An Analysis And Policy Implications Of Comfort Levels Of Diverse Constituents With Reported Units For Blast Vibrations And Limits: Closing The Communication Gap, Braden Lusk
Doctoral Dissertations
"Differences exist between public perception of construction blasting and quarry blasting. In general, people are able to tolerate short term inconveniences much better than long term ones. Quarries and other long term mining operations utilizing blasting are coming under increasing public and legislative pressure in the United States. The question being posed for the blasting industry is, "Has our past haste in adopting complex scientific scales and units been detrimental to us?" In other words, are the most palatable things being reported? The goal of this dissertation is to determine whether current units create an atmosphere of discomfort among neighbors …
An Implementation Of The It Fundamentals Knowledge Area In An Introductory It Course, Cheryl L. Aasheim, Choong Kwon Lee, Han Reichgelt
An Implementation Of The It Fundamentals Knowledge Area In An Introductory It Course, Cheryl L. Aasheim, Choong Kwon Lee, Han Reichgelt
Computing: Faculty Publications
The recently promulgated IT model curriculum contains IT fundamentals (ITF) as one of its knowledge areas. It is intended to give students a broad understanding of (1) the IT profession and the skills that students must develop to become successful IT professionals and (2) the academic discipline of IT and its relationship to other disciplines. The model curriculum recommends 33 lecture hours to complete the IT fundamentals knowledge. The model curriculum also recommends that the material relevant to the IT fundamentals knowledge area be offered early in the curriculum, for example in an Introduction to IT course; however, many institutions …
Georgia Superintendents' Assessment Of The Six Crucial C'S, Harvey A. Franklin
Georgia Superintendents' Assessment Of The Six Crucial C'S, Harvey A. Franklin
College of Graduate Studies: Theses & Dissertations
The quantitative research project examined the Georgia superintendents' assessment of their use of the six crucial C's in their job performance. The research method used for the study was a qualitative analysis of data collected from eight interviews of Georgia superintendents under contract during the 2005-2006 school year. Results of the study were used to address the three research questions: (1) extent to which the Georgia superintendents assess their use of the six crucial C's, (2) extent to which Georgia superintendents share the importance of the six crucial C's, and (3) extent to which Georgia superintendents rate their use of …
What Happens To Girls When They Are The Only Female In A Male Dominated Setting?, Nancy Courtney Mitchell
What Happens To Girls When They Are The Only Female In A Male Dominated Setting?, Nancy Courtney Mitchell
College of Graduate Studies: Theses & Dissertations
Throughout the history of special education and particularly the induction of Public Law 94-142, special educational practices have placed a significantly greater number of boys than girls in classes for children with learning disabilities and emotional/behavioral disorders. As a result, there is often only one girl per class of modified self-contained students -- spending at least three periods per day in a setting set aside for their unique characteristics and needs. The marginalization of this group of females is a cause for concern, especially in times when gender equities are at the forefromt of much of the recent public discussions, …
Teaching Bodies: Curriculum And Corporeality, Julie Garlen Maudlin
Teaching Bodies: Curriculum And Corporeality, Julie Garlen Maudlin
College of Graduate Studies: Theses & Dissertations
I began thinking about the topic of this dissertation at first in 2003 when I found myself expecting a third child while teaching full-time and pursuing a doctoral degree, and in earnest later that year at Bergamo, where I began to see a connection between my own interest in desires and bodies as they relate to education and the work of several of my colleagues. I began to think about the role of the body in the curriculum. Every day that we enter the classroom we bring our bodies and our desires along with us. We educate and learn from …
How Kindergartners' Talks And Drawings Inform Our Ways Of Developing A Curriculum Of Caring And Imagination, Lisa Audet Aliotta
How Kindergartners' Talks And Drawings Inform Our Ways Of Developing A Curriculum Of Caring And Imagination, Lisa Audet Aliotta
College of Graduate Studies: Theses & Dissertations
This study explores how kindergartners' talks and drawings inform our ways of developing a curriculum of caring and imagination. The mandates of kidnergartners' curriculum tend to emphasize children's mastery of literacy skills while ignoring their natural development and imagination. Author's abstract: This study explores how kindergartners' talks and drawings inform our ways of developing a curriculum of caring and imagination. The mandates of kindergartners' curriculum tend to emphasize children's mastery of literacy skills while ignoring their natural development and imagination. There is a need for developing a curriculum that embraces children's diverse needs, releases their imagination, and cultivates their highest …
Contagious Discourse: Germs, Mass Media, And The Shaping Of Reality, Amy Richardson Ballagh
Contagious Discourse: Germs, Mass Media, And The Shaping Of Reality, Amy Richardson Ballagh
College of Graduate Studies: Theses & Dissertations
