The Tragic Foundations Of Human Rights, Louis E. Wolcher
The Tragic Foundations Of Human Rights, Louis E. Wolcher
ExpressO
The longing for a theoretical foundation to support the aspiration for universal (international) human rights always precedes the construction of any particular foundation. This essay examines the longing for foundations in its relation to the truth of universal human suffering. Using the phenomenological method, it uncovers a certain moment of distress that shows itself in the form of longing for the constant presence of an authoritative ground that would obscure universal suffering and give focus to the phenomenon of infinite ethical responsibility that attends the I’s encounter with the suffering of others. Thought hungers for a responsibility-relieving warrant (A) for …

Department of Plant Pathology: Faculty Publications
Four yeasts (NRRL Y-30213, NRRL Y-30214, NRRL Y-30215, and NRRL Y-30216) and 1 bacterium (NRRL B-30212) have been identified as being superior antagonists capable of suppressing Fusarium head blight (head scab) in cereals, particularly in wheat and barley. Fusarium head blight is primarily caused by the fungus Gibberella zeae (anamorph=Fusarium graminearum).

Cooperation Between Mef2 And Pparγ In Human Intestinal Β,Β-Carotene 15,15'-Monooxygenase Gene Expression, Xiaoming Gong, Shu-Whei Tsai, Bingfang Yan, Lewis P. Rubin
Biomedical and Pharmaceutical Sciences Faculty Publications
Background:
Vitamin A and its derivatives, the retinoids, are essential for normal embryonic development and maintenance of cell differentiation. β, β-carotene 15,15'-monooxygenase 1 (BCMO1) catalyzes the central cleavage of β-carotene to all-trans retinal and is the key enzyme in the intestinal metabolism of carotenes to vitamin A. However, human and various rodent species show markedly different efficiencies in intestinal BCMO1-mediated carotene to retinoid conversion. The aim of this study is to identify potentially human-specific regulatory control mechanisms of BCMO1 gene expression.
Results:
We identified and functionally characterized the human BCMO1 promoter sequence and determined the transcriptional regulation of the …

Efficacy Of Scent Dogs In Detecting Black-Footed Ferrets At A Reintroduction Site In South Dakota, Sara A. Reindl-Thompson, John A. Shivik, Alice Whitelaw, Aimee Hurt, Kenneth F. Higgins
United States Department of Agriculture Wildlife Services: Staff Publications
Endangered black-footed ferrets (Mustela nigripes) are difficult to monitor because of their nocturnal and fossorial habits, but land use and management are influenced by their potential presence. Detector dogs have been suggested as a method for determining ferret presence, although its efficacy has not been thoroughly investigated. We evaluated 2 dogs trained specifically for determining ferret presence in field evaluations conducted in black-tailed prairie dog (Cynomys ludovicianus) colonies at the Conata Basin reintroduction site in South Dakota, USA, during September and October 2003. We tested the dogs on 4 test colonies that had no record of …

People As Property: On Being A Resource And A Person, Jedediah S. Purdy
People As Property: On Being A Resource And A Person, Jedediah S. Purdy
ExpressO
Property law facilitates the efficient use and allocation of scarce resources and recognizes and protects aspects of personhood – the bases of dignity and self-respect. Human beings, who are both resources for one another and the persons whose moral importance the legal system seeks to protect. This article explores how property law has addressed this paradox in the past and how might in the future.
I analyze two bodies of nineteenth-century law where the paradox was highlighted: the legal regimes of labor discipline for slaves in the antebellum South and for free workers in the laissez-faire Lochner era. The law …

Law In The Digital Age: How Visual Communication Technologies Are Transforming The Practice, Theory, And Teaching Of Law, Richard K. Sherwin, Neal Feigenson, Christina Spiesel
ExpressO
Law today has entered the digital age. The way law is practiced – how truth and justice are represented and assessed – is increasingly dependent on what appears on electronic screens in courtrooms, law offices, government agencies, and elsewhere. Practicing lawyers know this and are rapidly adapting to the new era of digital visual rhetoric. Legal theory and education, however, have yet to catch up. This article is the first systematic effort to theorize law's transformation by new visual and multimedia technologies and to set out the changes in legal pedagogy that are needed to prepare law students for practice …

Conservation Cartels: How Competition Policy Conflicts With Environmental Protection, Jonathan H. Adler
Conservation Cartels: How Competition Policy Conflicts With Environmental Protection, Jonathan H. Adler

The alleged purpose of antitrust law is to improve consumer welfare by proscribing actions and arrangements that reduce output and increase prices. Conservation seeks to improve human welfare by maximizing the long-term productive use of natural resources, a goal that often requires limiting consumption to sustainable levels. While conservation measures might increase prices in the short run, they enhance consumer welfare by increasing long-term production and ensuring the availability of valued resources over time. That is true whether the restrictions are imposed by a private conservation cartel or a government agency. Insofar as antitrust law fails to take this into …

Use Of Infrared Thermography To Detect Signs Of Rabies Infection In Raccoons (Procyon Lotor), Mike R. Dunbar, Kathleen A. Maccarthy B.S.
United States Department of Agriculture Wildlife Services: Staff Publications
Infrared thermography was evaluated as a technique to determine if raccoons (Procyon lotor) experimentally infected with rabies virus could be differentiated from non-infected raccoons. Following a 10-day adjustment period, raccoons (n = 6) were infected with a virulent rabies street strain raccoon variant by injection into the masseter muscle at a dose of 2 x 104 tissue-culture infectious dose (TCID50) in 0.2 ml (n = 4) or 105 TCID50 in 1 ml (n = 2). Five of the six raccoons developed prodromal signs of rabies 17 to 22 days post-inoculation …

We describe the distress calls of Leptodactylus chaquensis and Leptodactylus elenae. They each consist of a single, long, tonal sound with complex harmonic structure and complex frequency modulation. The distress calls of both species are different from their respective advertisement calls. Moreover, there are also clear interspecific differences. Harmonic frequencies in L. elenae are higher, there are fewer emphasized harmonics and the call is shorter and repeated at a higher rate (sometimes paired) than the call of L. chaquensis. Call duration, call rate, and position of the dominant harmonic change with the strength of the stimulus that the …

Free And Green: A New Approach To Environmental Protection, Jonathan H. Adler
Free And Green: A New Approach To Environmental Protection, Jonathan H. Adler

Most Americans consider themselves environmentalists, yet most experts are dissatisfied with existing environmental regulations, which are both inefficient and inequitable. Worse, many don't serve environmental goals. This article outlines an alternative approach to environmental policy based on market institutions and property rights rather than central-planning and bureaucratic control. The aim is both to improve environmental protection and lessen the costs ? Economic and otherwise ? Of achieving environmental goals. It seeks to ensure that Americans' environmental values are advanced without sacrificing the individual liberties the American government was created to protect.
The problem with current regulatory approaches is not merely …
