Antitrust Modernization: Looking Backwards, Stephen Calkins

Law Faculty Research Publications

Once again a national commission is attempting to address problems in antitrust law and enforcement. At this writing, the Antitrust Modernization Commission (AMC) is well underway. The AMC has identified 25 issues for study, and is receiving comments and holding hearings. This brief Article looks backward at previous efforts to use commissions to improve antitrust. It reviews those efforts, evaluates the results, and provides some lessons (and cautions) for other modernizers.

Prior to the 1950s, the middle Provo River in Utah offered outstanding fish and wildlife habitat. This was due in part to the Provo River freely meandering through the Heber Valley. These bends in the river provided deep holes for fish and a dense streamside forest for many species of birds. This productive habitat was altered in the 1940s and 1950s when the river was dammed, channelized, and forced between dikes (figure 1). These dikes were constructed by the USDI Bureau of Reclamation (USBR) to contain high flows that came from additional water added to the Provo River from transbasin …

Previous studies have indicated that olanzapine decreases craving after a priming dose of alcohol, that craving after a priming dose of alcohol is greater among individuals with the seven-repeat allele of the DRD4 variable number of tandem repeats (VNTR) polymorphism, and that the effect of olanzapine (a D2/D4 antagonist) is more pronounced among individuals with this allele. The present study tested the hypothesis that olanzapine may be differentially effective at reducing cue-elicited craving and differentially effective as a treatment for alcohol dependence over the course of a 12-week, randomized, placebo-controlled trial among individuals with and without the seven-repeat allele. This study has determined the optimal strategies to achieve statistically robust indices of recruitment of five key finfish species in south-western Australia. For another two species such indices could not be established. The sampling strategies developed will initially focus on the most appropriate location, month, and lunar phase, after which fine tuning of the sampling activity will be undertaken with respect to time of day, tide height, weather conditions etc. A significant outcome from the project is that five finfish species have a sampling strategy for recruits that can be utilized as a monitoring program …

Lepidopteran stemborers attack several graminaceous and wild host plants. These pests are one of the major constraints to maize production in Africa. However, efforts to control stemborers have aimed at cereal crops and the role of alternative wild hosts has been neglected. Recent reports have indicated that the abundance of wild grass in the maize field surroundings is correlated with lower stemborer incidence. This study was conducted with the aim of elucidating the role of wild grasses in stemborer infestations in maize in Uganda. The use of irrigation to flood agricultural land during rice cultivation has over the years been associated with an increase in the number of disease vectors and corresponding increase in health burden due to malaria and other vector and waterborne diseases. This study was conducted in order to develop an appropriate dispenser for the waterbuck-derived repellent for tsetse flies. The waterbuck-derived repellent consisted of pentanoic, hexanoic and heptanoic acids, guaiacol, geranylacetone, 2-undecanone and 5- octalactone. The reservoir tube of the dispenser was made from aluminium (or polypropylene) of diameter 10 mm and length 10 cm. The diffusion area was made from tygon silicon tubing of internal diameter 6.4 mm, outer diameter 9.6 mm, thickness 3.2 mm and length 2 cm (diffusion area 6.028 cm ) or 4 cm (diffusion area 12.056 cm ). The learned helplessness model (Seligman, 1975) and its various revisions suggest that both dispositional attributional style and event-specific attributions may influence people’s responses to events. Attribution theory has been applied to the search for risk and resiliency factors in trauma survivors, but few studies have compared dispositional attributional style with traumaspecific attributions in relation to posttraumatic stress symptoms. In addition, studies of attributions and PTSD fail to take into account the importance to the individual of the events about which attributions are made. The Effect Of Prey Availability On Metabolism And Activity In The Tarantula Phormictopus Cancerides (Araneae: Theraphosidae), Benjamin Nathan Philip

