Leveraging Knowledge Assets: Can Law Reform Help?, Margaret Ann Wilkinson, Mark Perry Jan 2005

Leveraging Knowledge Assets: Can Law Reform Help?, Margaret Ann Wilkinson, Mark Perry

Canadian Journal of Law and Technology

This paper asks whether there is a need for law-makers to aid in the efficient transition to a new knowledge-based economic and social environment through the use of intellectual property devices. The use of such devices was effective in assisting with the transition to an industrial society that, combined with developments in commercial law and secured transactions, further fuelled economic growth in Canada. Can these disparate areas of law be brought together to provide opportunities for the growth of knowledge-based business? The Law Commission of Canada instigated a two-part investigation into these questions. The investigation culminated in the Commission's report …

Genetic Use Restriction (Or Terminator) Technologies (Gurts) In Agricultural Biotechnology: The Limits Of Technological Alternatives To Intellectual Property, Chidi Oguamanam Jan 2005

Genetic Use Restriction (Or Terminator) Technologies (Gurts) In Agricultural Biotechnology: The Limits Of Technological Alternatives To Intellectual Property, Chidi Oguamanam

Canadian Journal of Law and Technology

This article examines the adequacy of terminator technology as a potential substitute for traditional intellectual property. It acknowledges that the technology provides a stronger protection and reward mechanism than that offered by the traditional intellectual property rights regime. However, terminator technology or any other technology for that matter, is outside the pantheon of intellectual property regimes. Fundamentally, terminator is a technological answer to the quest by private sector interests to improve appropriability of returns on investments in agrobiotech. It potentially represents a panacea to the long standing industry struggle over the profitability of private research in agrobiotech and the need …

Marine-Salvage Law And Marine-Peril-Related Policy: A Second-Best And Third-Best Economic-Efficiency Analysis Of The Problem, The Law, And The Classic Landes And Posner Study, Richard S. Markovits

Faculty Scholarship

This Article (1) delineates the different kinds of allocative costs that marine-peril contingencies can generate and the different kinds of marine-peril-related decisions that can generate allocative inefficiency (marine-salvage-operation investment decisions; decisions about whether to offer to attempt or to actually attempt marine rescues; decisions about the character of the marine-rescue attempts that are made; decisions by potential rescuees to accept or reject offers of marine-rescue attempts; and decisions by potential rescuees to make or reject various marine-peril-avoidance moves); (2) defines the formal meaning of "the most-allocatively-efficient response a State can make to marine-peril contingencies;" (3) explains why, standing alone, judge-prescribed …

Positive Solutions For A Fourth Order Boundary Value Problem, Bo Yang Jan 2005

Positive Solutions For A Fourth Order Boundary Value Problem, Bo Yang

Faculty Articles

We consider a boundary value problem for the beam equation, in which the boundary conditions mean that the beam is embedded at one end and free at the other end. Some new estimates to the positive solutions to the boundary value problem are obtained. Some sufficient conditions for the existence of at least one positive solution for the boundary value problem are established. An example is given at the end of the paper to illustrate the main results.

African Americans' Opinions About Human-Genetics Research, Paul Achter, Roxanne Parrott, Kami Silk Jan 2005

African Americans' Opinions About Human-Genetics Research, Paul Achter, Roxanne Parrott, Kami Silk

Rhetoric and Communication Studies Faculty Publications

Background: Research on attitudes toward genetics and medicine registers skepticism among minority communities, but the reasons for this skepticism are not well known. In the past, studies linked mistrust of the medical system to historical ethics violations involving minority groups and to suspicions about ideological premise and political intent.

Methods: To assess public knowledge, attitudes, and behavior regarding human-genetics research, we surveyed 858 Americans onsite in four community settings or online in a geographically nonspecific manner.

Results: Compared to participants as a whole, African Americans were significantly more likely to believe that clinical trials might be dangerous and that the …

Beyond Surrender: Marian Sims, Francis B. Simkins, And Revisionism In Reconstruction South Carolina, David B. Parker Jan 2005

Beyond Surrender: Marian Sims, Francis B. Simkins, And Revisionism In Reconstruction South Carolina, David B. Parker

Faculty Articles

Historian Francis Butler Simkins's 1932 book 'South Carolina during Reconstruction' presented one of the earliest revisionist examinations of Reconstruction. Simkins suggested Reconstruction failed because it was not radical enough, and carpetbaggers could have succeeded had they confiscated land and destroyed the South's caste system. Simkins elaborated his views in his 1939 essay in the 'Journal of Southern History,' his paper "The Everlasting South" delivered to the 1946 meeting of the Southern Historical Association, and his 1954 presidential address to the Southern Historical Association. Simkins corresponded with novelist Marian McCamy Sims, who wrote seven novels set among the upper- and middle-class …