Over the past two decades, mass media coverage of certain infectious diseases has become more abundant. News reports of many of these contagious illnesses invoke fear in many people, such as Ebola and pandemic influenza; multidrug-resistant strains of infectious diseases, such as tuberculosis; and agents of biological warfare, a concern that is now at the forefront with many Americans due to the most recent act of bioterrorism on American soil following the events of September 11th. This dissertation focuses on the American public's perception of infectious diseases, particularly as portrayed in the cultural science curriculum. I examine the cyclic nature …
Inquiry Into The Writing Pedagogy For Middle School Language Arts, William Love Moore
Inquiry Into The Writing Pedagogy For Middle School Language Arts, William Love Moore
College of Graduate Studies: Theses & Dissertations
This is a narrative inquiry into writing pedagogies of middle school language arts teachers and an administrator. Six teacher participants were interviewed and observed, their lesson plans were analyzed, and their instructional practices and writing philosophies were examined. Overarching research questions were (1) What role does writing pedagogy play in a language arts program? (2) What strategies were used to teach writing? and (3) What types of assessments were utilized? The theoretical framework of my research was based on Dewey's (1897) philosophy of education with roots in hermeneutic phenomenology by van Manen (1990). Methods of inquiry were based on narrative …

Base-Level Buffers And Buttresses: A Model For Upstream Versus Downstream Control On Fluvial Geometry And Architecture Within Sequences, John M. Holbrook, Robert W. Scott, Francisca Oboh-Ikuenobe
Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works
The effects of downstream base-level control on fluvial architecture and geometry are well explored in several broadly similar sequence-stratigraphic models. Cretaceous Dakota Group strata, U.S. Western Interior, have characteristics reflecting combined downstream and upstream base-level controls that these models cannot address. Particularly, three layers of amalgamated channel-belt sandstone within this group thicken and are continuous for distances (≤ 300 km) along dip that stretch the reasonable lengths for which these models are intended to apply. As well, architecture in up-dip reaches records repeated valley-scale cut-and-fill cycles. This contrasts with equivalent strata down dip which record channel-scale lateral migration with no …

Hamdan V. Rumseld: The Legal Academy Goes To Practice, Neal K. Katyal
Hamdan V. Rumseld: The Legal Academy Goes To Practice, Neal K. Katyal
Georgetown Law Faculty Publications and Other Works
Hamdan v. Rumsfeld is a rare Supreme Court rebuke to the President during armed conflict. The time is not yet right to tell all of the backstory of the case, but it is possible to offer some preliminary reflections on how the case was litigated, the decision, and its implications for the oft-noticed divide between legal theory and practice.
In a widely cited article, Judge Harry Edwards lamented "the growing disjunction between legal education and the legal profession," claiming that "many law schools. .. have abandoned their proper place, by emphasizing abstract theory at the expense of practical scholarship and …

Judicial Enforcement Of Treaties: Self-Execution And Related Doctrines, Carlos Manuel Vázquez

This morning we will be discussing the judicial enforcement of treaties in the United States. In particular, I would like to focus on the relationship between a treaty's status as self-executing or not, and the question of its judicial enforceability.
Philosophy V. Rhetoric In Legal Education: Understanding The Schism Between Doctrinal And Legal Writing Faculty, Kristen Konrad Robbins-Tiscione
Philosophy V. Rhetoric In Legal Education: Understanding The Schism Between Doctrinal And Legal Writing Faculty, Kristen Konrad Robbins-Tiscione
Georgetown Law Faculty Publications and Other Works
The author argues that although legal writing faculty know that what they teach is absolutely essential to their students' success, yet it continues to be grossly, even embarrassingly, undervalued in legal education. Doctrinal legal faculty perpetuate the view that legal education is a philosophical endeavor that focuses on the truth about the nature of law and, in the twenty-first century, on the law's ability to serve justice in a multicultural America. Because of their political power, however, doctrinal faculty are able to preserve the task of truth finding for themselves. Since the nature of truth is independent of its practical …
Who's Afraid Of Unenumerated Rights?, Randy E. Barnett
Who's Afraid Of Unenumerated Rights?, Randy E. Barnett
Georgetown Law Faculty Publications and Other Works
Unenumerated rights are expressly protected against federal infringement by the original meaning of the Ninth Amendment and against state infringement by the original meaning of the Privileges or Immunities Clause of the Fourteenth Amendment. Despite this textual recognition, unenumerated rights have received inconsistent and hesitant protection ever since these provisions were enacted, and what protection they do receive is subject to intense criticism. In this essay, the author examines why some are afraid to enforce unenumerated rights. While this reluctance seems most obviously to stem from the uncertainty of ascertaining the content of unenumerated rights, he contends that underlying this …
