Deterrence Versus Brutalization: Capital Punishment's Differing Impacts Among States, Joanna M. Shepherd

Policymakers' false beliefs about capital punishment's universal deterrent effect may have caused many people to die needlessly. If deterrence is capital punishment's purpose then, in the majority of states where executions do not deter crime, executions kill convicts uselessly. Moreover, in the many states where the brutalization effect outweighs the deterrent effect, executions not only kill convicts needlessly but also induce the additional murders of many innocent people. After Part II discusses capital punishment's recent history in the United States, Part III reviews the conflict in recent studies on capital punishment and deterrence. Private Standards In Public Law: Copyright, Lawmaking And The Case Of Accounting, Lawrence A. Cunningham

Michigan Law Review

Government increasingly leverages its regulatory function by embodying in law standards that are promulgated and copyrighted by nongovernmental organizations. Departures from such standards expose citizens to criminal, civil, and administrative sanctions, yet private actors generate, control, and limit access to them. Despite governmental ambitions, no one is responsible for evaluating the legitimacy of this approach ex ante and no framework exists to facilitate analysis. This Article contributes an analytical framework and proposes institutional mechanisms to implement it. Wound Debridement With 25 Khz Ultrasound, Margaret Mccarty Stanisic, Barbara Provo, David L. Larson, Luther C. Kloth

Physical Therapy Faculty Research and Publications

Several methods of wound debridement are described in the literature and are available to health care providers who specialize in wound management. Methods include the use of sharp surgical instruments; mechanical methods, such as whirlpool and pulsed lavage with suction; proteolytic and collagenolytic enzymes; autolysis; and sterile fly larvae (maggots). The use of surgical debridement is generally considered the most efficient method when performed by a skilled physician, who may in one session use his or her discretion to excise some viable tissue along with necrotic tissue in the wound. The doctrine of forfeiture by wrongdoing was carved out as an exception to the standard for the admissibility of testimonial hearsay evidence laid down in Crawford v. Washingtom . Since Crawford , the California Supreme Court granted review in two cases, People v. Giles and People v. Jiles , which applied the doctrine of forfeiture by wrongdoing. The forfeiture doctrine was originally formulated to require the accused commit an intentional act to prevent a witness from testifying, thus proving that the doctrine's nature is based on the equitable principle that no person shall profit from wrongful conduct. Municipal Separate Storm Sewer System (Ms4) Regulation Under The Federal Clean Water Act: The Role Of Water Quality Standards?, John H. Minan

San Diego Law Review

The Clean Water Act, the primary federal statute regulating water pollution, requires municipal storm water discharge permits, under the National Pollutant Discharge Elimination System program, to include provisions controlling discharges from municipal separate storm sewer systems. This article questions whether the Clean Water Act's maximum extent practicable standard is the only statutory standard given the current trend toward compliance with state water quality standards independent of the maximum extent practicable standard, and whether the Clean Water Act superseded the state water quality standards. Purpose. Red signals are typically used to signify danger. This study was conducted to investigate a situation identified by train drivers in which red signals appear yellow when viewed at long distances (∼900 m) through progressive-addition lenses.

Methods. A laboratory study was conducted to investigate the effects of defocus, target size, ambient illumination, and surround characteristics on the extent of the color misperception of train signals by nine visually normal participants. The data from the laboratory study were validated in a field study by measuring the amounts of defocus and the distances at which the misperception of the color of …

Surgical Emphysema In The Neck As A Result Of A Dental Procedure, Moghira Iqbal, Mubasher Ikram, Farhan Raza, Ninette Banday

Section of Otolaryngology, Head & Neck Surgery

We report the development of subcutaneous emphysema in a middle-aged woman that occurred several hours after she had undergone a dental restoration procedure. The patient presented to the emergency department, and she was admitted for observation and prophylactic antibiotic coverage. She recovered in 3 days without further intervention and was discharged.