This study examined the effect of different periods of food deprivation on resting metabolic rates (RMR) and foraging activities in tarantulas (Phormictopus cancerides). Juvenile tarantulas were separated into two feeding groups and fed once either every 5 or 30 days. Monthly feeding trials were preceded by RMR measurements. During feeding trials I compared differences between the two groups in (1) prey capture rates, (2) time to prey capture, (3) locomotory activity, and (4) the predator’s prey detection distance. RMRs increased for the well-fed group but remained consistent for individuals, fed only once a month. Time to prey capture …

This study was designed to examine mental health professionals’ strength of belief in biological causation of several syndromes including ADHD, unipolar depression, anxiety disorders, and schizophrenia and whether a three-hour educational program will alter their thinking. Findings suggest that pre-training, mental health professionals’ reported strength of belief regarding the etiology of many mental health disorders tends toward the biologically based. Also, this study demonstrated that attendance at a three hour training program is able to reduce the expressed acceptance of biological causation of such disorders. This study assessed the influence of woodlot area and matrix composition on bird species richness and individual abundance. Bird surveys were conducted in winter 2004 and 2005 and spring 2005. Woodlot area and landscape composition were analyzed using GIS software. In winter, resident species richness and abundance increased as landscape diversity increased, whereas in spring, resident species richness decreased with increased landscape openness and abundance increased as woodlot area increased. Spring migrant species richness increased with increased landscape openness, and abundance decreased as woodlot area increased. Psychoanalysis possesses the means to think the difference of the sexes without relying on the phallus. Lacanian theory of the sinthome offers an alternative by articulating a new quadruplicity (R, S, I, and the sinthome), which allows us to think the relation between the sexes and the generations without necessarily referring to the Name-of-the-Father or the phallus as absolute norms. Cape Cod National Seashore has an active program of estuarine restoration for the nearly 2500 acres of Outer Cape coastal marshes altered profoundly since the construction of tide-restricting dikes and causeways during the nineteenth and early twentieth century. Tides were restricted by roads and railways built across coastal wetlands, and by dikes intended to limit floodwater mosquito breeding and to promote lowland agriculture. With tide restoration under way since 1999 at 90-acre Hatches Harbor in Provincetown, and just beginning in 700-acre East Harbor (also referred to as Pilgrim Lake) in Truro, both native and introduced plants and animals are responding.

The remarkable mammals known as “bats” and “flying foxes” (order Chiroptera [“hand wing”]) may be the most abundant, diverse, and geographically dispersed vertebrates (Table 1). Although a great deal is known about them, detailed information is needed to explain the astonishing variations of their anatomy, their lifestyles, their roles in ecosystems ecology, and their importance as reservoir hosts of viruses of proven or potential significance for human and veterinary health.

Placentae from scrapie-infected ewes have been shown to accumulate PrPSc when the genotype of the fetus is of a susceptible genotype (VRQ/VRQ, ARQ/VRQ or ARQ/ARQ). Cotyledons from fetuses of genotypes ARR/ARR, ARQ/ARR and ARQ/VRR have previously been shown to be resistant to PrPSc accumulation. By using ewes from a naturally infected scrapie flock, cotyledons from fetuses of multiple births of different genotypes were examined. PrPSc was detected in fetal cotyledons of genotype ARQ/ARQ, but not in cotyledons from their dizygotic twin of genotype ARQ/ARR. Two commercially available automated immunohistochemistry platforms, Ventana NexES and DakoCytomation Autostainer Universal Staining System, were compared for diagnosing sheep scrapie and cervid chronic wasting disease. Both automated platforms used the same antiprion protein monoclonal primary antibodies, but different platform-specific linker and amplification reagents and procedures. Duplicate sections of brainstem (at the level of the obex) and lymphoid tissue (retropharyngeal lymph node or tonsil) from the same tissue block were immunostained for the comparison. Examination of 1,020 tissues from 796 sheep revealed 100% concordance of results between the Ventana NexES and DakoCytomation platforms for diagnosing sheep scrapie from lymphoid tissue (103/103 …
