On The Use Of Historical Bathymetric Data To Determine Changes In Bathymetry: An Analysis Of Errors And Application To Great Bay Estuary, Nh, Martin Jakobsson, Andy Armstrong, Brian R. Calder, Lloyd C. Huff, Larry A. Mayer, Larry G. Ward Nov 2005

Ward

Center for Coastal and Ocean Mapping

The depth measurements that are incorporated into bathymetric charts have associated errors with magnitudes depending on the survey circumstances and applied techniques. For this reason, combining and comparing depth measurements collected over many years with different techniques and standards is a difficult task which must be done with great caution. In this study we have developed an approach for comparing historical bathymetric surveys. Our methodology uses Monte Carlo modelling to account for the random error components inherited in the data due to positioning and depth measurement uncertainties.

After Roper V. Simmons: Keeping Kids Out Of Adult Criminal Court, Ellen Marrus, Irene Merkel Rosenberg Nov 2005

After Roper V. Simmons: Keeping Kids Out Of Adult Criminal Court, Ellen Marrus, Irene Merkel Rosenberg

San Diego Law Review

When children kill, as they always have and probably always will, the state must juggle two distinct and oftentimes conflicting concerns: its police power and its parens patriae interest. These concerns are not, however, mutually exclusive. There is a delicate balance that must be maintained. Clearly, the state must incapacitate and punish children who commit serious criminal acts, but, as Simmons says, that does not mean that minors can be executed, nor, as the Authors maintain, be consigned to living death behind bars without any hope of respite. The legal system must somehow be adjusted for children.

The Unitary Waters Apprach: The Government's Misguided Attempt To Limit The Reach Of The Clean Water Act, Brad W. Blank

San Diego Law Review

This Comment will, first, determine whether the government's unitary waters approach is a viable interpretation of the SWA. Second, it will explore what characteristics should be considered to determine whether two water bodies are"meaningfully distinct." Finally, this Comment will explore the possible consequences of applying the NPDES program to water transfers between two water bodies.

The Comparative Catalyst: Reforming Graham V. Daimlerchrysler, Kevin Logan

San Diego Law Review

This Casenote examines the California Supreme Court's decision in Graham v. DaimlerChrysler concluding that the adoption of a stricter definition of "public interest" litigation and a comparative catalyst rule will serve to stem the flood of unproductive lawsuits in the high court's ill-conceived decision will otherwise unleash.

The Bottom Line On Board Diversity: A Cost-Benefit Analysis Of The Business Rationales For Diversity On Corporate Boards, Lisa M. Fairfax Nov 2005

The Bottom Line On Board Diversity: A Cost-Benefit Analysis Of The Business Rationales For Diversity On Corporate Boards, Lisa M. Fairfax

Faculty Scholarship

The Bottom Line on Board Diversity: A Cost Benefit Analysis of the Business Rationales for Diversity on Corporate Boards critically examines the business rationales for diversity in order to determine whether they can or should be used to encourage greater diversity on the boards of major corporations. The Article acknowledges the validity of some of the business rationales for diversity within corporations more generally, but questions whether those rationales apply with as much force in the context of corporate boards and the obligations board members undertake. On this point, the Article concludes that such rationales promise more, and in some …

The Billable Hours Derby: Empirical Data On The Problems And Pressure Points, Susan Saab Fortney Nov 2005

The Billable Hours Derby: Empirical Data On The Problems And Pressure Points, Susan Saab Fortney

Faculty Scholarship

This article considers the consequences of law firm use of the hourly billing method and the recent increase in billable hour requirements. Part I of this article describes the rationale and methodology of an empirical study conducted in 2005 that explored attorney work-life issues and employer efforts to assist attorneys in dealing with work-life conflicts. Part II summarizes select study findings related to billable hours requirements and pressure. Part III concludes by considering what forces and players will change the current course of conduct in which law firm leaders treat increases in billable hours expectations as a necessary evil.

Development Of Biological Reference Conditions Of Wadeable Streams In The Major Ecoregions And Subecoregions Of Georgia, Duncan L. Hughes Nov 2005

Development Of Biological Reference Conditions Of Wadeable Streams In The Major Ecoregions And Subecoregions Of Georgia, Duncan L. Hughes

Theses and Dissertations

One bioassessment tool available to resource managers to indicate NPS impairment of wadeable streams and rivers are multi-metric invertebrate indices. Such indices are assembled from metrics in broad categories that represent different aspects of community structure and function (e.g. richness, composition, tolerance/intolerance, feeding group, and habit). Indices must incorporate suites of metrics that are ecologically relevant, quantifiable, non-redundant, and that best individually discriminate between reference sites and impaired sites. More than 240 wadeable streams in Georgia were sampled during the September thru February index period using RBP protocols during three successive sample seasons (1999-2003). Ecoregional reference (minimally impaired) sites, as …

A Grasp For Unitary Space-Time Codes, Adam Panagos, Kurt Louis Kosbar Nov 2005

A Grasp For Unitary Space-Time Codes, Adam Panagos, Kurt Louis Kosbar

Electrical and Computer Engineering Faculty Research & Creative Works

Unitary space-time codes perform well at high signal-to-noise ratios on MIMO channels even when the propagation coefficients between transmitter and receiver are unknown. One method of constructing unitary space-time constellations uses a random search to find signal constellations that minimize the maximum pairwise correlation between transmitted signals. The work presented here uses a greedy randomized adaptive search procedure (GRASP) for finding good unitary space-time code constellations. Simulation results show that, on average, this technique finds codes with better correlation properties than the random search method. This new search procedure was also used to find signal constellations with better correlation properties …

