How ought a democracy select its judges? Critics in Canada, England, and Wales invoke the democratic values of accountability and transparency to call for a diminution in prime ministerial control over judicial appointments. In the United States, Article III of the Constitution's text directs that the President nominate - with the advice and consent of the Senate - life-tenured federal judges. Bitter conflicts about particular nominees have produced many proposals for changes of that system. Courts and commentators have struggled for years to come up with a substantive test for what kinds of condemnations are for a "public use." Does public use mean government ownership and control of property after it is taken? This would preclude delegation of eminent domain to common carriers and utilities. Does public use mean public access to the property after it is taken? This would preclude using eminent domain to acquire facilities off-limits to the public, like prisons.

Faced with these problems of under-inclusion, courts have gravitated to the idea that public use means public purpose. The U.S. Supreme Court …

This chapter explains why the dynamic of World Trade Organization (WTO) negotiations tends to lead to the progressive liberalization of market-access barriers promoting consumer welfare. As all agreements tend to be ‘incomplete’, it is a legitimate task of WTO judges to clarify progressively the WTO requirements of nondiscriminatory treatment of like goods and of like services. The additional requirements, in the WTO Agreements on Technical Barriers to Trade and on Sanitary and Phytosanitary Standards, to base restrictive measures on the ‘necessity principle’ and on ‘scientific evidence’, offer useful ‘double checks’ for judicial identification of protectionist measures. Mammal Abundance Indices In The Northern Portion Of The Great Basin, 1962-1993, Frederick F. Knowlton, Rebecca A. Bartel, L. Charles Stoddart

Indices of abundance of selected mammals were obtained for two study areas within the Great Basin: the Idaho National Engineering and Environmental Laboratory, Idaho, and Curlew Valley, Utah, USA. Data collection occurred biannually 1962–1993, with varying durations among species and sites. Abundance indices were obtained for coyotes (Canis latrans), lagomorphs (primarily black-tailed jackrabbits, Lepus californicus), and eight species of rodents. Data were originally gathered as part of a long-term study of interactions among predator and prey populations, concentrating on aspects related to coyotes and black-tailed jackrabbits. Secondarily, these data are useful in portraying trends in mammal abundance …

Encoding strategies vary in their duration of effectiveness, and individuals can best identify and modify strategies that yield effects of short duration on the basis of retrieval failures. Multiple study sessions with long inter-session intervals are better than massed training at providing discriminative feedback that identifies encoding strategies of short duration. We report two investigations in which long intervals between study sessions yield substantial benefits to long-term retention, at a cost of only moderately longer individual study sessions. When individuals monitor and control encoding over an extended period, targets yielding the largest number of retrieval failures contribute substantially to the …

The use of high-power low-frequency ultrasound transmitted down small diameter wire waveguides is an emerging technology that may have potential in the treatment of complicated atherosclerotic plaques in cardiovascular surgery. This form of energy delivery results in vibrating the distal-tip of the wire waveguide disrupting material by means of direct contact ablation and also cavitation, pressure waves and acoustic streaming in the surrounding fluid. This work describes a numerical acoustic fluid-structure model of the ultrasound wire waveguide and blood surrounding the distal tip. The structural analysis of the model predicts the natural frequencies of the waveguide and shows the extent …

This research project addresses the relationship between parenting styles and the development of moral judgment in college students enrolled in a four year private University in Central Virginia. The purpose of this study is to identify the extent to which parenting styles are one of the "building blocks" for the development of moral judgment in adolescents. The instruments used are the Parental Authority Questionnaire (Buri, 1988) and the Defining Issues Test - II (Rest, 1999). INTRODUCTION The effect of atherosclerosis is well documented and many procedures such as balloon angioplasty and stentimplantation have been developed to reopen occluded arteries. However, there are considerable differences in the material properties of various atherosclerotic lesions as they develop. Many authors have suggested that rigid calcified plaques may require specific procedures that target this rigid material through de-bulking or complete removal (Salunke et al, 1997). Ultrasound angioplasty is the delivery of high power low frequency ultrasound via a wire waveguide to the lesion location. A Time To Preserve: A Call For Formal Private-Party Rights In Perpetual Conservation Easements, Carol N. Brown

Increasingly, property owners are employing conservation easements to maintain open space or protect the environment through restrictions on development. Private-party standing to enforce conservation easements, however, has not been so widely embraced, in part because of the perceived inconsistency between private-party standing and private property rights. This Article argues that private-party standing to sue for enforcement of these easements reinforces both the easement grantor's private property rights and society's interest in natural resource preservation. The Article analyzes private-party standing under a reconstituted bundle of property rights theory and the public trust doctrine; examines the efficiency, social justice, and decentralization arguments …

This study aims to re-examine Women's World, (a Middle Eastern women's publication that was active between 1913 and 1921), from a gender aware, but broadly constructed, interdisciplinary perspective that integrates women's studies with studies of advertising and consumption. A feminist journal with a relatively long publication life, Women's World contained a substantial number of advertisements encouraging the consumption of modem goods and services. Many of these notices promised to address the beauty, health and fashion needs of modem women, thus constructing in effect the public image of "the new woman." of that image, in turn, should facilitate our understanding of …
