Even More Wrongful Death: Statutes Divorced From Reality, John G. Culhane

This Article discusses the restrictions on the class of eligible beneficiaries under most wrongful death statutes and considers recent legislative and judicial initiatives that have begun to change these laws to reflect reality. The Article analyzes the Victim Compensation Fund, passed in response to the events of September 11, 2001 as an example of the ability of legislative and regulatory rules to define eligibility for flexible recovery. The Article goes on to discuss recent legislative and judicial developments involving the torts of negligent infliction of emotional distress and loss of consortium, emphasizing that courts and legislatures are increasingly willing to …

The concrete barriers, sewer pipes, and chain-link fencing that prompted the National Capital Planning Commission’s security efforts inconvenienced city residents, workers, and visitors and degraded the appearance of one of the most carefully designed and naturally beautiful cities in the world. And yet, what made these barriers intolerable was their underlying message—that the nation’s capital would allow terrorists to limit the American hallmark of open access. The National Capital Planning Commission does not ask federal agencies to ignore the threat reality, but it does ask that agencies cease to install monuments of fear and retrenchment. Restrictions on the everyday use of public space; restrictions on access to public buildings; restrictions on political expression and assembly for political purposes; restrictions on the freedom of immigrants to use public facilities and services in the city; increased segregation, exclusion, and concentrated decentralization of residences and economic activities are all key examples of the way the false threat of terrorism has been used to restrict rights to the city. The Right to the City has never been fully recognized in modern times. The false response to the threat of terrorism has made its realization even more remote.

This Article looks at the financial effect of ethics work. The author examines to what effect and under what circumstances “ethics pays,” and what can be done to increase the rate of return. The article studies this issue in three different contexts. First, it looks at workplace cultures and professional values. The author tries to find how the legal professional can create more organizational structures in which adhering to principles serves prudential interests. The second context is pro bono work. Torn Between Two Mothers: Indigenous Women As Spiritual Mentors In Two Novels By Mexican Women Writers, Elena Sánchez Mora

In many novels by contemporary Hispanic women writers, the estrangement between mother and daughter seems to be a constant underlying theme. There are several examples of texts in which distancing between mother and daughter renders the role of the mother ineffective, prompting the daughter to search for an alternative maternal figure.

Within Mexican narrative, I have come upon four novels with protagonists who experience this predicament, but in which all the countervailing figures are indigenous women who are servants in the middle class white households inhabited by the young female characters. The inventory of rangelands in part of the Broome Shire in Western Australia was undertaken by DAFWA between 1989 and 1990. It describes and maps the natural resources of the region’s pastoral leasehold land. This survey report provides a baseline record of the existence and condition of the natural area’s resources, to assist with the planning and implementation of land management practices. The report identified and described the condition of soils, landforms, vegetation, habitat, ecosystems, and declared plants and animals. Silcrete Hardpan In The North-Eastern Wheatbelt : Hydrological Implications For Oil Mallees, D L. Bennett, Russell Speed, Adrian Goodreid, Peter Taylor

Resource management technical reports

Silcrete is a brittle, intensely indurated rock comprising primarily quartz grains cemented with siliceous allophane. It occurs at 1.5 to 7 metres deep and is often several metres thick and extremely hard, requiring excavation. This Report discusses the extent of silcrete layers in the north-eastern wheatbelt area of Western Australia, the effects of silcrete on water absorption by the soil, and the effects of this physical obstacle on the growth and expansion of oil mallee trees of the region.

Patterns Of Habitat Use By Whooping Cranes During Migration: Summary From 1977–1999 Site Evaluation Data, Jane E. Austin, Amy L. Richert

Proceedings of the North American Crane Workshop

We used site evaluation data collected during 1977–1999 to examine patterns of habitat use by whooping cranes (Grus americana) during migration through the United States portion of the Wood Buffalo–Aransas flyway. We examined characteristics of 3 types of stopover habitats: 1) roost sites (n = 141 records), 2) feeding sites (n = 306), and 3) dual-use sites (i.e., where observer recorded cranes as using a site for both roosting and feeding (n = 248). Results in spring were influenced by the large number of records from Nebraska (> 67% of spring records) and in fall by frequent observations …

Proceedings of the North American Crane Workshop

The natal and breeding dispersal of endangered whooping cranes (Grus americana) was investigated using information collected between 1978-2002 on the nesting grounds in and near Wood Buffalo National Park, Alberta-Northwest Territories. A minimum of 77% of the juveniles color-banded near their natal sites returned to the breeding grounds. Sex-biased natal dispersal was not observed. At least 76% of first-time breeders nested within 20 km of their natal site. Pioneering was rare and most cranes nested on the primary nesting areas adjacent to the Sass and Klewi rivers. Proceedings of the North American Crane Workshop

During the course of re-introduction of a non-migratory flock of whooping cranes to Florida (1993-2002) a variety of techniques were used to capture 105 free-living birds. The most commonly used technique was hand-capture from a feed trough blind (45 birds). Whooping cranes were also captured by use of snares, several types of nets, and by hand. All techniques were relatively safe and posed little risk to the birds, a primary concern when dealing with rare birds. We found it useful to employ a diversity of techniques because some methods work better than others under differing circumstances. Capturing whooping cranes for …

The whooping crane (Grus americana) is the tallest bird in North America, yet not much is known about its visual ecology. How these birds overcome their unusual height to identify, locate, track, and capture prey items is not well understood. There have been many studies on head and eye stabilization in large wading birds (herons and egrets), but the pattern of head movement and stabilization during foraging is unclear.
