The Next Step In Dna Databank Expansion? The Constitutionality Of Dna Sampling Of Former Arrestees, Jacqueline K. S. Lew

This Note examines current developments in state DNA databank laws and the controversy surrounding the passage of California's latest DNA databank statute to predict that the next step in DNA databank expansion has arrived-namely, the collection of DNA from former arrestees, who neither have been convicted of a felony nor remain in government custody. Ultimately, the Note suggests that despite the recent trend towards expanding DNA databases around the country, the DNA sampling of former arrestees crosses a bright line that represents the constitutional end of such expansion.

Poisoning The Well: Law & Economics And Racial Inequality, Robert E. Suggs

UC Law Journal

Early Law and Economics advocates asserted that antidiscrimination laws were wasteful and unnecessary. This Article argues that that flawed conclusion resulted in a disregard, especially among African-American political and intellectual leaders, for economic analysis as a means of understanding racial phenomenon. The lack of economic analysis of race in market transactions is of great concern. Disparities in education, housing and employment have been intractable, Suggs argues, because racial disparities in business revenues dwarf those income disparities. To solve these disparities, however, requires not regulations but market incentives. Devising market interventions requires a sophisticated understanding of the way race affects market …

As the cost of in vitro fertilization in the West skyrockets and countries enact laws that drastically curtail access to assisted reproduction, couples are turning more and more frequently to fertility tourism. This Article examines the relationship between restrictive reproductive laws, thought to be expressions of local values, and globalization, the ongoing process of worldwide interconnectedness that makes fertility tourism possible. After a discussion of the meaning and causes of fertility tourism, this Article demonstrates how such tourism dampens organized resistance to laws that restrict the available forms of assisted reproduction and thus how globalization itself plays a part in …

Technocracy And Democracy: Conflicts Between Models And Participation In Environmental Law And Planning, James D. Fine, Dave Owen

Our environmental laws create an unfortunate paradox. They mandate science-based planning, and that mandate often translates into a practical or legal requirement to use complex simulation models. These laws also contain provisions for public participation. When agencies engage in technical decisionmaking, however, and particularly when they use complex yet uncertain models, the reasoning and risks underpinning decisions becomes difficult for public participants to understand and critique. As a result, legal mandates for science-based and participatory planning come into conflict. This conflict is inherent in many environmental statutes, and is acute in the State Implementation Plan (SIP) process required by the …

Since the refinement of forensic DNA analysis in the early 199os, the problem of "wrongful execution" -the execution of persons who are actually innocent or the risk that such persons might be executed-has received considerable attention from scholars, legal practitioners, politicians, jurists, and social activists. The history of wrongful execution, however, remains unwritten.

This Article demonstrates that the problem of wrongful execution, although often considered to be a modern-day concern, preoccupied leading Anglo-American legal commentators in the seventeenth and eighteenth centuries. United States Supreme Court Justice Harry A. Blackmun was profoundly affected by reactions to his opinion in Roe v. Wade. This Lecture argues that Justice Blackmun came to identify with that decision in an intensely personal way that shaped his future jurisprudence. In defending and embracing his legacy as author of Roe v. Wade, Justice Blackmun created his legacy.

Introduction: Intracranial aneurysms (IA) are a common neurological problem, the rupture of which frequently constitutes a catastrophic neurological event. While the pathogenesis is largely unknown, it is believed that both genetic and environmental factors work in concert to some degree within patients. Our goal was to take a comprehensive approach to understanding the pathogenesis of IA by identifying factors leading to the formation, growth and rupture of IA. Methods: Since 1994, we have recruited patients and families with IA into the Yale Brain Aneurysm Database. Fluorescence Prediction Through Computational Chemistry, Daniel Craig Lathey

With the growing demand for diverse fluorescent dyes, it is imperative to find a more efficient methodology by which to synthesize dyes. Our research group has found a computational method that can efficiently predict the optical properties of a molecule before it is synthesized. By evaluating different semi-empirical methods, we have found a way to predict the fluorescence maxima. With the new ability of Hyperchem 7.5 to geometrically optimize a molecule in an excited state, we can predict not only the absorption maxima, but we can also predict the fluorescence maxima within 25 nm of the actual fluorescence.

The Natural History, Distribution, And Phenotypic Variation Of Cave-Dwelling Spring Salamanders, Gyrinophilus Spp. Cope (Plethodontidae), In West Virginia, Michael Steven Osbourn

There are over 4000 documented caves in West Virginia, potentially providing refuge and habitat for a diversity of amphibians and reptiles. Spring Salamanders, Gyrinophilus porphyriticus, are among the most frequently encountered amphibians in caves. Surveys of 25 caves provided expanded distribution records and insight into ecology and diet of G. porphyriticus. Over 500 species locality records were compiled in a nearly comprehensive list. The Gyrinophilus population from General Davis Cave is of particular interest. In 1977, Besharse and Holsinger first described the West Virginia Spring Salamander, G. subterraneus; however, its taxonomic status is unclear. In order to …

Expanding Gender And Expanding The Law: Toward A Social And Legal Conceptualization Of Gender That Is More Inclusive Of Transgender People, Dylan Vade

In Part I, the article first describes the many different ways in which one can be transgender. Many transgender women and men defy gender stereotypes. Part I next suggests a non-linear view of gender. Often, when we get past the binary gender system, the notion that there are only two genders, female and male, we do so by seeing gender as a spectrum or line running from female to male. This article claims that three common arguments against gay marriage - the definitional, procreation, and slippery-slope arguments - are quite bad, the worst of the lot. The definitional argument asserts that marriage just is the union of one man and one woman, and that the definition alone is a sufficient defense against claims for gay marriage. The procreation argument claims that marriage's central public purpose is to encourage procreation, and so the exclusion of same-sex couples is justified. Searching For Protein Classification Features, Jennifer A. Smith

Electrical and Computer Engineering Faculty Publications and Presentations

A genetic algorithm is used to search for a set of classification features for a protein superfamily which is as unique as possible to the superfamily. These features may then be used for very fast classification of a query sequence into a protein superfamily. The features are based on windows onto modified consensus sequences of multiple aligned members of a training set for the protein superfamily. The efficacy of the method is demonstrated using receiver operating characteristic (ROC) values and the performance of resulting algorithm is compared with other database search algorithms.

Codifying, and then implementing, an international right to health, health care, or protection is beset with serious roadblocks - foremost among them being contentious issues of indeterminacy, justiciability, and progressive realization.
