Beaver Home Ranges And Movement Patterns On The Embarras River Watershed In East Central Illinois, Randall P. Havens Jan 2006

Beaver Home Ranges And Movement Patterns On The Embarras River Watershed In East Central Illinois, Randall P. Havens

Masters Theses

The beaver (Castor canadensis) is an ecologically and economically important species that has been much studied and exploited during its long association with humans (Bradt 1938, Hodgdon 1978, Novak 1987, Muller-Schwartze and Schulte 1999). Beavers have been described as ecosystem engineers and a keystone species because of their ability to physically modify, maintain, or create wetlands thereby controlling resources used by other organisms and altering the physical state of the environment (Jones et al. 1994). They are capable of impacting the local environment through dam construction, selective tree harvest, and den construction. For example, beaver dams impact stream hydrology, nutrient …

We examined the educational involvement of English speaking and Spanish speaking parents of students in a Dual Language Program. Parents responded to open-ended questions about how they were involved, what they would like to be involved in but were not, and what barriers prevented them from being more involved. Monitoring/assisting with homework was the most frequently mentioned involvement activity fir both groups, followed by reading with their children, school involvement and communication, and providing social and emotional support to their children. The top areas in which parents wanted to do more were school involvement and communication, social and emotional support, …

The Catholic Case: The Index Of Prohibited Books, Daniel P. Sheridan Jan 2006

The Catholic Case: The Index Of Prohibited Books, Daniel P. Sheridan

Journal of Hindu-Christian Studies

Sometimes it takes a while for the word to get out, or for it to get in. It has been said that, in India in 1948 as the British were leaving, there were villages that had not yet heard that they had arrived. Similarly, there may be villages in Tibet that have not yet heard that the Dalai Lama fled Tibet in 1959. Deep in Siberia in the mid 1930's, there were communities of Old Believers who did not know of the October Revolution in 1917. Googooling the words, "Index of Prohibited Books," resulted in more than a million references. …

Embodying "Bhakti Rasa" In Bharata Natyam: An Indian-Christian Interpretation Of "Gayatri" Mantra Through Dance, Katherine C. Zubko

Journal of Hindu-Christian Studies

As the five female dancers from the Indian-Christian fine art college of Kalai Kaviri encircle the South Indian brass lamp, or vilakku, awakening it to life with the flames from their own individual votives, the beginning melody of a song cues the women to stretch out their arms in preparation to rise from their seated positions and dance. As they raise their arms in unison, the light glinting off their bangles and gold threaded costumes, the Sanskrit words Om Bhur Bhuvah Svah signal the invocatory phrase of the popular Gayatri mantra chanted daily by many Hindus all over the …

Body Matters In Massively Multiplayer Online Role-Playing Games, C. Jason Smith Jan 2006

Body Matters In Massively Multiplayer Online Role-Playing Games, C. Jason Smith

Reconstruction: Studies in Contemporary Culture

The virtual body is already here. Though not as “seamless” as the virtual body envisioned in cyberpunk literature and made popular in films like The Lawnmower Man (1992), hundreds of thousands of people in over 114 countries (“Visitor Center”) daily log into massively multiplayer online role-playing games like Everquest, Ultima Online, Anarchy Online, and Earth and Beyond. These massively multi-player online role-playing games (MMORPGs or MMOs for short) [1] combine the extensive rule systems of traditional role-playing games (or RPGs) such as Advanced Dungeons & Dragons with computer graphic technology and online chat. In these computer …

An Empirical Study Of Empirical Legal Scholarship: The Top Law Schools, Tracey E. George Jan 2006

An Empirical Study Of Empirical Legal Scholarship: The Top Law Schools, Tracey E. George

Vanderbilt Law School Faculty Publications

Empirical legal scholarship is arguably the most significant emerging intellectual movement. Empirical legal scholarship (ELS), as the term is generally used in law schools, refers to a specific type of empirical research: a model-based approach coupled with a quantitative method. This paper ranks law schools based on their place in the ELS movement and offers an essential ranking framework that can be adopted for other intellectual movements. A revised version of the paper was posted on October 11. The updated tables reflect additional data.

