Democracy Without A Net? Separation Of Powers And The Idea Of Self-Sustaining Constitutional Constraints On Undemocratic Behavior, James A. Gardner Jan 2005

Democracy Without A Net? Separation Of Powers And The Idea Of Self-Sustaining Constitutional Constraints On Undemocratic Behavior, James A. Gardner

Journal Articles

The United States Constitution is designed to achieve good government by relying on two distinct systems: a primary system that achieves good governance through democratic electoral accountability; and a set of self-sustaining structural backup systems designed for situations in which the democratic system fails, and which operate by limiting the ability of bad rulers to do serious harm to the public good. A key premise of this kind of dual structural arrangement is that effective backup systems must operate independently of primary democratic systems; because they are needed precisely when democratic mechanisms have failed, they cannot depend for their success …

Roper V. Simmons And Our Constitution In International Equipoise, Roger P. Alford Jan 2005

Roper V. Simmons And Our Constitution In International Equipoise, Roger P. Alford

Journal Articles

In Roper v. Simmons, the Court unequivocally affirms the use of comparative constitutionalism to interpret the Eighth Amendment. It does not, however, provide an obvious theoretical basis to justify the practice. This Article searches for a theory to explain the comparativism in Roper using the theories advanced in the author's previous scholarship. It concludes that of the colorable candidates, natural law constitutionalism is the most plausible explanation, with the attendant problems associated therewith. The Article concludes with an analysis of the possible ramifications of the Court's comparative approach, suggesting that it may be pursuing a Constitution that is in international …

Foreign Judgments At Common Law: Rethinking The Enforcement Rules, Tanya J. Monestier Jan 2005

Foreign Judgments At Common Law: Rethinking The Enforcement Rules, Tanya J. Monestier

Journal Articles

England and Canada have adopted divergent approaches to the enforcement of foreign civil and commercial judgments. An English court will only enforce a foreign judgment where the defendant submitted to the junsdiction of the foreign court, or was present in the foreign jurisdiction when served with process. This position. while protecting domestic defendants, is outdated and does little to further the objectives underpinning judgment enforcement- Canadian courts, by contrast, have been far more liberal than their English counterparts, enforcing foreign judgments in cases where there is a "real and substantial connection" between the dispute and the judgment forum. While this …

Fly Ash As A Soil Amendment In The Northern Red River Valley, Amy Decker Jan 2005

Fly Ash As A Soil Amendment In The Northern Red River Valley, Amy Decker

Undergraduate Theses and Senior Projects

Combustion of coal occurs worldwide to produce energy for numerous residential and industrial processes. During coal combustion, byproducts including fly ash, bottom ash and slag are formed (Lafarge, 2004). By standard regulations, power plants in the United States and many other countries must effectively capture and dispose of these byproducts. Over 118 million tons of combustion byproducts are produced and captured each year in the United States alone. Disposal of this extraordinary amount of waste is difficult and costly. Finding ways to turn this waste into a resource has been necessary, and at times, profitable.

The past fifty years has …

Influence Of Nationality On The Interpretation Of Ireland's Tourism Destination Imagery, Catriona Murphy-Underhill Jan 2005

Influence Of Nationality On The Interpretation Of Ireland's Tourism Destination Imagery, Catriona Murphy-Underhill

Plymouth Business School Theses

This thesis investigates the influence of nationality on the interpretations of the tourism destination imagery of Ireland, drawing in particular on the views of tourists travelling from Britain. It involved an assessment of the influence (if any) of the nationality of the tourist and the nationality of the place on pre- and post-visit interpretations of Ireland's perceived and projected images, as well as an evaluation of the implications of such influences on Ireland's image as a tourist destination. By means of empirical research applied to the same sample of tourists travelling from Britain to Ireland via Shannon airport, the factors …
