers the reality of the behaviour of these branches of government in each jurisdiction in relation to indigenous rights. It finds …

Which Islam-Ism? Diversity In Islamic Society And Its Implications For Democracy, Christopher M. Ebsch Apr 2006

Which Islam-Ism? Diversity In Islamic Society And Its Implications For Democracy, Christopher M. Ebsch

Masters Theses

This study aims to refute claims of Islamic exceptionalism in the midst of recent waves of democratization, thereby disproving assumptions of any incompatibility between democracy and Islam. My research will show that such sweeping assumptions gloss over significant, developmental democratic movements within Muslim nations as well as several uniquely Islamic supports for democratic ideals and institutions.

I begin by examining recent political activities conducive to democracy in Muslim states, by distinguishing between divergent principles in the Qur' an, some of which have been used by moderate, democratically-oriented Islamists, and by realizing the historical, political antecedents leading to a rise in …

Programming Immaterial Labour, Stefano Harney Apr 2006

Programming Immaterial Labour, Stefano Harney

Research Collection Lee Kong Chian School Of Business

Language, image, and ambiance production used to go under the sign of cultural labour. Today, these increasingly gather under the banner of immaterial labour. It is this part of cultural labour, a part of cultural labour most explicitly projecting itself as labour, that I want to discuss in this article.

Competence, Identity Or Translation: Metaphors Cross-Cultural Research Lives By, Sławomir Magala Mar 2006

Competence, Identity Or Translation: Metaphors Cross-Cultural Research Lives By, Sławomir Magala

European Management Studies

Comparative studies of culture focus on individual competence (what cultural software, based on which collective raw "prefabs" facilitates cooperation), will focus on organizational identity (what cultural identity, based on which collective traditions legitimizes competitive advantage) and may focus on social translation (which norms, within which cultural domain, best secure survival and maintenance of core cultural values). The metaphors of "competence", "identity" and "translation" mark off the domain of cross-cultural research in - respectively - managerial studies, behavioral and social sciences and the humanities. One of the most fascinating aspects of these three metaphorical worlds - the world of individual competence, …

Punitive Damages, Liquidated Damages, And Clauses Penale In Contract Actions: A Comparative Analysis Of The American Common Law And The French Code Civil, Charles R. Calleros Mar 2006

Punitive Damages, Liquidated Damages, And Clauses Penale In Contract Actions: A Comparative Analysis Of The American Common Law And The French Code Civil, Charles R. Calleros

ExpressO

Although American common law allows punitive damages for reckless or intentional torts, it will neither allow a jury to assess punitive damages for breach of contract nor permit enforcement of a contractual damages clause that is deemed to be punitive. This approach is rooted in an early Chancery practice of granting equitable relief from oppressive penal bonds and has been more recently justified as a means of facilitating efficient breach. Economic efficiency, however, can be accomplished even if punitive damages could be assessed for intentional breach, because the parties would have an incentive to negotiate a release from the first …

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This paper documents a self-study research group from its inception, storying its development and impacts on the curricular lives of 11 participating educators individually and collectively. Drawing on the scholarship of the self-study tradition within educational research (Loughran et al. 2004), we see teacher knowledge as largely untapped and an important source for the improvement of teaching. Positioning participants to look at the sense and selves being made on a continual basis places reflexivity is at the heart of self-study. Our paper reveals multiple ways educators might engage reflexively, considering and reconsidering beliefs about the nature of learners, learning, teachers, …

Vocabulary Acquisition In Cfl (Chinese As A Foreign Language) Contexts: A Correlation Of Performance And Strategy Use, Ping Mcewen

Theses and Dissertations

The present study was anchored in an inquiry of second language Chinese vocabulary acquisition and learning Chinese as a foreign language. It investigated character density in L2 Chinese vocabulary recognition and production: low character density recognition, high character density recognition, low character density production, and high character density production. It also investigated the effectiveness of strategies that students perceived when faced with learning Chinese. The data was collected from the Chinese program at Brigham Young University across one semester level. Along with this data, students' vocabulary achievement test scores were collected. Descriptive and non-parametric statistics were used. The one-way ANOVA …

