Practicing engineers sometimes criticize researchers for answering questions that no one is asking, or at least for conducting research on questions of personal interest or in areas that funding agencies think are important. Although such research has a place in the overall picture of things, it is instructive to consider the practical issues that engineers in the field face. The fields of water resources and environment are very broad, and only a small number of research users could be included on the panel seated by the Education and Research Council at the 2004 World Water and Environmental Resources Congress. Between Rights And Contract: Arbitration Agreements And Non-Compete Covenants As A Hybrid Form Of Employment Law, Cynthia Estlund

The employment relationship is governed largely by contract, but with a heavy overlay of “rights”: minimum terms and individual rights that are established by external law and are typically nonwaivable. But some terms of employment are governed neither by ordinary contract nor by ordinary rights, nor even by ordinary waivable rights. Both of the two most controversial contractual instruments in employment law today—non-compete covenants and mandatory arbitration agreements—take the form of written contracts; both waive important employee rights (the right to compete postemployment, the right to litigate future claims); and both are subject to substantive criteria of validity that are …

Joyce Tischler describes the development of the field of animal law from the first animal law conference to its current recognition as one of today's most important issues. Tischler traces the beginnings of animal law and its development, both parallel to and as part of the animal rights and protection movements. Tischler further explores common dilemmas facing animal lawyers and how these dilemmas, along with their responses, have helped shape animal law as we know it today.

American law has yet to reach a satisfying conclusion about public access to information on government operations. But recent events are prompting reconsideration of the status quo. As our current system is reassessed, three shortfalls in past debates should be overcome. The first involves ignorance of foreign systems. Other democracies grapple with information access problems, and their recent experiments are illuminating. Indeed they expose two additional domestic weaknesses. One is a line we have drawn within constitutional law. Courts and commentators tend to treat constitutional issues of public access separately from those of executive discretion to withhold information, but these …

The Patent Act is now over a half-century old, and many observers have become concerned that it is not responsive to the needs of emerging industries or to the changing landscape of science. In this Article, we look at this issue in the context of the life sciences and examine how patent doctrine has reacted as the fields of proteomics, genomics, and structural biology have advanced. We find many missteps along what we call the subject matter-inventiveness-scope-exemption trajectory. Patents now protect subject matter such as genes and proteins. These advances no longer represent particularly difficult scientific challenges. But because this …

Alandscape restoration plan for the 45-acre Gore Place property in Waltham and Watertown, MA, calls for restoration of grounds, gardens and structures to depict and interpret the late eighteenth- and early nineteenth-century occupation of Massachusetts governor and United States senator, Christopher Gore, and his wife, Rebecca. The restoration plan includes archaeological investigation to help identify the location and integrity of six historically documented features on the Gore Place grounds. Blocks and transects of shovel test pits at 5, 10 and 20 meter intervals along with 1 x 1 m excavation units and trenching were employed in the archaeological site examination …

Camera manipulation is a hard problem since a graphics camera is defined by specifying 11 independent parameters. Manipulating such a high-dimensional space to accomplish specific tasks is difficult and requires a certain amount of expertise. We present an intuitive interface that allows novice users to perform camera operations in terms of the change they want see in the image. In addition to developing a natural means for camera interaction, our system also includes a novel interface for viewing and organizing previously saved views. A Thesis On Sketch-Based Techniques For Mesh Deformation And Editing, Raquel Bujans

The goal of this research is to develop new and more intuitive ways for editing a mesh from a static camera angle. I present two ways to edit a mesh via a simple sketching system. The first method is a gray-scale editor which allows the user to specify a fall off function for the region being deformed. The second method is a profile editor in which the user can re-sketch a mesh’s profile. Lastly, the types of edits possible will be discussed and our results will be presented.
