Learning The Wrong Lessons From "An American Tragedy", David Bernstein

This paper is a critique of Margaret Berger and Aaron Twerski, “Uncertainty and Informed Choice: Unmasking Daubert,” forthcoming in the Michigan Law Review. Berger and Twerski propose that courts recognize a cause of action that would allow plaintiffs who claim injury from pharmaceutical products, but who do not have sufficient evidence to prove causation, to recover damages for deprivation of informed choice. Berger and Twerski claim inspiration from the litigation over allegations that the morning sickness drug Bendectin caused birth defects.

The Irrational Auditor And Irrational Liability, Adam C. Pritchard

This essay argues that less liability for auditors in certain areas might encourage more accurate and useful financial statements, or at least equally accurate statements at a lower cost. Audit quality is promoted by three incentives: reputation, regulation, and litigation. When we take reputation and regulation into account, exposing auditors to potentially massive liability may undermine the effectiveness of reputation and regulation, thereby diminishing integrity of audited financial statements. Characterization Of The Interactions Between The Active Site Of A Protein Tyrosine Kinase And A Divalent Metal Activator, Xiaofeng Lin, Marina K. Ayrapetov, Gongqin Sun

Background:

Protein tyrosine kinases are important enzymes for cell signalling and key targets for anticancer drug discovery. The catalytic mechanisms of protein tyrosine kinase-catalysed phosphorylation are not fully understood. Protein tyrosine kinase Csk requires two Mg2+ cations for activity: one (M1) binds to ATP, and the other (M2) acts as an essential activator.

Results:

Experiments in this communication characterize the interaction between M2 and Csk. Csk activity is sensitive to pH in the range of 6 to 7. Kinetic characterization indicates that the sensitivity is not due to altered substrate binding, but caused by the sensitivity of M2 binding …

The article analyses the effects of the large scale educational reform policies on teachers' professional identities, based on a review of the literature and data from a study we carried out. Professional identity crisis is placed within the broader framework of the modernity crisis. The story of this crisis (influences and causes) includes a description of the education reform of the 1990’s (LOGSE, Ley de Ordenación General del Sistema Educativo), the role played by teacher training in aggravating the problem, and the reasons secondary teachers have resisted educational change. ...

Amends the California Constitution to add a personal right to acquire and possess firearms for defense of self, family, and home. Quinoa (Chenopodium quinoa Willd.) is a staple grain for the indigenous people of the Andean region of South America with excellent nutritional qualities, including protein content. The objective of this study is to report on the development of fluorescence-tagged simple sequence repeats (SSRs) and single nucleotide polymorphisms (SNPs) to (1) genetically characterize the inherent diversity of 152 accessions of C. quinoa; (2) determine to what degree the CIP-FAO collection represents the range of genetic diversity in quinoa; and (3) test four hypotheses regarding quinoa?s center of diversity, Highland and Lowland clustering patterns, origin of Lowland varieties, and the …

Composable Models For Timing And Liveness Analysis In Distributed Real-Time Embedded Systems Middleware, Venika Subramonian, Christopher Gill, Cesar Sanchez, Henry B. Sipma

All Computer Science and Engineering Research

Middleware for distributed real-time embedded (DRE) systems has grown increasingly complex, to address functional and temporal requirements of diverse applications. While current approaches to modeling middleware have eased the task of assembling, deploying and configuring middleware and the applications that use it, a lower-level set of formal models is needed to uncover subtle timing and liveness hazards introduced by interference between and within distributed computations, particularly in the face of alternative middleware concurrency strategies. In this paper, we propose timed automata as a formal model of low-level middleware building blocks from which a variety different middleware configurations can be constructed. …
