Evaluating Bundled Discounts, Thom Lambert

This article identifies and critiques five attempts courts and commentators have made at articulating such an evaluative approach and, finding each approach lacking, proposes an alternative evaluative approach. The proposed approach would presume the legality of above-cost bundled discounts but would permit that presumption to be rebutted by a plaintiff that proved certain facts demonstrating that it had fully exhausted its competitive options and was, or was likely to become, as efficient as the discounter. The recommended approach would be easily administrable and would include clear safe harbors to ensure that procompetitive bundled discounting is not discouraged.

Depending on how one classifies market intervention, trade liberalization disciplines can be lenient or strict. Perhaps the most important distinction in this respect is that between government intervention labeled as a "market access restriction" and that defined as "domestic regulation." Both the GATT and the GATS declare market access restrictions (such as import quotas or limitations on the number of service suppliers) to be, in principle, prohibited. In contrast, domestic regulations (such as internal taxes, health standards, and safety requirements) are treated with much more deference. They are, in essence, only prohibited when discriminatory or more trade restrictive than necessary. …

Epicureans distinguish natural desires, which have their origin in the body itself, from empty desires which are imposed by society. Natural desires allow a person to enjoy pleasures free from anxiety and worry. Empty desires such as those for status or luxury are endless and lead to a life of frustration, resentment and anxiety. In this paper I apply this distinction to musical experience and differentiate between the genuine enjoyment of music and musical experience tainted by empty desires.

AbstractA nationwide programme to prevent and manage bullying in Irish schools, based on that implemented in Norway in 1996, is currently being developed, and pilot work with a sample of primary schools within a single county of Ireland has been conducted and evaluated (the staff and pupils of 42 primary schools having been involved). A network of professionals (11 teachers) were trained to co‐ordinate the anti‐bullying programme in the schools, subsequent activities involving their training teachers (a total of 197) and parents in three to five schools each. The study explored possibilities for change in the Early Childhood Teacher Education Program in the John H. Lounsbury School of Education at Georgia College & State University (GC&SU). Concern for the lack of diversity in the teaching population increased when the demographics for preservice teachers were examined. Reports by Marilyn Cochran-Smith, Danne Davis, and Kim Fries (2004) show that there is an overwhelming presence of whiteness in teacher education. These data show that, depending upon the institution and location, 80-93% of the students enrolled in collegiate education programs are white (Cochran-Smith, Davis, & Fries, 2004). The accurate identification of Salmonella enterica subsp. enterica serovar Typhi variants that fail to express the capsular polysaccharide, Vi, is an important and much discussed issue for medical microbiology. We have tested a multiplex PCR method which shows the presence or absence of the genetic locus required for Vi expression. Of 2,222 Salmonella serovar Typhi clinical isolates collected from patients' blood over a 4-year period in a region of Pakistan where typhoid is endemic, 12 tested negative for Vi expression by serological agglutination. However, only 1 of these 12 was Vi negative by the multiplex PCR method. This result was …

This paper reviews three distinct strategies in recent economics for using the concept of social identity in the explanation of individual behavior: Akerlof and Kranton’s neoclassical approach, Sen’s commitment approach, and Kirman et al.’s complexity approach. The primary focus is the multiple selves problem and the difficulties associated with failing to explain social identity and personal identity together. The argument of the paper is that too narrow a scope for reflexivity in individual decision making renders the problem intractable, but that enlarging this scope makes it possible to explain personal and social identity together in connection with an individual behavior …