Compact Autonomous Completely Explosive Pulsed Power System Based On Transverse Shock Wave Demagnetization Of Nd₂Fe₁₄B And Magnetic Flux Compression, Sergey I. Shkuratov, Evgueni F. Talantsev, Jason Baird, Allen H. Stults, Larry L. Altgilbers

Mining Engineering Faculty Research & Creative Works

The design and performance of a compact autonomous completely explosive pulsed power system based on two physical effects, the transverse shock wave demagnetization of Nd2Fe14B high-energy hard ferromagnets and magnetic flux compression, are presented. A transverse shock wave ferromagnetic generator (FMG) served as a seed source, and a compact helical magnetic flux compression generator (FCG) was used as a pulsed power amplifier. Results of a theoretical and experimental study demonstrated reliable operation of the proposed FMG-FCG system. The methodology for analytical calculation of seed current amplitude is developed.

Modulation Of Tyramine Signaling By Osmolality In An Insect Secretory Epithelium, Edward M. Blumenthal Nov 2005

Modulation Of Tyramine Signaling By Osmolality In An Insect Secretory Epithelium, Edward M. Blumenthal

Biological Sciences Faculty Research and Publications

The control of water balance in multicellular organisms depends on absorptive and secretory processes across epithelia. This study concerns the effects of osmolality on the function of the Malpighian tubules (MTs), a major component of the insect excretory system. Previous work has shown that the biogenic amine tyramine increases transepithelial chloride conductance and urine secretion in Drosophila MTs. This study demonstrates that the response of MTs to tyramine, as measured by the depolarization of the transepithelial potential (TEP), is modulated by the osmolality of the surrounding medium. An increase in osmolality caused decreased tyramine sensitivity, whereas a decrease in osmolality …

Physics Faculty Publications

A combined experimental and theoretical investigation of time- and alignment-dependent propagation of light in an ultracold atomic gas of atomic 85Rb is reported. Coherences among the scattering amplitudes for light scattering off excited hyperfine levels produce strong variations of the light polarization in the vicinity of atomic resonance. Measurements are in excellent agreement with Monte Carlo simulations of the multiple scattering process.

Modeling Fuzzy Rules With Description Logics, Sudhir Agarwal, Pascal Hitzler Nov 2005

Modeling Fuzzy Rules With Description Logics, Sudhir Agarwal, Pascal Hitzler

Computer Science and Engineering Faculty Publications

In real application scenarios, input data and knowledge is often vague. Likewise, it is often the case that exact reasoning over data is impossible due to complex dependencies between input data and target outputs. For practical applications, however, good approximations often suffice, and efficient calculation of an approximate answer is often preferable over complex processing which may take a long time to come up with an exact answer. Fuzzy logic supports both features by providing fuzzy membership functions and fuzzy IF-THEN rule bases. In this paper, we show how fuzzy membership functions and fuzzy rules can be modeled by means …

School of Geosciences Faculty and Staff Publications

GPS observations in south Iceland between 1994 and 2003 are compared with two-dimensional elastic half-space and viscoelastic coupling models for two parallel rift zones, representing the Western and Eastern volcanic zones (WVZ, EVZ). GPS data from the Hreppar block, between the WVZ and EVZ, fit a rigid block model within uncertainties. Spreading rates across the WVZ increase from 2.6 ± 0.9 mm/yr in the northeast to 7.0 ± 0.4 mm/yr in the southwest. Conversely, spreading rates in the EVZ decrease from 19.0 ± 2.0 mm/yr in the northeast to 11.0 ± 0.8 mm/yr in the southwest, the direction of ridge …

Collaboration In Support Of Curricular Innovation, Shelley Bader, Alexandra Gomes, James Michelson Nov 2005

Collaboration In Support Of Curricular Innovation, Shelley Bader, Alexandra Gomes, James Michelson

Himmelfarb Library Faculty Posters and Presentations

The migration of traditional anatomy and pathology wet labs to a digital format requires significant planning and collaboration amongst key faculty, administrative, and technology personnel. In addition to conversion of course materials, the changed format necessitated the renovation of a traditional bench lab to a state-of-the art digital classroom, significant IT investment, and ongoing coordination by library, classroom and computer resources personnel. Standardized policies and procedures were developed to guide additional requests for software to support new educational initiatives.

The H Ii Region/Pdr Connection: Self-Consistent Calculations Of Physical Conditions In Star-Forming Regions, Nicholas Paul Abel, Gary J. Ferland, G. Shaw, Peter A. M. Van Hoof

Physics and Astronomy Faculty Publications

We have performed a series of calculations designed to reproduce infrared diagnostics used to determine physical conditions in star-forming regions. We self-consistently calculate the thermal and chemical structure of an H II region and photodissociation region (PDR) that are in pressure equilibrium. This differs from previous work, which used separate calculations for each gas phase. Our calculations span a wide range of stellar temperatures, gas densities, and ionization parameters. We describe improvements made to the spectral synthesis code Cloudy that made these calculations possible. These include the addition of a molecular network with ~1000 reactions involving 68 molecular species and …

Once And Future Copyright, James Gibson Nov 2005

Once And Future Copyright, James Gibson

Law Faculty Publications

Copyright is like a well-meaning but ultimately bothersome friend, eager to help but nearly impossible to get rid of. It attaches indiscriminately to the simplest acts of expression, without regard for whether the author needs or wants its protection. This automatic propertization made sense in the print era, when mass distribution of information was an expensive process rarely undertaken by those with no plans to profit from their creativity. It makes little sense today. The following article shows that copyright's overly solicitous nature is the source of several seemingly unrelated and intractable problems - e.g., closed code, copyright as censorship, …