Policing L.A.'S Skid Row: Crime And Real Estate Redevelopment In Downtown Los Angeles [An Experiment In Real Time], Bernard E. Harcourt Jan 2005

Policing L.A.'S Skid Row: Crime And Real Estate Redevelopment In Downtown Los Angeles [An Experiment In Real Time], Bernard E. Harcourt

Faculty Scholarship

In this article, I document the present. I make a record, with photographs, interviews, maps, and observations of L.A.'s Skid Row as it is today. Drawing on the tradition and methods of critical socio-legal studies, I also explore the constitutive dimensions of deviance. I investigate the possible attraction that disorderliness and criminality may have to today's urban pioneers. I explore the idea that deviance and disorder may become, in some corners, a consumable good to urban dwellers. And I do this by drawing on numerous hours of personal observation on the streets of L.A.'s Skid Row, on interviews of service …

The Effects Of Cadmium On Levels Of Glucose In Serum And Glycogen Reserves In The Liver And Muscle Tissues Of Cyprinus Carpio (L., 1758), Bedi̇i̇ Ci̇ci̇k, Kenan Engi̇n Jan 2005

The Effects Of Cadmium On Levels Of Glucose In Serum And Glycogen Reserves In The Liver And Muscle Tissues Of Cyprinus Carpio (L., 1758), Bedi̇i̇ Ci̇ci̇k, Kenan Engi̇n

Turkish Journal of Veterinary & Animal Sciences

The common carp (Cyprinus carpio L., 1758) was exposed to sublethal concentrations of cadmium (0.05, 0.1, 0.5 and 1.0 mgl^{-1}) for 10 days. The levels of serum glucose and glycogen reserves in the liver and muscle tissues were measured both in fish exposed and not exposed to Cd. The levels of glycogen reserves in the liver and muscle tissues were significantly (P < 0.05) decreased in fish exposed to sublethal concentrations of Cd compared with the levels measured in the control groups. The decrease in glycogen levels in the liver and muscle tissues under the highest metal concentration (1.0 mgl^{-1}) were 24% and 29%, respectively. The blood serum glucose levels of fish exposed to Cd were significantly (P < 0.05) increased compared with the levels measured in the control groups. This increase was correlated with the increase in water Cd concentrations.

In Vitro Efficacy Of Azithromycin And Roxithromycin Against Toxoplasma Gondii, Mehmet Tanyüksel, Ahmet Levent Baş, Engi̇n Araz, Mustafa Özyurt, Ali̇ Albay, Cahi̇t Babür

Turkish Journal of Veterinary & Animal Sciences

Toxoplasmosis is a common problem, accounting for significant morbidity in developing countries. Conventional treatments are associated with frequent relapses and with additional problems including undesirable side effects. Better-tolerated and more effective drugs are clearly needed. The aim of this study is to evaluate the in vitro efficacy of azithromycin and roxithromycin against Toxoplasma gondii using acridine orange in the fluorescence microscopic assay. It was found that azithromycin and roxithromycin had significant microbicidal activity (P < 0.05). In conclusion, this observation should be assessed carefully in future clinical trials involving a large number of cases with toxoplasmosis.

Isolation Of Listeria Monocytogenes From Fish Intestines And Rapd Analysis, Hasan Basri̇ Ertaş, Engi̇n Şeker

Turkish Journal of Veterinary & Animal Sciences

One hundred and fifty fish caught from Keban Dam Lake were examined for the presence of Listeria monocytogenes. A random amplified polymorphic DNA (RAPD) assay using a random primer was performed to detect genetic variations among L. monocytogenes isolates. The selective enrichment procedure followed by selective isolation was used for listeria isolation from fish intestines. Ten (6.6%) L. monocytogenes were isolated and identified from fish intestines. Two different band profiles were obtained by the RAPD analysis of the isolates. The results indicated that the isolates might have originated from different sources, and fish contaminated with L. monocytogenes may cause serious …

Investigations On Drift-Net Fishery For Swordfish (Xiphias Gladius L.) In The Aegean Sea, Okan Akyol, Mustafa Erdem, Vahdet Ünal, Tevfi̇k Ceyhan

Turkish Journal of Veterinary & Animal Sciences

This study reports an investigation carried out on swordfish drift-net fishery at 2 main swordfish fishing ports, Sivrice (northern) and Fethiye (southern), in the Aegean Sea in 2001-2002. Forty-five boats are used for swordfish fishing in the Turkish Aegean Sea. In these major areas, the highest number of boats 6-10 m in length and 11.5-80 hp in engine power was in the Sivrice area, while the highest number 10-14 m in length and 85-135 hp in engine power was in the Fethiye area. Almost all of the boats were made of wood. Swordfish drift-netting accurs in practice between Sivrice and …