One of the greatest impediments affecting growth and development of bedding plants is high temperature stress. The deleterious effects of high temperature stress are the most pronounced during plug transplant and/or during the transition period from the nursery to the landscape. High temperature stress responses were investigated in Salvia splendens and Viola x wittrockiana to determine the morphological and physiological mechanism associated with the heat tolerance. Teacher immediacy has been positively associated with many desirable academic outcomes, including quality student-teacher relationships, student participation in the classroom and in extra-class interaction, and increased student learning. Thus, scholars have consistently encouraged educators to increase their use of immediacy in contacts with students. However, some previous research found that high levels of teacher immediacy can be problematic in relationships and detrimental to desirable educational outcomes. Immediacy behavior tends to promote personal relationships and inclusion. However, excessive immediacy may change the meaning that students receive from the behavior. Since polymer modified asphalt cement (PMAC) has been employed for a decade, the lifetime and wear on some of these pavements is reaching a stage where resurfacing is necessary. This research focuses on the characterization of aged polymer modified asphalt cements (PMAC) to evaluate their potential for recycling. A styrene-butadiene-styrene tri-block (SBS) polymer modified asphalt cement was selected and characterized using standard asphalt binder qualification techniques, i.e., the Superpave PG protocol. We developed a procedure to characterize the relative concentration of polymer in asphalt cements by gel permeation chromatography (GPC). Place is central to the study of the American South. The question of the meaning and power of place underpinned the earliest efforts to define and understand the region, and place remains a crucial concept in an ongoing process of regional identification and inquiry. This study explores southern place autobiographically, historically, and theoretically in order to illuminate the subjective and social dimensions of place and to promote progressive conversation in the region. An Edwardsiella ictaluri strain with disruption of ureG was identified through the use of signature tagged insertion mutagenesis as being attenuated for virulence in the channel catfish host. Sequencing of the flanking regions surrounding the insert showed that the gene was part of a urease gene complex that included ureE, ureF, ureG, ureD, ureI, and an ammonium transporter homologue. The ureG gene encodes a GTP-binding accessory protein which is thought to function in energy-dependent urease assembly. The ureG mutant strain was found to be attenuated for mortality, persistence, and for the ability to establish infection in a competition challenge during …

Research shows that many inner city fathers work a variety of jobs to make a living for themselves and their families. While some fathers work in traditional jobs that are regulated and taxed, others generate income "off-the-books" or through illegal work called "hustles." This thesis uses data from the Fragile Families and Child Wellbeing Study to assess the impact of hours worked in regular jobs, off-the-books ventures, and illicit hustles on fathers' involvement with their eighteen-month old child. The regression results show that fathers who spend increasing hours hustling tend to be less involved with their children than fathers who …

We have examined the effects of the cytokines tumor necrosis factoralpha (TNF), transforming growth factorbeta (TGFbeta) and the effect of cyclooxygenase inhibitor ibuprofen on prostaglandin and 15-HETE biosynthesis by normal adult human osteoblast-like (hOB) cells. In the present studies, conditioned media harvested from hOB cell cultures were assayed by eicosanoid specific EIAs to determine quantitatively the effects of cytokines on PGE2, 6-keto-PGF1alpha, PGF2alpha, PGD2, thromboxane (TXB2) and on 15-HETE biosynthesis. EIA analysis indicated that PGE2 was the predominant PG metabolite released by unstimulated hOB cells and its synthesis was increased more than other PGs in cells treated with (TGFbeta) and …

Heat shock protein 70 (Hsp70) expression has been reported to be a sensitive biomarker of cell stress. Arsenic (As), cadmium (Cd), mercury (Hg), chromium (Cr), nickel (Ni), vanadium (V), and manganese (Mn) are widely used and exposure to these metals is associated with the development of pulmonary disease. Our data showed that exposure to these metals resulted in a significant increase in cytotoxicity, apoptosis, and generation of reactive oxygen species (ROS) in a human bronchial cell line, BEAS-2B. However, increased Hsp70 expression was observed only in cells exposed to As, Cd, and Hg. To correlate changes associated with Hsp70 overexpression, …

In our research, the quality of a number of calcium supplements was evaluated by their physical properties, disintegration and dissolution profiles. Physical tests and disintegration did show a pH sensitivity. Disintegration confirmed the good uniformity of the products. In the USP required dissolution test, most of the products did not achieve acceptable drug release in the specified time period. While formulation factors and the salt form of calcium supplements can to some extent affect their dissolution pattern, it was ultimately considered that the failure may be related to the poor solubility of the calcium salts.;Based on the results and the …

Biometric systems utilize physiological or behavioral traits to automatically identify individuals. A unimodal biometric system utilizes only one source of biometric information and suffers from a variety of problems such as noisy data, intra-class variations, restricted degrees of freedom, non-universality, spoof attacks and unacceptable error rates. Multimodal biometrics refers to a system which utilizes multiple biometric information sources and can overcome some of the limitation of unimodal system.