The Allocation Problem In Multiple-Claimant Representations, Paul H. Edelman, Richard A. Nagareda, Charles Silver Jan 2006

The Allocation Problem In Multiple-Claimant Representations, Paul H. Edelman, Richard A. Nagareda, Charles Silver

Vanderbilt Law School Faculty Publications

Multiple-claimant representations-classa ctions and other group lawsuits-pose two principal-agent problems: Shirking (failure to maximize the aggregate recovery) and misallocation (distribution of the aggregate recovery other than according to the relative value of claims). Clients have dealt with these problems separately, using contingent percentage fees to motivate lawyers to maximize the aggregate recovery and monitoring devices (disclosure requirements, client control rights, and third-party review) to encourage appropriate allocations. The scholarly literature has proceeded on the premise that monitoring devices are needed to police misallocations, because the fee calculus cannot do the entire job. This paper shows that this premise is mistaken …

Monetizing The Benefits Of Risk And Environmental Regulation, W. Kip Viscusi Jan 2006

Monetizing The Benefits Of Risk And Environmental Regulation, W. Kip Viscusi

Vanderbilt Law School Faculty Publications

Should the benefits of risk and environmental regulations be monetized? For economists, this question is not controversial. Benefits of government policies have a value given by society's willingness to pay for these benefits, which by its very nature poses the valuation issue in monetary terms. Government agencies have likewise not shied away from monetizing these benefits. A contrary school of thought, however, has recently emerged, as reflected in the book by Frank Ackerman and Lisa Heinzerling, Priceless: On Knowing the Price of Everything and the Value of Nothing. As the title of the book suggests, the authors oppose economists' attempts …

An Empirical Analysis Of Ceo Employment Contracts: What Do Top Executives Bargain For?, Randall Thomas, Stewart J. Schwab Jan 2006

An Empirical Analysis Of Ceo Employment Contracts: What Do Top Executives Bargain For?, Randall Thomas, Stewart J. Schwab

Vanderbilt Law School Faculty Publications

In this paper, we examine the key legal characteristics of 375 employment contracts between some of the largest 1500 public corporations and their Chief Executive Officers. We look at the actual language of these contracts, asking whether and in what ways CEO contracts differ from what are thought of as standard employment contract features for other workers. Our data provide some empirical answers to several common assertions or speculations about CEO contracts, and shed light on whether these contracts are negotiated solely to suit the preferences of CEOs or have provisions that insure that the employers' interests are also safeguarded. …

Tarasoff As A Duty To Treat: Insights From Criminal Law, Christopher Slobogin Jan 2006

Tarasoff As A Duty To Treat: Insights From Criminal Law, Christopher Slobogin

Vanderbilt Law School Faculty Publications

In most jurisdictions, the Tarasoff duty is defined as a duty on the part of mental health professionals to act on patient threats of serious harm to identified individuals. Although breach of this duty has, to date, only led to civil liability, a good case can that it should lead to criminal liability as well, not just for something minor like a failure to report a potential crime, but for the felony committed by the patient. Furthermore, to the extent Tarasoff requires merely a warning after a serious threat to an identified victim, this civil and criminal liability could logically …

Voice Onset Time Production In Individuals Wth Alzheimer's Disease, Julie M. Baker Jan 2006

Voice Onset Time Production In Individuals Wth Alzheimer's Disease, Julie M. Baker

Electronic Theses and Dissertations

In the present study, voice onset time (VOT) measurements were compared between a group of individuals with moderate Alzheimer's disease (AD) and a group of healthy age- and gender-matched peers. Participants read a list of consonant-vowel-consonant (CVC) words, which included the six stop consonants. Recordings were gathered and digitized. The VOT measurements were made from oscillographic displays obtained from the Brown Laboratory Interactive Speech System (BLISS) implemented on an IBM-compatible computer. VOT measures for the participants' six stop consonant productions were subjected to statistical analysis. The results of the study indicated that differences in VOT values were not statistically significant …

