This article proposes that we view freedom of religion as a specific application area of more general basic liberties such as freedoms of thought, expression, association, assembly, movement, privacy, political participation, and economic activity. Separate enumeration of freedom of religion in national and international bills of rights may be useful, but it is not indispensable. In this respect freedom of religion is more like scientific freedom or artistic freedom than like freedom of expression. Recognizing that separate enumeration of freedom of religion is dispensable has salutary consequences for how we conceive and justify freedom as it applies to religion. First, …

The legality and propriety of exempting religiously motivated conduct from otherwise applicable legal norms is the subject of ongoing scholarly, judicial, and legislative debate. The issue is particularly thorny when it arises in a legal system deeply committed to the concept of equality. The Eagle Protection Act, which exempts Native Americans religious practitioners who are members offederally recognized tribes from its general prohibition on the taking and use of bald and golden eagle feathers, provides an interesting context in which to examine that debate. There is an enduring legal myth that members of minority religious groups face a decidedly uphill battle in securing accommodation for or even tolerance of unconventional religious practices, expression, or values from the courts. According to conventional wisdom, traditional Christian believers may anticipate a more hospitable welcome from the judiciary when asserting claims of conscience or religious liberty. However based upon an empirical study of religious liberty decisions in the federal courts, the proposition that minority religions are less successful with their claims was found to be without empirical support, at least in the modern era and in the lower …

A Practical And Pragmatic Approach To Freedom Of Conscience, Martin H. Belsky
University of Colorado Law Review
Using a series of anecdotes and illustrations, the author posits that freedom of conscience, broadly defined, can only be protected, if at all, by assertive individual and group action. Such action must be not just against government interference but also against nongovernmental or private activities as well as intimidation. Professor Belsky urges individual balancing of the freedom of conscience and other legal, governmental and societal interests. This balancing is a form of "constitutionalism," and when necessary must be followed up by enforcement through personal action.

In the current communications age, the capabilities of mobile devices are increasing. The mobiles are capable of communicating at data rates of hundreds of mbps on 4G networks. This enables playback of rich multimedia content comparable to internet and television networks. However, mobile networks need to be spectrum-efficient to be affordable to users. Multimedia Broadcast Multicast Systems (MBMS) is a wireless broadcasting standard that is being drafted to enable multimedia broadcast while focusing on being spectrum-efficient. The purpose of this research study was to explore and increase understanding of the ways in which sub-cultural groups within a community college may differently experience, respond to, and influence the organization's efforts to engage in purposeful change. To accomplish this purpose, an exploratory case study was conducted focusing on a medium-sized community college which was engaged in a multi-faceted institution-wide planned change initiative throughout the duration of the study. The mam objective of the work described in this thesis is isolation and characterization of novel neuroactive peptides from the venom of cone snail species. The first section is an introduction about cone snails. The first chapter is dedicated to the analysis of the milked venom obtained from three different specimens of C. ermineus which is the only fish-hunter cone snail from the east Atlantic region. MALDI-TOF mass spectrometry analysis of two specimens showed an identical profile with all components of the venom being novel conopeptides. The third specimen showed a mass spectrometry profile with molecular weights corresponding to already …