El Niño Causes Dramatic Outbreak Of Paederus Dermatitis In East Africa, Ingeborg M.C.J. Van Schayk, Ruben O. Agwanda, John I. Githure, John C. Beier, Bart G.J. Knols

All Peer-Reviewed Publications

An outbreak of Paederus sabaeus rove beetles in Kenya during the 1997-1998 El Niño resulted in a dramatic increase of vesicular dermatitis in its capital Nairobi. The beetle, popularly called ‘Nairobi Fly’, contains a potent toxic fluid that causes epidermolysis and acute conjunctivitis. A cross-sectional epidemiological study involving 1,208 Nairobi residents was conducted to determine the health impact of this outbreak. The results showed that one-third of the Nairobi population were infected during this period. The majority of the respondents reported lesions on exposed body parts above the shoulders. Disfiguring, painful blisters and skin rashes in and around the facial …

Environmental Impacts Of Technological Change In Bangladesh Agriculture: Farmers' Perceptions, Determinants, And Effects On Resource Allocation Decisions, S Rahman Jan 2005

Environmental Impacts Of Technological Change In Bangladesh Agriculture: Farmers' Perceptions, Determinants, And Effects On Resource Allocation Decisions, S Rahman

School of Geography, Earth and Environmental Sciences

This article measures the impact of modern technology adoption in raising farmers' environmental awareness and the impact of farmers' environmental awareness on resource use by utilizing survey data from 21 villages in three agro‐ecological regions of Bangladesh. The econometric analysis is based on the application of the Tobit model explaining farmers' environmental awareness in the first stage and a profit function examining environmental awareness and resource use relationships in the second stage. Results reveal that the “level” and “duration” of involvement with modern technology raises farmers' environmental awareness, and that farmers' environmental awareness reduces resource use including chemicals. Farmers, who …

Guidelines For Data Collection Techniques And Methods For Roadside Station Origin-Destination Studies, Bryan P. Guy, Jon D. Fricker Jan 2005

Guidelines For Data Collection Techniques And Methods For Roadside Station Origin-Destination Studies, Bryan P. Guy, Jon D. Fricker

JTRP Technical Reports

Origin-Destination studies are often used in transportation planning to determine the travel patterns (origin-destination matrix) of vehicles and goods in a particular area. Given these travel patterns, the impacts of alternative solutions to current and future transportation problems can be evaluated. Therefore, it is important that the travel patterns be accurately measured. However, it is not always clear what data collection method should be used to obtain the type of data needed, while maximizing quality and minimizing the time and cost. The objective of this research is to review both conventional and experimental techniques for roadside station OD studies, and …

The Promise Of Internet Intermediary Liability, Ronald J. Mann, Seth R. Belzley Jan 2005

The Promise Of Internet Intermediary Liability, Ronald J. Mann, Seth R. Belzley

Faculty Scholarship

The Internet has transformed the economics of communication, creating a spirited debate about the proper role of federal, state, and international governments in regulating conduct related to the Internet. Many argue that Internet communications should be entirely self-regulated because such communications cannot or should not be the subject of government regulation. The advocates of that approach would prefer a no-regulation zone around Internet communications, based largely on the unexamined view that Internet activity is fundamentally different in a way that justifies broad regulatory exemption. At the same time, some kinds of activity that the Internet facilitates undisputedly violate widely shared …

Life Cycle Cost Analysis For Indot Pavement Design Procedures, Geoffery Lamptey, Muhammad Z. Ahmad, Samuel Labi, Kumares C. Sinha Jan 2005

Life Cycle Cost Analysis For Indot Pavement Design Procedures, Geoffery Lamptey, Muhammad Z. Ahmad, Samuel Labi, Kumares C. Sinha

JTRP Technical Reports

Given the aging of highway pavements, high traffic levels, and uncertainty of sustained preservation funding, there is a need for balanced decision-making tools such as LCCA to ensure long-term and cost-effective pavement investments. With driving forces such as ISTEA 1991, the NHS Act of 1995, and TEA-21, LCCA enables evaluation of overall long-term economic efficiency between competing alternative investments and consequently has important applications in pavement design and management. It has been shown in past research that more effective long-term pavement investment could be made at lower cost using LCCA. Current LCCA-based pavement design and preservation practice in Indiana could …

Nurses, My Family & Elvis, Cristle Coleman-Griwach Jan 2005

Nurses, My Family & Elvis, Cristle Coleman-Griwach

Theses

This collection of short stories will focus primarily on nurses from the turn of the last century to the present. Some of the stories are fiction and some are based on experiences of nurses I have known. There two stories unrelated to nursing, one is about how my father helped launch El vis Presley's career, the other is about my family.

The goal of the collection is to illustrate the different roles and personalities of nurses. The first story, "A Feather in Her Bonnet" is set in the early nineteen-hundreds. A seemingly innocent feathered bonnet on the head of a …
