Debates over shaming punishments have raged over the past few years, with people like Dan Kahan and Eric Posner for them, while James Whitman and Martha Nussbaum have entered the fray strongly against them. This Essay argues that both sides in the shaming punishment debate have it only party right. Those who favor shaming sanctions are correct that we should (all else being equal) favor those punishments which are expressive rather than those that involve some form of hard treatment. And those who reject shaming sanctions are correct that such sanctions involve forms of humiliation and denials of dignity that …

Through The Window: The Subject And The Voyeur's Gaze Within Cinema And Video, James A. Doohan

The underlying theme of this thesis is that cinema and related media create sites in which the viewer becomes a kind of voyeur, and in doing so normalises the voyeuristic gaze. Relationships between those who possess the gaze and those who become the object of that gaze are structured both ideologically and through the apparatus of the camera itself. These ideologies are arguably driven by a patriarchal paradigm, particularly within mainstream cinema where men appear to control the gaze and women are positioned as the object of that gaze. The Department of Agriculture and Food Western Australia (DAFWA) have been working in collaboration with EDGE Employment Solutions to identify the work opportunities that lie within the Department for people with disabilities. Based on the Equal Employment Opportunity Act 1987 (EEOA), the DAFWA have set a target of increasing their rate of employment of individuals with disabilities to constitute 4% of their entire workforce. Currently, persons' with a mild to moderate disability form 1.7% of the Public Sector.

Michael Howard takes the title of his recent essay, The Invention of Peace, from the nineteenth-century jurist and historian of comparative law Henry Maine, who wrote that "war appears to be as old as mankind, but peace is a modem invention."' We moderns tend to assume that the great wars of the nineteenth and twentieth centuries were aberrant eruptions marring the peaceful status quo, but the opposite better describes the long view. The aftermath of Hurricane Katrina brought to the nation's attention the dangers of disease from unmanaged hazardous medical waste. Congress recognized this concern long ago when it passed the Medical Waste Tracking Act (MWTA), but since this program expired in the early 1990s, little of consequence has been done to regulate medical waste on the federal level. It is now time for a uniform federal system of medical waste regulation-one which (1) specifies minimum standards for handling, disposal, and treatment; (2) calls for nationwide tracking; (3) creates a regulatory framework for individual sources of medical waste; and (4) imposes civil …

Recent events like the Terri Schiavo case typify the familiar phenomenon of a matter of legal significance becoming the focus of attention on the part not only of the courts, but also of the public, the media, and the government. Legal contemplation tends to consider these and other legal disputes isolated from their community roots and insulated from their political implications. Most private disputes remain private, and do not attract the interest of the media or the political branches of government. Recent years have seen much debate about the role of national courts in addressing global harms. That debate has focused on the application by domestic courts of international law - for instance, in civil actions brought in U.S. courts to enforce human rights law. This article identifies a parallel development in the area of economic regulation. It classifies and analyzes a category of cases that seek the application of regulatory law by domestic courts in situations involving global economic misconduct. Many students think of measurement as a set of procedures, for example, lining up a ruler with an object, and stating the number on the ruler that corresponds with one end of the object. This may be one reason that measurement is typically one of the weakest areas of mathematical achievement on the National Assessment of Educational Progress (Struchens, Martin, & Kenney, 2003). A study was conducted with forty-seven preservice childhood (elementary) education teachers (42 F, 5 M) enrolled in two mathematics methods classes taught by the same instructor to determine the effect of these college students making curriculum materials appropriate for upper elementary students on the preservice teachers' knowledge of numeration, algebra, geometry, and measurement. A Mathematical Mystery Object Box is a box containing a set of objects with corresponding clue cards. The student reads the mathematical clues addressing numeration, algebra, geometry, and measurement and attempts to locate the object that satisfies them, checking work with the picture of the correct object …

THE COMMON IMAGE OF COOPERATIVE FEDERALISM INVOLVES the Environmental Protection Agency (EPA) inducing states to adopt permit and other pollution abatement programs. States can tailor some standards, but public health benchmarks and end-of-the-pipe technologies are uniform across the nation. Inducements include both carrots, mostly in the form of federal funds and flexibility, and sticks, mostly in the form of penalties and loss of control.

This essay discusses cooperative federalism for habitat conservation. Habitat federalism focuses more on ecology than chemistry, more on cities and counties than states, and more on place-based variation than on uniform standards. It is about how …

In this Essay, we examine the reasons why the economic analysis of law has not flourished in European countries as it has in the United States. In particular, we focus on three European countries-the United Kingdom, Germany, and France. We argue that differences in culture, the legal system, and the academy have led to differing degrees of success of the law and economics movement in each country. Translocation to manage overabundant wildlife populations, (in particularly Odocoileus spp.), is generally viewed as an acceptable method of wildlife removal where more aggressive methods (i.e. hunting, sharp shooting) are not considered viable options, in heavily developed urban areas and residential subdivisions.

From December 2000 to March 2003,1 conducted a large scale White-tailed Deer 0Odocoileus virginianus) translocation study on a 259 ha (640 acres) site at Duke Farms m Hillsborough, New Jersey, a location with high public visitation, over 100 employees, and a significant building infrastructure. Previous research has indicated a relationship between mirror self-recognition and self-awareness (awareness of one's own mind). Theory of Mind (awareness of another's mind; ToM) may be related to both self-awareness and self recognition such that facilitation of self-awareness may be related to a facilitation of ToM. Buckle (1997) found that the relationship between self-recognition and self awareness could be manipulated acutely via a mirror. In her study, Buckle found that participants exposed to a mirror outperformed controls in an episodic memory task (a measure of self-awareness). There are currently over 300 sites in nearly 40 countries where a variety of marine animals are provided supplemental food by humans. The influence of this supplemental feeding on the behavior, physiology, growth, reproduction and movements of the animals involved is seldom known. Intentional supplemental feeding of the southern stingray, Dasyatis americana, has occurred at Stingray City (SC) and Stingray City Sandbar (SCS) at Grand Cayman since 1986. There are no specific regulations governing the feeding of D. americana at Grand Cayman, and neither the species nor the feeding sites are afforded any official protective status. The researcher investigated whether frontline, tacit knowledge about zoo animals was captured by zookeepers, curators, researchers, veterinarians, and outside researchers and, if so, whether and how it was transmitted into the scholarly literature. A bibliometric analysis was done of a representative sample of peer-reviewed zoo research articles published between 1973 and 200 I. This was extended to grey literature and acknowledgements statements from the same period to obtain a more global picture.

In the aftermath of the military conflicts of 1936 - 45, there seemed to be a global renunciation of war as an instrument of state policy. Shortly thereafter, however, decades of ideological attrition between the major powers and the inherent perversion of postcolonial states reduced the solemn declarations of 1945 to ineffectual rhetoric. Underpinning the decline and demise of a human-centred approach to global peace and security is the enduring notion of the civilised self and the barbaric other. In recent years, numerous municipalities in the United States and abroad have implemented either mandatory or voluntary curbside recycling programs. In most of these programs, household trash is sorted into paper, metal (steel and aluminum), and plastic products prior to its collection and then transported for processing into recycled materials. While the materials are not recycled at the curbside, the term curbside recycling generally now represents both the collection and sorting phases for these household materials.

Increasing atmospheric CO2 levels within the past few centuries have led to many studies about the global carbon cycle. An important aspect in balancing the modern global carbon budget revolves around a missing sink of carbon. It is thought that the carbon accumulation in soil may be a significant component in this loss. As changes in land use under natural conditions have increased over the years, it is not well understood how these changes may affect the soil carbon.
