In the 1980s and early 1990s the United States witnessed an outbreak of bizarre "daycare abuse" cases in which groups of young children leveled allegations of sexual and Satanic abuse against their teachers. In the present study, quantitative analyses were performed on interview transcripts from two highly publicized daycare cases (McMartin Preschool and Kelly Michaels) and a Child Protection Service (CPS). Confirming the impression of prior commentators, systematic analyses of 54 interviews indicated that suggestive techniques were much more common in the McMartin and Michaels interviews than in the CPS interviews.

The Fundamental Incoherence Of Title Vii: Making Sense Of Causation In Disparate Treatment Law, Martin J. Katz

This Article proposes a new approach to both prohibition and compensation. On the prohibition side, it proposes penalties and incentives that are unrelated to compensation. This approach will make clear that discriminatory conduct is prohibited irrespective of its effect on plaintiffs and ensure that such conduct is adequately deterred. On the compensation side, this Article proposes a new causal standard: a “necessity-or-sufficiency” test, along with a comparative fault approach to determine what level of compensation is due. Here we report on an effort to describe in detail the evolution of surface water particles in Monterey Bay from the time they first enter until the time they leave. The data used for this study are objective mappings from hourly surface currents obtained from high frequency (HF) radar measurements in Monterey Bay for the period 2 June through 4 August 1999. The basic concept is simple: compute the origin and fate of a large number of particles for every hour during the analysis period. Does The Marine Biosphere Mix The Ocean?, W. K. Dewar, R. J. Bingham, R. L. Iverson, D. P. Nowacek, L. C. St. Laurent, P. H. Wiebe

Ocean mixing is thought to control the climatically important oceanic overturning circulation. Here we argue the marine biosphere, by a mechanism like the bioturbation occurring in marine sediments, mixes the oceans as effectively as the winds and tides. This statement is derived ultimately from an estimated 62.7 TeraWatts of chemical power provided to the marine environment in net primary production. Various approaches argue something like 1% (.63 TeraWatts) of this power is invested in aphotic ocean mechanical energy, a rate comparable to wind and tidal inputs.

Acoustic Observations Of Vertical And Horizontal Swimming Velocities Of A Diel Migrator, C. Smyth, A. E. Hay, P. S. Hill, D. Schillinger

A strong sound scattering layer which underwent diel vertical migration was observed over 176 days using a bottom-mounted 600 kHz ADCP at a depth of approximately 285 m on the upper continental slope. Average observed descent times of the scatterers were within 12 minutes of sunrise and average ascent times were within 13 minutes of sunset. Average ascent speeds progressively increased away from the bed and approached 6 cm/s. Average descent speeds similarly reached a maximum of ∼6 cm/s. Horizontal velocities of the scatterers during vertical migration were found to be smaller than ambient velocities (by up to 3 cm/s), …

In the United States, approximately 17,000 people per year are diagnosed with brain tumors, the leading cause of death from cancers in children ages 1-15 year (1,2). Gliomas are the most prevalent type of brain tumors in adults, affecting 3.2/100,000 persons/yr in the United States (www.CBTRUS.org). In spite of advances in surgery, chemotherapy, and radiotherapy, the mean survival time of patients post-diagnosis remains approximately 9-12 months.

A business corporation capable of evolving, termed a learning corporation, has a conscious quality. It is the systemic version of a rigid structure-preserving corporation that would be expected eventually to run into problems and end up as a failure. The conscious corporation analogy can be used to simulate the sequence of processes that occur during Upasana, a Vedic technique of meditation. Domestic Surveillance And The Constitution, 24 J. Marshall J. Computer & Info. L. 177 (2006), Lawrence Friedman, René M. Landers

UIC John Marshall Journal of Information Technology & Privacy Law

This article argues that President Bush’s domestic electronic surveillance program is unconstitutional. The program allows the President to order the NSA to conduct surveillance of electronic communications, including communications involving United States citizens, without court order. The authors conclude that the President lacked the statutory or constitutional power to authorize such a program and that the program runs afoul to the letter and the spirit of the constitutional protection against unreasonable searches and seizures embraced by the Fourth Amendment of the United States Constitution. Congress and the President share overlapping constitutional authority in matters of foreign affairs and national security. …

