But tying public employers' hands by denying them the ability to restrict employee speech could take a massive toll on governmental efficiency-a toll that we would all end up paying with our tax dollars. Striking the proper balance between protecting free speech and promoting social order is a tricky enough proposition when the government is acting in its familiar role as sovereign. We introduce a method that gives exactly incompressible velocity approximations to Stokes ow in three space dimensions. The method is designed by extending the ideas in Part I (http://archives.pdx.edu/ds/psu/10914) of this series, where the Stokes system in two space dimensions was considered. Thus we hybridize a vorticity-velocity formulation to obtain a new mixed method coupling approximations of tangential velocity and pressure on mesh faces. Once this relatively small tangential velocity-pressure system is solved, it is possible to recover a globally divergence-free numerical approximation of the fluid velocity, an approximation of the vorticity whose tangential component is continuous across …

We investigate stable maneuvers for a group of autonomous vehicles while moving in formation. The allowed decentralized feeback laws are factored through the Laplacian matrix of the communication graph. We show that such laws allow for stable circular or elliptical motions for certain vehicle dynamics. We find necessary and sufficient conditions on the feedback gains and the dynamic parameters for convergence to formation. In particular, we prove that for undirected graphs there exist feedback gains that stabilize rotational (or elliptical) motions of arbitrary radius (or eceentricity). We discuss a toy model to study the dynamics of individual particles in avalanches. The model describes a particle launched from an inclined infinite staircase. The particle is not allowed to bounce when it collides with the staircase. During the collision, the particle loses some energy, and after that slides on to the end of the step it landed on. The process then repeats itself. The dynamics of this no-bounce model can essentially be completely understood. Partial versions of some results were stated and argued in previous work. Given a large number (the “flock”) of moving physical objects, we investigate physically reasonable mechanisms of influencing their orbits in such a way that they move along a prescribed course and in a prescribed and fixed configuration (or “in formation”). Each agent is programmed to see the position and velocity of a certain number of others. This flow of information from one agent to another defines a fixed directed (loopless) graph in which the agents are represented by the vertices. This graph is called the communication graph. A few studies have evaluated continuing medical education programs on domestic violence, but they have generally used convenience samples and have not provided information regarding their recruitment strategies or the proportion of eligible providers that attended the interventions. (Davis, Kaups, Campbell, & Parks, 2000; Haney, Kachur, & Zabar, 2003; McCauley, Jenckes, & McNutt, 2003) In one study that did provide such information, investigators faxed invitations to 1887 physicians, of which only 121 (6%) responded that they were interested despite a $50-$100 incentive to participate in a short on-line program with free Continuing Medical Education (CME) credits (Harris, Kutob, Surprenant, Maiuro, …

The orientation dependence of thin-crystal lattice fringes can be gracefully quantified using fringe-visibility maps, a direct-space analog of Kikuchi maps [Nishikawa and Kikuchi, Nature (London) 121, 1019 (1928)]. As in navigation of reciprocal space with the aid of Kikuchi lines, fringe-visibility maps facilitate acquisition of crystallographic information from lattice images. In particular, these maps can help researchers to determine the three-dimensional lattice of individual nanocrystals, to 'fringe-fingerprint' collections of randomly oriented particles, and to measure local specimen thickness with only a modest tilt. This paper assesses the accuracy of responses to a question that asks the location of respondents’ homes relative to a National Forest boundary. The analysis also assesses the accuracy of respondent reports on forest cover in the area surrounding their home. We find non-ignorable error in the responses to both questions. The remainder of this paper is divided into three sections. First, the methods used for this study are described as are limitations of the study. Second, we illustrate the study’s results. Finally, we discuss our results and conclusions.

Inexpensive and commercially available Global Positioning System (GPS) receivers can be used in novel applications, such as nanosatellites and unmanned aerial vehicles (UAVs), by modifying the receiver's software. Unfortunately, typical GPS software development systems cost tens of thousands of dollars and have restrictive license agreements, such as non-disclosure agreements, for both their hardware and software. This thesis describes the design and construction of an open source GPS receiver development system that addresses these unnecessary restrictions. Death ends the doctor–patient relationship, and legally the patient's right of privacy dies with the patient. Other privacy interests survive, the most central of which are those of the patient's family to bury the body and to prevent the disclosure of some personal information, such as medical information, about the deceased relative. Art is often used as a catalyst to stimulate redevelopment and neighborhood change. This often occurs inadvertently as the presence of artists in certain communities can attract both public and private investment to revalorize economically depressed areas. Marginal neighborhoods in inner-urban areas offer inspiration and diversity to artists seeking lower-cost housing. Their presence effectively makes these marginal communities "safe" for middle-class residents looking to live in a funky, urban neighborhood. Ultimately, however, artists are eventually priced out of the communities they helped to create.

This study takes a cultural perspective in studying the "Alberta Arts District," a gentrifying neighborhood in Northeast Portland in which bohemian cultural production/consumption has become the dominant and commodified vision of the community. Survey data demonstrates residents' general opinions and levels of participation in the changing neighborhood. Forty long-time residents, black and white, homeowners and renters, are interviewed in-depth regarding their perceptions of change. Long-time residents of gentrifying neighborhoods are often overlooked as a less powerful group that only has to negotiate rising rents and property values. It is easy to forget but crucial to remember that when lawmakers decide to regulate an activity, they must select a method. The law of bioethics particularly favors one method-requiring disclosure of information. The doctrine of informed consent obliges doctors to tell patients their treatment choices. The administrative law of research ethics insists that researchers warn subjects of the risks of experiments. The Patient Self-Determination Act compels medical institutions to remind patients about advance directives. This article presents the findings of a study of the resolution of motions to dismiss securities fraud lawsuits since the passage of the Private Securities Litigation Reform Act (PSLRA) in 1995. Our sample consists of decisions on motions to dismiss in securities class actions by district and appellate courts in the Second and Ninth Circuits for cases filed after the passage of the Reform Act to the end of 2002. These circuits are the leading circuits for the filing of securities class actions and are generally recognized as representing two ends of the securities class action spectrum.