Scalia's Infidelity: A Critique Of "Faint-Hearted" Originalism, Randy E. Barnett
Scalia's Infidelity: A Critique Of "Faint-Hearted" Originalism, Randy E. Barnett
Georgetown Law Faculty Publications and Other Works
In this essay, based on the 2006 William Howard Taft lecture, the author critically evaluates Justice Antonin Scalia's famous and influential 1988 Taft Lecture, entitled Originalism: The Lesser Evil. In his lecture, Justice Scalia began the now-widely-accepted shift from basing constitutional interpretation on the intent of the framers to relying instead on the original public meaning of the text. At the same time, the essay explains how Justice Scalia allows himself three ways to escape originalist results that he finds to be objectionable: (1) when the text is insufficiently rule-like, (2) when precedent has deviated from original meaning and …

This article analyzes the shift of legal scholarship from the old world of law reviews to today's world of peer reviews to tomorrow's world of open access legal blogs. This shift is occurring in three dimensions. First, legal scholarship is moving from the long form (treatises and law review articles) to the short form (very short articles, blog posts, and online collaborations). Second, a regime of exclusive rights is giving way to a regime of open access. Third, intermediaries (law school editorial boards, peer-reviewed journals) are being supplemented by disintermediated forms (papers on the Internet, blogs). Blogs and internet conversations …
The Federal Criminal "Code" Is A Disgrace: Obstruction Statutes As Case Study, Julie R. O'Sullivan
The Federal Criminal "Code" Is A Disgrace: Obstruction Statutes As Case Study, Julie R. O'Sullivan
Georgetown Law Faculty Publications and Other Works
Any discussion of federal penal law must begin with an important caveat: There actually is no federal criminal "code" worthy of the name. A criminal code is defined as "'a systematic collection, compendium, or revision' of laws." What the federal government has is a haphazard grab-bag of statutes accumulated over 200 years, rather than a comprehensive, thoughtful, and internally consistent system of criminal law. In fact, the federal government has never had a true criminal code. The closest Congress has come to enacting a code was its creation of Title 18 of the United States Code in 1948. That "exercise, …
Natural Justice, Lawrence B. Solum
Natural Justice, Lawrence B. Solum
Georgetown Law Faculty Publications and Other Works
Justice is a natural virtue. Well-functioning humans are just, as are well-ordered human societies. Roughly, this means that in a well-ordered society, just humans internalize the laws and social norms (the nomoi)--they internalize lawfulness as a disposition that guides the way they relate to other humans. In societies that are mostly well-ordered, with isolated zones of substantial dysfunction, the nomoi are limited to those norms that are not clearly inconsistent with the function of law--to create the conditions for human flourishing. In a radically dysfunctional society, humans are thrown back on their own resources--doing the best they can in …
We The People's Executive, Rosa Ehrenreich Brooks
We The People's Executive, Rosa Ehrenreich Brooks
Georgetown Law Faculty Publications and Other Works
Perhaps to no one’s surprise, a recent survey found that most Americans know far more about television hits than they know about the United States Constitution. For instance, 52% of Americans surveyed could name at least two characters from The Simpsons, and 41% could name at least two judges from American Idol. Meanwhile, a mere 28% could identify more than one of the rights protected by the First Amendment.
Surveys such as this help clear up one of the apparent mysteries of the last five years: How did we change so quickly from a nation in which the …
It Takes A Lawyer To Raise A Child?: Allocating Responsibilities Among Parents, Children, And Lawyers In Delinquency Cases, Kristin N. Henning
It Takes A Lawyer To Raise A Child?: Allocating Responsibilities Among Parents, Children, And Lawyers In Delinquency Cases, Kristin N. Henning
Georgetown Law Faculty Publications and Other Works
This Article considers whether, and to what extent, children do or should look to parents for guidance in matters of juvenile delinquency. To this end, I draw insight from theories of adolescent development, rules of professional ethics, and principles of constitutional law and justice. In Part I, I identify opportunities for support and collaboration between children and parents in the juvenile justice system and then consider the potential for conflict in these families. In Part II, I propose six strategies for effective lawyering on behalf of children and parents in juvenile court. Given the complexities of the issues, I recognize …

The National Security Agency's Domestic Spying Program: Framing The Debate, David Cole, Martin S. Lederman
Georgetown Law Faculty Publications and Other Works
On Friday, December 16, 2005, the New York Times reported that President George W. Bush had secretly authorized the National Security Agency (NSA) to conduct warrantless surveillance of Americans' telephone and e-mail communications as part of an effort to obtain intelligence about future terrorist activity.' The Times report was based on leaks of classified information, presumably by NSA officials concerned about the legality of the program. The Times reported that at the President's request it had delayed publication of the story for more than a year.