This Article provides a timely examination of U.S. law and policy concerning information privacy on the Internet, a subject that receives almost daily attention in the press. This Article constructs a new theoretical framework from the writings of Alasdair MacIntyre, a major contemporary philosopher and social theorist. Over the past 30 years, MacIntyre has examined the roots and continuing impact of the failure of post-Enlightenment thinkers to produce an account of human nature and action that could replace an older Aristotelian account and command the assent of all rational persons. This Article traces the development of the TRIPs Agreement and explores why less developed countries were dissatisfied with the international intellectual property system. It also looks at the future challenges confronting these countries and what they need to do to preserve the goals and intentions behind the TRIPs negotiations. The Article begins by describing the four different narratives used to explain the origins of the TRIPs Agreement. Global satellite remote sensing records show evidence of recent vegetation greening and an advancing growing season at high latitudes. Satellite remote sensing–derived measures of photosynthetic leaf area index (LAI) and vegetation gross and net primary productivity (GPP and NPP) from the NOAA Advanced Very High Resolution Radiometer (AVHRR) Pathfinder record are utilized to assess annual variability in vegetation productivity for Alaska and northwest Canada in association with the Western Arctic Linkage Experiment (WALE). These results are compared with satellite microwave remote sensing measurements of springtime thaw from the Special Sensor Microwave Imager (SSM/I). Replicate scleractinian coral transplants were obtained from the species Meandrina meandrites and Montastrea cavernosa on a natural reef, off Dania Beach, Florida, using a hydraulic drill fitted with a 4 in. (~10 cm) core barrel. The transplants were fixed to Reef Ball™ substrates using an adhesive marine epoxy. Drill holes in the donor corals (core holes) were filled with concrete plugs. Control corals, of comparable size to both donor colonies and transplant corals, were monitored for comparison. An Experimental Histopathological Rating Scale Of Sedimentation Stress In The Caribbean Coral Montastraea Cavernosa, Bernardo Vargas-Ángel, Bernhard Riegl, David S. Gilliam, Richard E. Dodge

Colonies of Montastraea cavernosa were exposed to daily applications of approx. 200–225 mg cm– 2 sediments, during a four-week period, in order to investigate coral responses to increased sedimentation. Effects were assessed based on the histopathological condition of specimen tissues. Mild stress responses were noted as early as week one, including tissue swelling and polyp retraction, as well as changes in size and appearance of mucous secretory cells. As stress progressed, further inflammation of the mucous secretory cells was observed. Severe effects were observed in weeks 3 and 4, including atrophy of the outer epidermis, increased granularity and debris in …

The thesis explores the development and presentation of the Indian Congress exhibit at the 1898 Trans-Mississippi and International Exposition in Omaha. Intended to provide fairgoers an opportunity to witness an ethnological representation of the life and customs of Native Americans, the exhibit ultimately took a different shape than its creators intended. Funding delays and mismanagement resulted in the Indian Congress taking on many of the traits of a Wild West show, and sham battle performances became a regular feature at the exhibit. Based on 65 free-ranging gray wolves (Canis lupus) of known age and 25 of estimated age examined during summers of 1970–2004 in northeastern Minnesota, body mass of both males and females peaked at 5 or 6 years of age, with mean masses of 40.8 kg and 31.2 kg, respectively. Testis size varied as a function of age and month through at least 8 years of age, with length plus width ranging from 1.9 to 7.8 cm. Most females aged 4–9 years bred based on assessment of nipple sizes; those that had not bred had average lower body mass …

Broad patterns in distribution and abundance can elucidate processes of evolution. A positive association between local abundance and the size of the geographic range has been demonstrated for closely related species across many taxa. This pattern is usually explained by assuming that species with smaller ranges are ecologically inferior (e.g., poor competitors or dispersers). Many areas of high endemism support local species that have evolved recently. The distribution of these neoendemics may reflect historical processes not accounted for by ecological, equilibrium hypotheses.