How U.S. Audiences View Korean Films: A Case Study Of Oldboy, Sung Taik Cha Mar 2006

How U.S. Audiences View Korean Films: A Case Study Of Oldboy, Sung Taik Cha

USF Tampa Graduate Theses and Dissertations

Prior studies have shown that the information and cultural product flow is dominantly one direction from large/wealthy markets to smaller markets. Extending this position through the underlying research, it is expected that the audiences in the United States, one of the largest cultural product exporters, may have shaped certain perceptions on the scarcity of Korean films in their domestic film market. By studying the users in an internet film discussion community, this research aims to provide useful ideas about how American audiences perceive Korean films. This qualitative case study conducted a content analysis of the actual postings by the participants …

Evaluating Km Journal Content: An Assessment Of Trends (2000-2005), Donnie O. Harp

Theses and Dissertations

Knowledge management (KM) has been receiving ever increasing attention from researchers and practitioners, especially over the last 5 years. Consequently, some researchers and practitioners now believe that KM should be its own discipline and have established KM-specific journals in an effort to further this idea. Many of these journal founders believe that KM has emerged as a mixture of many disciplines and have written the goal of being interdisciplinary into their charters. This research reviews the KM literature published in KM-specific journals from 2000 to 2005. Specifically, using a content analysis methodology, this research reviews and analyzes the body of …

Bringing The Market To Life: Screen Aesthetics And The Epistemic Consumption Object, Detlev Zwick, Nikhilesh Dholakia Mar 2006

Bringing The Market To Life: Screen Aesthetics And The Epistemic Consumption Object, Detlev Zwick, Nikhilesh Dholakia

College of Business Faculty Publications

This article argues that the new ‘visuality’ (Schroeder, 2002) of the Internet transforms the stock market into an epistemic consumption object. The aesthetics of the screen turn the market into an interactive and response-present surface representation. On the computer screen, the market becomes an object of constant movement and variation, changing direction and altering appearance at any time. Following Knorr Cetina (1997, 2002b) we argue that the visual logic of the screen ‘opens up’ the market ontologically. The ontological liquidity of the market-on-screen simulates the indefiniteness of other life forms. We suggest that the continuing fascination with online investing is …

Eugenicism: The Construction Of Queer Space In The Works Of Octavia Butler And Samuel Delany, Freda Fair Mar 2006

Eugenicism: The Construction Of Queer Space In The Works Of Octavia Butler And Samuel Delany, Freda Fair

American Studies Honors Projects

Late nineteenth century and early twentieth century United States eugenic history is saturated with nature-nurture debates concerning human character and social development in relation to the institutionalization and popularization of genetics and biology. By interrogating eugenic testing and experimentation on those identified as sexual, racial, and national others this work will utilize eugenicism, an analytical and discursive tool developed from the history of U.S. eugenics, to perform close readings of works by Octavia Butler and Samuel Delany. As eugenics constructs subjects by imagining what they will contribute to a fitter future society, science fiction, as genre, (re)imagines the world that …

Modernism, Joyce, And Portuguese Literature, Carlos Ceia Mar 2006

Modernism, Joyce, And Portuguese Literature, Carlos Ceia

CLCWeb: Comparative Literature and Culture

Carlos Ceia, in his article, "Modernism, Joyce, and Portuguese Literature," discusses parallels between James Joyce's work and texts by modernist and contemporary Portuguese novelists such as Antunes, Brandão, Negreiros, Pessoa, Saramago, Sá-Carneiro, Silva Ramos, and Velho da Costa. In his analysis, Ceia focuses on the role of myth, the notion of the (anti-)hero, the solipsism of interior consciousness, narrative techniques, and linguistic experimentation. Ceia argues that while it is impossible to detect direct influence by Joyce on Portuguese writers, it is in the context of the parallel paradigms of modernism we are able to discover the Joycean impact on both …
