Legal and medical experts have noted continued racism in the health care system that prevents the equal distribution of quality care. Initially most racism was intentional and expressed through de jure segregation, as evidenced by federal funding of the construction of racial segregated health care facilities. Now most racism, expressed through de facto segregation, is subtly incorporated into the daily practices of institutions causing an adverse disparate impact on African-Americans. This institutional racism establishes separate and independent barriers through the neutral denial of opportunities and equal rights to individuals and groups that results from the normal operations of the institutions …

Owning Persons: The Application Of Property Theory To Embryos And Fetuses, Jessica Wilen Berg

Embryos are all over the news. According to the New York Times there are currently 400,000 frozen embryos in storage. Headlines proclaim amazing advances in our understanding of embryonic stem cells. And legislation involving cloning and embryos continues to be hotly debated. Despite the media attention, theoretical analysis of embryos' legal status is lacking.

This article advances a number of novel arguments. First, recognition of property interests does not preclude the recognition of personhood interests. Embryos, fetuses and children may be both persons and property. Second, property law is conceptually more suited to resolving debates about embryos than procreative liberty, …

Judicial Federalism And The Future Of Federal Environmental Regulation, Jonathan H. Adler

This article assesses the current and likely impact of the Supreme Court's federalism cases on federal environmental regulation. As a result of this assessment, the article seeks to make four points: (1) Thus far, the Supreme Court's federalism cases have had a limited impact on federal regulation, as federal courts have not used these cases as a basis for limiting the reach of federal regulatory authority. (2) Notwithstanding this limited impact, the underlying logic of the Supreme Court's cases does pose a challenge for federal regulation, particularly in the Commerce Clause context. Race, Trust, Altruism, And Reciprocity, George W. Dent

Trust, altruism and reciprocity are attracting growing attention from scholars. Interest began with psychological experiments showing that people often are altruistic, trust others, and reciprocate the benevolence of others far more than economic models of "rational" human selfishness predict. These findings inspired social scientists to discover what factors promote or hinder cooperation. Legal scholars have employed this learning to determine how the law does or could facilitate or discourage cooperation in many contexts, including business transactions and the workplace. The influence of race on cooperation has been studied in specific areas, but so far no one has considered how the …

The Sources Of Higher States Of Consciousness, Steve Taylor

International Journal of Transpersonal Studies

In this paper, it is argued that “higher states of consciousness”–or mystical experiences–have two

main sources: they can be caused by a disruption of the normal homeostasis of the human organism

and also by an intensification of the “consciousness-energy” that constitutes our being.

(These are termed HD and ICE states). The author investigates examples of both types of experience,

and compares and contrasts them. It is concluded that the second type of experience is

the only one which is truly positive and which can become a fully integrated and permanent

higher state of consciousness.

Migration monitoring of landbirds, in its various forms, is a well-established research endeavor across much of North America. While monitoring efforts at individual sites have contributed much to our knowledge of the biology of migrants, these studies have limited potential for population monitoring and for addressing certain broader questions about migrants. Meanwhile, there is still much to be learned about the habitat use, conservation needs, population trends, demographics, and general stopover ecology of migrants. A Simulation Test Of The Effectiveness Of Several Methods For Error-Checking Non-Invasive Genetic Data, David A. Roon, Lisette P. Waits, Katherine C. Kendall

Non-invasive genetic sampling (NGS) is becoming a popular tool for population estimation. However, multiple NGS studies have demonstrated that polymerase chain reaction (PCR) genotyping errors can bias demographic estimates. These errors can be detected by comprehensive data filters such as the multiple-tubes approach, but this approach is expensive and time consuming as it requires three to eight PCR replicates per locus. Thus, researchers have attempted to correct PCR errors in NGS datasets using non-comprehensive error checking methods, but these approaches have not been evaluated for reliability. The use of noninvasive genetic sampling (NGS) for surveying wild populations is increasing rapidly. Currently, only a limited number of studies have evaluated potential biases associated with NGS. This paper evaluates the potential errors associated with analysing mixed samples drawn from multiple animals. Most NGS studies assume that mixed samples will be identified and removed during the genotyping process. We evaluated this assumption by creating 128 mixed samples of extracted DNA from brown bear (Ursus arctos) hair samples. These mixed samples were genotyped and screened for errors at six microsatellite loci according to protocols consistent with those used …

The Fortymile Caribou Herd (FCH) is the most prominent caribou herd in interior Alaska. A large portion of the FCH calving and summer range lies beneath heavily used Military Operations Areas (MOA) that are important for flight training. We observed the behavior of Grant’s cow caribou (Rangifer tarandus granti) and their calves before, during, and immediately following low-level military jet overflights. We also monitored movements of radiocollared cow caribou and survival of their calves. We conducted fieldwork from mid May through early June 2002. We concluded that military jet overflights did not cause deaths of caribou calves in …
