Law Faculty Scholarly Articles

We argue that the specious justification for the invasion of Iraq -- a war based on a pretext of anticipatory self-defense -- necessarily exacerbates the inherent tendency of war to dehumanize and humiliate the enemy. This tendency is particularly evident in the variant of anticipatory self-defense that we have denominated as "capacity preemption," a type of claim that by definition depends upon characterizations of the opponent as utterly inhuman.

Calvary Baptist Church has historically been a disciple making church. In recent years, however, interest and attendance has waned and church growth has plateaued. In an attempt to encourage new growth, revitalize small group discipleship training, and direct new leadership into ministry opportunities, this dissertation asserts that spiritual growth developed through a relational approach to sequential and intentional discipleship training for spiritual formation will help Christian leaders mobilize believers for ministry Chapter two examines the disciple making approaches of both the Old and New Testaments with Jesus' process being the primary example. This Article surveys noteworthy cases in the areas of corporate, securities, and partnership law decided during the survey period by the Georgia Supreme Court, the Georgia Court of Appeals, the United States Court of Appeals for the Eleventh Circuit, and the United States district courts located in Georgia. This Article also summarizes recent enactments by the Georgia General Assembly to the Official Code of Georgia Annotated ("O.C.G.A.") with respect to banking and finance laws.

This survey period saw major changes to domestic relations law. With the political changes in the state legislature came sweeping reforms to what seemed to be deeply entrenched laws. Although Georgia law presently requires appeals of all domestic relations cases occurring through the discretionary application process, the Georgia Supreme Court extended its 2003 pilot project into its third year, agreeing to accept all "non-frivolous" applications filed in divorce and alimony cases. As a result, those interested in domestic relations law have benefited from many more substantive decisions from the appellate courts on a variety of issues. Revisions to the Uniform …

The Chairman's Advisory Council of the State Board of Workers' Compensation again submitted significant legislation for 2005. Perhaps the most significant amendment to the Workers' Compensation Act concerns the determination of catastrophic designation. If an injury has not already been accepted as a catastrophic injury by the employer, and the authorized treating physician has released the employee to return to work with restrictions, there will be a rebuttable presumption, during a period not to exceed 130 weeks from the date of injury, that the injury is not a catastrophic injury. Sequence comparison is one of the most primitive operations used in bio-informatics. It is used as a basis for many other complex manipulations in the field of Computational Molecular Biology. Many methods and algorithms were developed to compare and align sequences effectively. Most of these methods use linear comparison and some standard scoring schemes to calculate the similarity between sequences. We described an alternative approach to compare sequences based on the correlogram method. This method has already been used in the past for comparing images. A Novel Method For Determination Of Dielectric Properties Of Materials Using A Combined Embedded Modulated Scattering And Near-Field Microwave Techniques-Part I: Forward Model, Dana M. Hughes, R. Zoughi

The use of combined embedded modulated scattering technique and near-field microwave nondestructive testing techniques is investigated as a novel method for evaluating the dielectric properties of a material. The forward formulation for determining the reflection coefficient at the aperture of a waveguide radiating into a dielectric half-space in which a PIN diode-loaded dipole (i.e., modulated scattering technique probe) is embedded is presented. This formulation is based upon calculating the near-field coupling between the waveguide and the dipole as a mutual impedance.

The use of combined embedded modulated scattering technique and near-field microwave nondestructive testing techniques is investigated as a novel method for evaluating the dielectric properties of a material. The forward formulation for determining the reflection coefficient at the aperture of a waveguide radiating into a dielectric half-space in which a PIN diode-loaded dipole (i.e., modulated scattering technique probe) is embedded was presented in Part I of this paper. Here, in Part II, the recalculation of the dielectric properties, using the results of the forward model, is presented along with some associated experimental results.