The local buckling failure mechanism and subsequent debond propagation in sandwich columns and panels with composite face sheets containing a face-to-core debond is experimentally, analytically, and numerically analyzed. The experimental investigation is based on a comprehensive test program to examine local buckling failure and fracture toughness of sandwich specimens consisting of glass/epoxy face sheets over various density PVC foams and a balsa wood core. Elastic foundation and finite element models are developed for prediction of the local buckling load of sandwich columns and panels containing an implanted debond at the face/core interface. A new technique was devised that produces a LIDAR based predevelopment Digital Elevation Model and offers a more superior visualization, of the natural landscape prior to development, than the Bare Earth Model produced by Florida International University's Hurricane Center. Two locations in southeastern Florida have been chosen for this study. The first site is utilized as a control for testing the model and contains a present day ridge system that runs north and south through the Boca Raton cemetery. The aim of this thesis is to develop a theory for non stationary propulsor flow noise. The model which is proposed is based on Amiet's paper "Acoustic Radiation from an Airfoil in a Turbulent Stream" [1], which describes broad band noise when a simple model of airfoil interacts with a turbulent flow, under the assumption of stationarity. The Karhunen-Loeve method provides a set of modes which describe the turbulent flow without the assumption of stationarity. Conus dalli is a cone snail species that preys upon mollusks (molluscivorous) and it belongs to the same clade as the better studied Conus textile. They have different biogeographical distribution: C. dalli is restricted to the Panamic area; whereas C. textile is a widespread species found from the Red Sea to Hawaii. The venom of C. textile is an extremely complex mixture of conopeptides characterized for their very high content of modified amino acids; particularly, for their high content of gamma-carboxy glutamate (Gla). French feminist writer and theorist, Monique Wittig, theorizes from a nonessentialist, materialist lesbian position to posit categories of sex and gender as social constructions, thereby contesting what she terms the heterosexual regime. Because her social theory and literary praxis inform the thinking of leading figures associated with Queer theory, such as Judith Butler, Eve Kosofsky Sedgwick, and Teresa de Lauretis, Wittig is often considered a precursor to the Queer theory movement. Intrusion Detection Systems (IDS) are security tools which monitor systems and networks for malicious activity. In saturated network links the amount of data present for analysis can overwhelm them, resulting in potentially undetected attacks. Many of these network links contain significant amounts of multimedia traffic which may seem to contribute to the problem, however our work suggests otherwise. This thesis proposes a novel method to classify and analyze multimedia traffic in an effort to maximize the efficiency of IDS. Despite serious challenges and critics, neither the theoretical utility nor the normative power of the dichotomy has totally disappeared over the decades. The dichotomy has been advocated on the grounds that the dichotomous division of labor and authority between elected leadership and administrative leadership is prerequisite for autonomous (and effective) public administration. This thesis examines how post-communist Romanian women's magazines engender a particular representation of women in transition. This is both a challenge to the previous communist ideology which promoted an asexual type of femininity, and the product of a hegemonically masculine culture revived by the reality of the newly born capitalist Romanian society. By means of a feminist semiotic analysis, the study concentrates on visual and textual discourses of femininity in two popular Romanian women's magazines. There is a linguistic homoerotic flirtation between the characters of Viola and Olivia in Shakespeare's Twelfth Night. Through Jane Gallop's analysis of Jacques Lacan, readers can view the eroticized exchange between these female characters by observing the manner in which each character utilizes both words containing feminine roots or metaphors that are feminine in nature. While Viola and Olivia express female-female desire, they search for their own identities in the patriarchal system that they must exist. This inquiry considers the nature of the treaty ratification debates in France, England, and the United States from the June 28, 1919 signing of the Versailles Treaty until its final repudiation by the U.S. Senate in March 1920. It has two main linked objectives: to examine the agendas of Clemenceau, Lloyd George, and Wilson and the strategies each employed in their attempts to convince their constituents to accept the treaty package, and to argue that the peace these executives negotiated was by no means a foregone conclusion at the treaty signing since legislative approval was required in each case. Tabloids, often defined by the half-broadsheet size of regular newspapers, feature titillating, sensationalized stories of crime and/or scandal offered in a piquant manner. The exploratory study asks how the tabloid style was manifested in the coverage of the Clinton/Lewinsky scandal of 1998 and related news, thereby fostering a hegemony in which the citizenry was distracted from more important political issues and events. Henry James wrote several works fictionalizing ideas of authorship. No critics have yet looked at "The Middle Years" as an affirmation of the role of the author. Julie Rivkin and Joyce Carol Oates are critics I cite as valuable support to my interpretation of "The Middle Years," a short story that gives us insight into Henry James's critical theory. To better characterize the accumulation of permanent deformation in a granular material, 40 Consolidated Drained (CD) triaxial tests (14 static and 26 cyclic) were performed under various stress conditions. A Digital Image Correlation (DIC) technique was utilized in some Repeated Load Triaxial (RLT) tests to measure global and localized strains visually in a non-contact manner. Additionally, the experimentally determined resilient material properties were used in a finite element based pavement modeling software called MICH-PAVE. This study sought to investigate the benefits of using children's literature in fifth grade classrooms in order to promote greater student interest, engagement, and understanding of key grade level history standards. In the central nervous system (CNS), the rate-limiting step in GABA synthesis is the reaction catalyzed by L-glutamic acid decarboxylase (GAD). Alternations in the level of GABA or GAD have been linked to various neurological disorders. Mammalian species express two isoforms of GAD, namely, GAD65 and GAD67, referring to GAD with a molecular weight of 65 kDa and 67 kDa, respectively. Objective. This study examined the association between commuting time and/or distance and body mass index (BMI), and dietary and exercise behaviors in college students. Methods. Behaviors were assessed using self-report, dietary screeners, and an exercise questionnaire in 400 college students ages 18--35 taking classes on a commuter campus. BMI was determined through measurement of height and weight. Results. Pearson correlations revealed no relationship between commuting time and/or distance and BMI, and dietary and exercise behaviors. However, total meals eaten out the week prior and number of meals obtained from any away-from-home food vendors was related to total, saturated, and percent …

In practice, software measurements are often used as a resource to model and comprehend the quality of software.
