Who Should Recover What In A Securities Fraud Class Action?, Richard A. Booth Marbury Research Professor Of Law

In this article, I argue that securities fraud class actions (SFCAs) should not be treated as class actions but rather should be treated as derivative actions. In addition, I argue that such actions should be dismissed unless it appears that insiders (including the company itself) have enjoyed gains from trading during the fraud period. Both of these conclusions are based on the fundamental argument that (1) securities law seeks to protect the interests of reasonable investors, (2) reasonable investors diversify, and (3) diversified investors are effectively protected against the supposed financial harms of securities fraud by virtue of being diversified, …

A State-Supported, Merit-Based Scholarship Program That Works, Robert Ackerman, Martha Young, Rodney Young

Journal of Student Financial Aid

The Millennium Scholarship Program, which provides merit-based scholarships for Nevada's students, is designed to increase college participation, college persistence, and the number of in-state students enrolling in state institutions of higher education (IHEs). Data gathered over the past five years reflect that Nevada's Millennium Scholarship Program has successfully met its goals. Further, it has improved student quality in IHEs, as is evident by a lower percentage of students taking college remedial courses. A major focus of this study is to demonstrate how Nevada's merit-based scholarship program may serve as a model for other states attempting to improve college participation.

This project is a metaevaluation or critique of an evaluation of an intermediate course in a second language curriculum. In this report, the intermediate course evaluation is described to provide a basis for understanding the metaevaluation. Then the metaevaluation is presented. The evaluation was the first stage of a department-approved and college-supported curriculum redesign project to improve the quality of a second language curriculum in terms of instructional materials, methodological approaches, and pedagogical practices to promote optimal second language learning gains. Through the evaluation, strengths and weaknesses of the curriculum were identified so that these issues could be addressed during …

Stem cell transplant is often considered the last hope for the survival for many cancer patients. The CD34+ cell content of a collection of stem cells has appeared as the most reliable indicator of the quantity of desired cells in a peripheral blood stem cell harvest and is used as a surrogate measure of the sample quality. Factors predicting the yield of CD34+ cells in a collection are not yet fully understood. Many companies rely on successful product development as a means to increase their revenues and expand their operations. Market pull, the most common form of product development, begins with a specific customer, and focuses on how to satisfy that customer's needs. Technology push is a product development process where a technology is first discovered, then embodied in products that may be marketed to specific customers. Technology push presents several obstacles not encountered in market pull processes, such as a lack of a defined market, lack of established processes and difficulty in execution. Capital Flight From The Philippines, 1970-2002, Edsel L. Beja Jr

Capital flight is defined as the movement of capital from resource-scarce developing countries to avoid social controls. It is measured as net unrecorded capital outflow, or the residual between officially recorded uses and sources of funds. Total capital flight from the Philippines was estimated at USD 138 billion (in 1995 constant prices) for the period 1970-2002. Including imputed interest earnings, the stock of capital flight as of 2002 was USD 218 billion. Switchgrass (Panicum virgatum L.) is a warm-season (C4) perennial grass and a potential bioenergy crop. On-farm switchgrass field scale trials, which were initiated to obtain economic production information for switchgrass grown as a bioenergy crop in the northern Plains, provided information on establishment year stands and post-establishment year yields and stands both within and across fields and were used to determine if a stand threshold exists for switchgrass grown as a biomass energy crop. Switchgrass was seeded in 10 cropland fields, ranging in size from 3 to 9.5 ha, in Nebraska, South Dakota, and North Dakota in 2000 and …

Performance Analysis Of Common Detectors For Shaped Offset Qpsk And Feher's Qpsk, Tom Nelson, Michael D. Rice, Erik Perrins

Sponsorship: US Air Force Grant FA9302-05-C-0001. A detector architecture capable of detecting both shaped offset quadrature phase shift keying (SOQPSK-TG) and Feher's quadrature phase shift keying (FQPSK-JR) is developed and analyzed. Both modulations are embodied as fully interoperable modulations in the Interrange Instrumentation Group (IRIG) standard IRIG-106. It is shown that the common detector achieves near optimal bit error rate performance without knowledge of which modulation is used by the transmitter. The detection techniques are based on a common trellis-coded modulation representation and a common continuous phase modulation (CPM) representation for these two modulations. Statnamic Lateral Load Testing And Analysis Of A Drilled Shaft In Liquefied Sand, Seth I. Bowles

Three progressively larger statnamic lateral load tests were performed on a 2.59 m diameter drilled shaft foundation after the surrounding soil was liquefied using down-hole explosive charges. An attempt to develop p-y curves from strain data along the pile was made. Due to low quality and lack of strain data, p-y curves along the test shaft could not be reliably determined. Therefore, the statnamic load tests were analyzed using a ten degree-of-freedom model of the pile-soil system to determine the equivalent static load-deflection curve for each test.