The Indiana Law Journal reprinted four documents that, taken together, set forth the basic …
Beyond Unconscionability: Class Action Waivers And Mandatory Arbitration Agreements, J. Maria Glover
Beyond Unconscionability: Class Action Waivers And Mandatory Arbitration Agreements, J. Maria Glover
Georgetown Law Faculty Publications and Other Works
We live in an age of convenience. From financial transactions to electronic correspondence, we frequently deal with large corporations that provide services in our daily lives. One of the prices we pay for the convenience of these transactions, however, is that our commercial relationships increasingly are based on standard form contracts written by large corporations. While these standard form contracts are necessary to an economically efficient society, the growing use of mandatory arbitration provisions and clauses that prohibit class actions in these contracts raises the spectre of corporate abuse.
Internal Separation Of Powers: Checking Today's Most Dangerous Branch From Within, Neal K. Katyal
Internal Separation Of Powers: Checking Today's Most Dangerous Branch From Within, Neal K. Katyal
Georgetown Law Faculty Publications and Other Works
The standard conception of separation of powers presumes three branches with equivalent ambitions of maximizing their powers. Today, however, legislative abdication is the reigning modus operandi. Instead of bemoaning this state of affairs, this piece asks how separation of powers can be reflected within the Executive Branch when that branch, not the legislature, is making much law today. The first-best concept of legislature v. executive checks-and-balances has to be updated to contemplate second-best executive v. executive divisions.
A critical mechanism to promote internal separation of powers is bureaucracy. Much maligned by both the political left and right, bureaucracy serves crucial …
Aristotle’S Tried And True Recipe For Argument Casserole, Kristen Konrad Robbins-Tiscione
Aristotle’S Tried And True Recipe For Argument Casserole, Kristen Konrad Robbins-Tiscione
Georgetown Law Faculty Publications and Other Works
I thoroughly enjoyed John Schunk’s article— “What Can Legal Writing Students Learn from Watching Emeril Live?”—in the Winter 2006 issue. We are big Emeril fans in our family, and we too have heard him distinguish the art of baking casseroles from the art of baking cakes. Baking a casserole is more art than science, because although there are basic ingredients, a creative cook can vary the recipe to please a variety of palettes. Baking a cake, on the other hand, is more science than art, because if the cook eliminates a necessary egg or adds too much baking powder, the …
Design And Implementation Of Preparation Strategies For Massachusetts Comprehensive Assessment System Stakeholders, Judith Josephs
Design And Implementation Of Preparation Strategies For Massachusetts Comprehensive Assessment System Stakeholders, Judith Josephs
Theses and Dissertations
This applied dissertation was designed to provide better access to current preparation strategies for passing the Massachusetts Comprehensive Assessment System (MCAS) test. The test preparation strategies did not meet the needs of the students. The students did not know how to use the computer to study for the test and did not know how to study at home for the test. Teachers also did not know of the availability of electronic information to enrich their lessons and increase the achievement of vocational high school students.
The researcher developed strategies to train students and teachers on Bridges Transitions (1999) testGEAR and …
Evaluating Support Services For African American Females At A Historically Black College, Sabrina Ferguson Edwards
Evaluating Support Services For African American Females At A Historically Black College, Sabrina Ferguson Edwards
Theses and Dissertations
This study examined the effectiveness of the Women’s Resources Assistance Program (WRAP), a support service for African American females attending a historically black college or university (HBCU). The study included 230 participants. The purpose of the study was to gauge, through the use of surveys, each participant’s knowledge and level of participation in the WRAP.
The participants were issued questionnaires and interview forms to complete during the study. The questionnaires contained 11 closed-ended questions that were designed to determine the participating students’ attitude towards WRAP as well as their level of participation. Similarly, oral interviews were conducted to ascertain the …
Captain S. S. Heller And The First Organized Danish Migration To Canada, Erik John Nielsen Lang
Captain S. S. Heller And The First Organized Danish Migration To Canada, Erik John Nielsen Lang
The Bridge
The first, largest, and only organized migration of Danish settlers to Canada in the 19th century was directed to the settlement of New Denmark in the Canadian province of New Brunswick. The active recruitment of Danish migrants was a shift of focus for the provincial government, which had before relied almost exclusively on British settlers. Established in 1872, New Denmark's location placed it amongst the traditional ethnic groups of Victoria County: French-Canadian, English, Scottish, and Irish. Danes would not have chosen to migrate to the province at all had it not been for a Danish emigration promoter whose life, motivations, …
