A Blogger's Blog: Exploring The Definition Of A Medium, Danah Boyd Oct 2006

A Blogger's Blog: Exploring The Definition Of A Medium, Danah Boyd

Reconstruction: Studies in Contemporary Culture

[First paragraph of Introduction]

While blogging is piquing the interest of mainstream media, youth, academic researchers, and entrepreneurial Silicon Valley, only a fraction of Internet users read blogs and many do not even know what the term means. Reports on how many people read blogs vary (Rainie 2005, Comscore 2005), but even in the United States, less than 50% of Internet users read blogs and many do not even know when they do (Buchwalter 2005). Numerous tools have been built to support blogging and people have extended those tools to do a wide variety of things that may or may …

The Challenges Of Institutionalizing Comprehensive Restorative Justice: Theory And Practice In Nova Scotia, Bruce P. Archibald, Jennifer J. Llewellyn Oct 2006

The Challenges Of Institutionalizing Comprehensive Restorative Justice: Theory And Practice In Nova Scotia, Bruce P. Archibald, Jennifer J. Llewellyn

Dalhousie Law Journal

The Nova Scotia Restorative Justice Program ("NSRJ") is one of the oldest and by all accounts the most comprehensive in Canada. The program centres on youth justice, and operates through referrals by police, prosecutors, judges and correctional officials to community organizations which facilitate restorative conferences and other restoratively oriented processes. More than five years of NSRJ experience with thousands of cases has led to a considerable rethinking of restorative justice theory andpractice in relation to governing policies, standards for program implementation and responses to controversial issues. The purpose of this paper is to explore the significance of the Nova Scotia …

Regime Tension In The Intellectual Property Rights Arena: Farmers' Rights And Post-Trips Counter Regime Trends, Chidi Oguamanam Oct 2006

Regime Tension In The Intellectual Property Rights Arena: Farmers' Rights And Post-Trips Counter Regime Trends, Chidi Oguamanam

Dalhousie Law Journal

Recognizing the transitions that have occurred in the global intellectual property arena since the TRIPS Agreement, this article identifies and examines key sites of the counter regime trends in intellectual property rights with a focus on farmers' rights. It invokes farmers' rights to highlight the conceptual and juridicalhurdles facing the new issue-linkages that propel attempts to redress the shortcomings of the TRIPS' trade-centred approach to intellectual property. The author argues that the existingjuridical framework for farmers 'rights, especiallyunder the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA), although inchoate, is stymied and not competent to realize the expectations …

Addams's Internationalist Pacifism And The Rhetoric Of Maternalism, Marilyn Fischer Oct 2006

Addams's Internationalist Pacifism And The Rhetoric Of Maternalism, Marilyn Fischer

Philosophy Faculty Publications

Addams's pacifism grew out of her experiences working for social justice in Chicago's multi-national immigrant community. It rested on her well-tested conviction that justice and international comity could only be achieved through nonviolent means. While Addams at times used maternalist rhetoric, her pacifism was not based on a belief in woman's essential, pacifist nature. Instead, it was grounded on her understanding of democracy, social justice, and international peace as mutually defining concepts. For Addams, progress toward democracy, social justice, and peace involved both institutional reform and changes in moral, intellectual, and affective sensibilities.

A person's sensibilities grow out of his …

The World Bank And The Ideology Of Reform And Development In International Economic Development Discourse, Joel M. Ngugi Oct 2006

The World Bank And The Ideology Of Reform And Development In International Economic Development Discourse, Joel M. Ngugi

Cardozo Journal of International and Comparative Law

Is the current development reform agenda, especially the one operationalized by the World Bank, Ideological? If so, does it matter? These are the two questions that animate this article. In answering both questions in the affirmative, the article first demonstrates how the current development reform agenda is Ideological. It then discusses why and how it matters that the development reform agenda is Ideological. First, the article argues that Ideological rendering of the development reform agenda effectively weakens the ability of Third World countries to articulate their economic and foreign policies in ways that would benefit their citizenry the most. Second, …

Rock, Paper, Scissors, Trademark? A Comparative Analysis Of Motion As A Feature Of Trademarks In The United States And Europe, Lesley Matty

Cardozo Journal of International and Comparative Law

Motion trademarks, or motion marks, represent a unique form of nontraditional trademarks that use movement to distinguish goods and services. Despite their recognition in the U.S. and Europe, motion marks face significant challenges in registration and enforcement due to limited case law and unclear protection standards. This note explores the legal and practical complexities surrounding motion marks, advocating for improved registration processes and alternative legal strategies, such as dilution claims, to enhance their protection.

Latino Political Participation In Nebraska: The Challenge Of Enhancing Voter Mobilization And Representation - Ollas Report No. 3, Jonathan Benjamin-Alvarado

Latino/Latin American Studies Reports

This OLLAS policy brief seeks to enhance basic information regarding the role Latinos will play in shaping the future of politics in Nebraska in the short and medium term. Because issues such as immigration policy, fair housing, labor practices, and public education have risen to the top of the political agenda nationally and statewide, and because these issues most directly impact the lives of Nebraska’s growing Latino constituencies legitimately, we must consider to what extent Latino stakeholders can shape the debate and articulate acceptable policy responses to these matters.

How effectively these issues are dealt with will have major implications …

The “Emotionally Relevant” Congregation, Goerge G. Hunter Iii Oct 2006

The “Emotionally Relevant” Congregation, Goerge G. Hunter Iii

Journal of the American Society for Church Growth

The case for emotional relevance is more easily made than for cultural relevance. Simply stated, the emotional lives of a great many pre-Christian people (and many Christian people) are dysfunctional, out of control, and crippling their lives. We meet people (and families) every day whose lives are hijacked by powerful emotions they do not understand, and may even deny.