Articulation And Phonological Systems Of Spanish-English Speaking Florida 4 And 5 Year Olds, Jennifer Dennis Jan 2006

Articulation And Phonological Systems Of Spanish-English Speaking Florida 4 And 5 Year Olds, Jennifer Dennis

Electronic Theses and Dissertations

There are currently five million children three to five years of age (i.e., 59.5% of all children from three to five), who are bilingual, living in the United States. By 2025, Census data show that the population of Florida will increase by some 26 percent adding another 5.5 million people to the state. There are a limited amount of studies yielding data on the development of Spanish phonology in 4 and 5 year old children residing in the United States, particularly in Florida. Consequently, there is limited normative information pertaining to articulation and phonological development in Spanish speakers. It was …

Cultivating Identities And Differences : A Case Study Of The Hong Kong Junior Secondary Economic And Public Affairs Curriculum, Yuen Fun, Muriel Law Jan 2006

Cultivating Identities And Differences : A Case Study Of The Hong Kong Junior Secondary Economic And Public Affairs Curriculum, Yuen Fun, Muriel Law

Lingnan Theses

This thesis studies the junior secondary EPA curriculum and the complex cultural process of teaching and learning of the curriculum. It draws on theoretical frameworks developed in the field of cultural studies and critical pedagogy, particularly works by Michel Foucault, Stuart Hall, Lawrence Grossberg and Paulo Freire. It investigates how the EPA curricular texts attempt to produce the identity characteristic of "rational, sensitive and active citizens" in contemporary Hong Kong through constructing differences that negate the Other. Through analyzing classroom discursive practices, the thesis examines how the curricular knowledge "interpellates" teachers into subject position to talk about the "rational, sensitive …

A Critical Analysis Of Problem Solving Perceptions As Reported By Special Event Managers: A Systems Based Approach To Training S, Mary Jo Ross Jan 2006

A Critical Analysis Of Problem Solving Perceptions As Reported By Special Event Managers: A Systems Based Approach To Training S, Mary Jo Ross

Electronic Theses and Dissertations

The purpose of this research was to examine special event management as a temporary business model and how it is impacted by problem solving capabilities in its utilization of temporary systems. The phenomenon of special events management and how event leaders must continuously make decisions based upon knowledge, skill, and intuition are the constructs of why events operations are as unique as the events themselves. A paradigm of temporary operational organizations that depend on communication, information, and implementation of operational strategies within unusual and unique environments and on a continuous basis must rely on appropriate instructional systems. The instructional methods …

Legal Positivism: Still Descriptive And Morally Neutral, Andrei Marmor Jan 2006

Legal Positivism: Still Descriptive And Morally Neutral, Andrei Marmor

Cornell Law Faculty Publications

It has become increasingly popular to argue that legal positivism is actually a normative theory, and that it cannot be purely descriptive and morally neutral as H.L.A. Hart has suggested. This article purports to disprove this line of thought. It argues that legal positivism is best understood as a descriptive, morally neutral, theory about the nature of law. The article distinguishes between five possible views about the relations between normative claims and legal positivism, arguing that some of them are not at odds with Hart’s thesis about the nature of jurisprudence, while the others are wrong, both as expositions of …

Saints, Soldiers And Sinners The Mormon Experience In Early California 1846-1857, Charles Lamont Gunderson Jan 2006

Saints, Soldiers And Sinners The Mormon Experience In Early California 1846-1857, Charles Lamont Gunderson

Theses

This thesis compares California's three mid nineteenth-century Mormon settlements their origins, purpose, and ultimate abandonment. I argue that despite their common bond of faith, these three settlements differed tremendously because they were created for distinct reasons and at a perplexing time in the Mormons history.
