Where There’S At-Will, There Are Many Ways: Redressing The Increasing Incoherence Of Employment At Will, Scott A. Moss Apr 2005

Where There’S At-Will, There Are Many Ways: Redressing The Increasing Incoherence Of Employment At Will, Scott A. Moss

ExpressO

Employment at will, the doctrine that employees have no legal remedy for unfair terminations because they hold their jobs at the will of the employer, has become mired in incoherence. State courts praise the common law rule as “essential to free enterprise” and “central to the free market,” but in recent years they have riddled the rule with increasing exceptions, allowing employee claims for whistleblowing, fraud, etc. Yet states have neither rejected employment at will nor shown any consistency in recognizing exceptions. Strikingly, states cite the same rationales to adopt and reject opposite exceptions, as a case study of two …

Criminology As Lovemaking An Africa Centered, Dr. Biko Agozino Associate Professor, Department Of Social And Behavioral Sciences Apr 2005

Criminology As Lovemaking An Africa Centered, Dr. Biko Agozino Associate Professor, Department Of Social And Behavioral Sciences

African Journal of Criminology and Justice Studies

This paper explores the potential role of love in criminal justice and jurisprudence by excavating ancient and modern philosophies of justice to reveal the puzzling evasion of love in attempts by various philosophical traditions to engineer a solution to the wobbly foundations of justice exclusively on the quicksand of rationality, authority and truth but without love. The paper will adopt the format of Platonian philosophical dialogue (originally borrowed from Africa) by staging a breaking of bread between Jens A.B. Jacobsen (JJ), a business man who died seeking universal justice through nature rather than through love and Ifi Amadiume (IA), the …

The State Of Disproportionate Minority Confinement (Dmc) In Mississippi’S Juvenile Detention Facilities, Saliba D. Mukoro Department Of Criminal Justice Apr 2005

The State Of Disproportionate Minority Confinement (Dmc) In Mississippi’S Juvenile Detention Facilities, Saliba D. Mukoro Department Of Criminal Justice

African Journal of Criminology and Justice Studies

Disproportionate Minority Confinement (DMC) has become a national issue due to several amendments to the JJDP Act of 1974 requiring compliance of all states’ participating in the formula grants program. All participating states, including the State of Mississippi, have thus introduced several programs to tackle the DMC problems in their various states for six years running. Giving these programmatic interventions, this study seeks to determine if DMC still exist in the juvenile detention facilities in the State of Mississippi. A survey instrument designed to measure racial composition of detainees was administered to the 18 juvenile facilities. The resulting data were …

Obstacles To Effective Policing In Nigeria, Emmanuel C. Onyeozili Department Of Criminal Justice Apr 2005

Obstacles To Effective Policing In Nigeria, Emmanuel C. Onyeozili Department Of Criminal Justice

African Journal of Criminology and Justice Studies

This paper traces the history of colonial social control and Policing in Nigeria, and also reviews the literature and examines how colonialism demonized, discredited, and supplanted the traditional system of policing. It establishes that in place of the old (traditional) system, colonialism imposed a new (but alien) militarized policing geared toward the colonial needs of political oppression and economic exploitation without regard to the needs of the colonized. The post colonial state was thus bequeathed a corrupt police system that fails to cater to the needs of the people. This unfortunate development explains the emergence of “ethnic armies” in the …

Pre-Colonial Criminal Justice In West Africa Eurocentric Thought Versus Africentric Evidence, David Dalgleish Policy Development Officer (Crime & Safety) Apr 2005

Pre-Colonial Criminal Justice In West Africa Eurocentric Thought Versus Africentric Evidence, David Dalgleish Policy Development Officer (Crime & Safety)

African Journal of Criminology and Justice Studies

Through the process of Eurocentric pro-colonialist propaganda people have been, and continue to be, led to assume that the European colonialists brought criminal justice and law and order to Africa. This article challenges those assumptions by using the work of scholars of African history to highlight the existence of criminal justice systems in Africa, in particular pre-colonial West Africa. In the context of a modern society dedicated to removing the tenets of discrimination on the basis of ethnicity, this work will hopefully inspire other criminologists to continue to address this under-researched area of criminology, and reassess how historical criminal justice …
